Par Nolīgumu par Starptautiskās atomenerģijas aģentūras privilēģijām un imunitātēm
1.pants.  1959.gada 1.jūlija Nolīgums par Starptautiskās atomenerģijas aģentūras privilēģijām un imunitātēm (turpmāk — Nolīgums) ar šo likumu tiek pieņemts un apstiprināts.
2.pants.  Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Nolīgums angļu valodā un tā tulkojums latviešu valodā.
3.pants.  Nolīgums stājas spēkā tā 12.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".
Likums Saeimā pieņemts 1999.gada 4.novembrī.

Agreement on the Privileges and Immunities of the Agency

1. The Agreement on the Privileges and Immunities of the International Atomic Energy Agency, the text of which is reproduced herein, was approved by the Board of Governors on 1 July 1959.

2. As required by section 38, the Director General has transmitted a certified copy of the Agreement to the Government of each Member of the Agency, and will transmit such a copy to the Government of every State that becomes a Member hereafter.

Agreement on the Privileges and Immunities of the International Atomic Energy Agency

WHEREAS Article XV.C of the Statute of the International Atomic Energy Agency provides that the legal capacity, privileges and immunities referred to in that Article shall be defined in a separate agreement or agreements between the Agency, represented for this purpose by the Director General acting under the instruction of the Board of Governors, and the Members;

WHEREAS an Agreement Governing the Relationship between the Agency and the United Nations has been adopted in accordance with Article XVI of the Statute; and

WHEREAS the General Assembly of the United Nations, contemplating the unification as far as possible of the privileges and immunities enjoyed by the United Nations and by the various agencies brought into relationship with the United Nations, has adopted the Convention on the Privileges and Immunities of the Specialized Agencies, and a number of Members of the United Nations have acceded thereto;

THE BOARD OF GOVERNORS

1. HAS APPROVED, without committing the Governments represented on the Board, the text below, which in general follows the Convention on the Privileges and Immunities of the Specialized Agencies; and

2. INVITES the Members of the Agency to consider and, if they see fit, to accept this Agreement.

Article I

Definitions

Section 1. In this Agreement:

(i) The expression "the Agency" means the International Atomic Energy Agency;

(ii) For the purposes of Article III, the words "property and assets" shall also include property and funds in the custody of the Agency or administered by the Agency in furtherance of its statutory functions;

(iii) For the purposes of Article V and VIII, the expression "representatives of Members" shall be deemed to include all Governors, representatives, alternates, advisers, technical experts and secretaries of delegations;

(iv) In sections 12, 13, 14 and 27, the expression "meeting convened by the Agency" means meetings:

(1) of its General Conference and of its Board of Governors;

(2) of any international conference, symposium, seminar or panel convened by it; and

(3) of any committee of any of these bodies;

(v) For the purposes of Article VI and IX, the expression "officials of the Agency" means the Director General and members of the staff of the Agency except those who are locally recruited and assigned to hourly rates.

Article II

Juridical Personality

Section 2. The Agency shall possess juridical personality. It shall have the capacity (a) to contract, (b) to acquire and dispose of immovable and movable property and (c) to institute legal proceedings.

Article III

Property, Funds and Assets

Section 3. The Agency, its property and assets, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except in so far as in any particular case it has expressly waived its immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution.

Section 4. The premises of the Agency shall be inviolable. The property and assets of the Agency, wherever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action.

Section 5. The archives of the Agency, and in general all documents belonging to it or held by it, shall be inviolable, wherever located.

Section 6. Without being restricted by financial control, regulations or moratoria of any kind:

(a) The Agency may hold funds, gold or currency of any kind and operate accounts in any currency;

(b) The Agency may freely transfer its funds, gold or currency from one country to another or within any country and convert any currency held by it into any other currency.

Section 7. The Agency shall, in exercising its rights under section 6, pay due regard to any representations made by the Government of any State party to this Agreement in so far as it is considered that effect can be given to such representations without detriment to the interest of the Agency.

Section 8. The Agency, its assets, income and other property shall be:

(a) Exempt from all direct taxes; it is understood, however, that the Agency will not claim exemption from taxes which are, in fact, no more than charges for public utility services;

(b) Exempt from customs duties and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Agency for its official use; it is understood, however, that articles imported under such exemption will not be sold in the country into which they were imported except under conditions agreed to with the Government of that country;

(c) Exempt from duties and prohibitions and restrictions on imports and exports in respect of its publications.

Section 9. While the Agency will not, as a general rule, claim exemption from excise duties and from taxes on the sale of movable and immovable property which form part of the price to be paid, nevertheless when the Agency is making important purchases for official use of property on which such duties and taxes have been charged or are chargeable, States parties to this Agreement will, whenever possible, make appropriate administrative arrangements for the remission or return of the amount of duty or tax.

Article IV

Facilities in Respect of Communications

Section 10. The Agency shall enjoy, in the territory of each State party to this Agreement and as far as may be compatible with any international conventions, regulations and arrangements to which that State is a party, for its official communications, treatment not less favourable than that accorded by the Government of such a State to any other Government, including the latter's diplomatic mission, in the matter of priorities, rates and taxes for posts and telecommunications, and press rates for information to the press and radio.

Section 11. No censorship shall be applied to the official correspondence and other official communications of the Agency.

The Agency shall have the right to use codes and to dispatch and receive correspondence and other official communications by courier or in sealed bags, which shall have the same immunities and privileges as diplomatic couriers and bags.

Nothing in this section shall be construed to preclude the adoption of appropriate security precautions to be determined by agreement between a State party to this Agreement and the Agency.

Article V

Representatives of Members

Section 12. Representatives of Members at meetings convened by the Agency shall, while exercising their functions and during their journeys to and from the place of meeting, enjoy the following privileges and immunities:

(a) Immunity from personal arrest or detention and from seizure of their personal baggage, and in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

(b) Inviolability for all papers and documents;

(c) The right to use codes and to receive papers or correspondence by courier or in sealed bags;

(d) Exemption in respect of themselves and their spouses from immigration restrictions, aliens' registration or national service obligations in the State which they are visiting or through which they are passing in the exercise of their functions;

(e) The same facilities in respect of currency or exchange restrictions as are accorded to representatives of foreign Governments on temporary official missions;

(f) The same immunities and facilities in respect of their personal baggage as are accorded to members of comparable rank of diplomatic missions.

Section 13. In order to secure for the representatives of Members of the Agency at meetings convened by the Agency complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of word spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Section 14. Where the incidence of any form of taxation depends upon residence, periods during which the representatives of Members of the Agency at meetings convened by the Agency are present in a Member State for the discharge of their duties shall not be considered as periods of residence.

Section 15. Privileges and immunities are accorded to the representatives of Members, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions in connection with the Agency. Consequently, a Member not only has the right but is under a duty to waive the immunity of its representatives in any case where, in the opinion of the Member, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose of which the immunity is accorded.

Section 16. The provisions of sections 12, 13 and 14 are not applicable in relation to the authorities of a State of which the person is a national or of which he is or has been a representative.

Article VI

Officials

Section 17. The Agency shall from time to time make known to the Governments of all States parties to this Agreement the names of the officials to whom the provisions of this Article and of Article IX apply.

Section 18.

(a) Officials of the Agency shall:

(i) Be immune from legal process in respect of words spoken or written and all acts performed by them in their official capacity;

(ii) Enjoy the same exemptions from taxation in respect of the salaries and emoluments paid to them by the Agency and on the same conditions as are enjoyed by officials of the United Nations;

(iii) Be immune, together with their spouses and relatives dependent on them, from immigration restrictions and alien registration;

(iv) Be accorded the same privileges in respect of exchange facilities as are accorded to officials of comparable rank of diplomatic missions;

(v) Be given, together with their spouses and relatives dependent on them, the same repatriation facilities in time of international crises as officials of comparable rank of diplomatic missions;

(vi) Have the right to import free of duty their furniture and effects at the time of first taking up their post in the country in questions.

(b) Officials of the Agency shall, while exercising the functions of an inspector under Article XII of the Statute of the Agency or those of a project examiner under Article XI thereof, and while travelling in their official capacity en route to and from the performance of these functions, enjoy all the additional privileges and immunities set forth in Article VII of this Agreement so far as is necessary for the effective exercise of such functions

Section 19. The officials of the Agency shall be exempt from national service obligations, provided that, in relation to the States of which they are nationals, such exemption shall be confined to officials of the Agency whose names have, by reason of their duties, been placed upon a list compiled by the Director General of the Agency and approved by the State concerned.

Should other officials of the Agency be called up for national service, the State concerned shall, at the request of the Agency, grant such temporary deferments in the call up of such officials as may be necessary to avoid interruption in the continuation of essential work.

Section 20. In addition to the privileges and immunities specified in sections 18 and 19 above, the Director General of the Agency, including any official acting on his behalf during his absence from duty, shall be accorded on behalf of himself, his spouse and minor children, the privileges and immunities, exemptions and facilities accorded to diplomatic envoys on behalf of themselves, their spouses and minor children, in accordance with international law. The same privileges and immunities, exemptions and facilities shall also be accorded to a Deputy Director General or official of equivalent rank of the Agency.

Section 21. Privileges and immunities are granted to officials in the interest of the Agency only and not for the personal benefit of the individuals themselves. The Agency shall have the right and the duty to waive the immunity of any official in any case where, in its opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the Agency.

Section 22. The Agency shall co-operate at all times with the appropriate authorities of Member States to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuses in connection with the privileges, immunities and facilities mentioned in this Article.

Article VII

Experts on missions for the Agency

Section 23. Experts (other than officials coming within the scope of Article VI) serving on committees of the Agency or performing missions for the Agency, including missions as inspectors under Article XII of the Statute of the Agency and as project examiners under Article XI thereof, shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connection with service on such committees or missions:

(a) Immunity from personal arrest or detention and from seizure of their personal baggage;

(b) In respect of words spoken or written or acts done by them in the performance of their official functions, immunity from legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Agency;

(c) Inviolability for all papers and documents;

(d) For the purposes of their communications with the Agency, the right to use codes and to receive papers or correspondence by courier or in sealed bags;

(e) The same facilities in respect of currency and exchange restrictions as are accorded to representatives of foreign Governments on temporary official missions;

(f) The same immunities and facilities in respect of their personal baggage as are accorded to members of comparable rank of diplomatic missions.

Section 24. Nothing in sub-paragraphs (c) and (d) of section 23 shall be construed to preclude the adoption of appropriate security precautions to be determined by agreement between a State party to this Agreement and the Agency.

Section 25. Privileges and immunities are granted to the experts of the Agency in the interests of the Agency and not for the personal benefit of the individuals themselves. The Agency shall have the right and the duty to waive the immunity of any expert in any case where, in its opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the Agency.

Article VIII

Abuses of Privilege

Section 26. If any State party to this Agreement considers that there has been an abuse of a privilege or immunity conferred by this Agreement, consultations shall be held between that State and the Agency to determine whether any such abuse has occurred and, if so, to attempt to ensure that no repetition occurs. If such consultations fail to achieve a result satisfactory to the State and the Agency, the question whether an abuse of a privilege or immunity has occurred shall be settled by a procedure in accordance with section 34. If it is found that such an abuse has occurred, the State party to this Agreement affected by such abuse has the right, after notification to the Agency, to withhold from the Agency the benefits of the privilege or immunity so abused. However, the withholding of privileges or immunities must not interfere with the Agency's principal activities or prevent the Agency from performing its principal functions.

Section 27. Representatives of Members at meetings convened by the Agency, while exercising their journeys to and from the place of meeting, and officials within the meaning of section 1 (v), shall not be required by the territorial authorities to leave the country in which they are performing their functions on account of any activities by them in their official capacity. In the case, however, of abuse of privileges of residence committed by any such person in activities in that country outside his official functions, he may be required to leave by the Government of that country, provided that:

(a) Representatives of Members, or persons who are entitled to the immunities provided in section 20, shall not be required to leave the country otherwise than in accordance with the diplomatic procedure applicable to diplomatic envoys accredited to that country;

(b) In the case of an official to whom section 20 is not applicable, no order to leave the country shall be issued by the territorial authorities other than with the approval of the Foreign Minister of the country in question, and such approval shall be given only after consultation with the Director General of the Agency; and, if expulsion proceedings are taken against an official, the Director General of the Agency shall have the right to appear in such proceedings on behalf of the person against whom they are instituted.

Article IX

Laissez-passer

Section 28. Officials of the Agency shall be entitled to use the United Nations laissez-passer in conformity with administrative arrangements concluded between the Director General of the Agency and the Secretary-General of the United Nations. The Director General of the Agency shall notify each State party to this Agreement of the administrative arrangements so concluded.

Section 29. States parties to this Agreement shall recognize and accept the United Nations laissez-passer issued to officials of the Agency as valid travel documents.

Section 30. Applications for visas, where required, from officials of the Agency holding United Nations laissez-passer, when accompanied by a certificate that they are travelling on the business of the Agency, shall be dealt with as speedily as possible. In addition, such person shall be granted facilities for speedy travel.

Section 31. Similar facilities to those specified in section 30 shall be accorded to experts and other persons who, though not holders of United Nations laissez-passer, have a certificate that they are traveling on the business of the Agency.

Section 32. The Director General, the Deputy Directors General and other officials of a rank not lower than head of division of the Agency, travelling on United Nations laissez-passer on the business of the Agency, shall be granted the same facilities for travel as are accorded to officials of comparable rank in diplomatic missions.

Article X

Settlement of Disputes

Section 33. The Agency shall make provision for appropriate modes of settlement of:

(a) Disputes arising out of contracts or the disputes of a private character to which the Agency is a party;

(b) Disputes involving any official or expert of the Agency who by reason of his official position enjoys immunity, if immunity has not been waived in accordance with section 21 or 25.

Section 34. Unless in any case it is agreed by the parties to have recourse to another mode of settlement, all differences arising out of the interpretation or application of the present Agreement shall be referred to the International Court of Justice, in accordance with the Statute of the Court. If a difference arises between the Agency and a Member and they do not agree on any other mode of settlement, a request shall be made for an advisory opinion on any legal question involved, in accordance with Article 96 of the Charter of the United Nations and Article 65 of the Statute of the Court and the relevant provisions of the agreement concluded between the United Nations and the Agency. The opinion given by the Court shall be accepted as decisive by the parties.

Article XI

Interpretation

Section 35. The provisions of this Agreement shall be interpreted in the light of the functions with which the Agency is entrusted by its Statute.

Section 36. The provisions of this Agreement shall in no way limit or prejudice the privileges and immunities which have been, or may hereafter be, accorded to the Agency by any State by reason of the location in the territory of that State of the Agency's Headquarters or regional offices, or of officials, experts, materials, equipment or facilities in connection with Agency projects or activities, including the application of safeguards to an Agency project or other arrangement. This Agreement shall not be deemed to prevent the conclusion between the Agency and any State party thereto of supplemental agreements adjusting the provisions of this Agreement or extending or curtailing the privileges and immunities thereby granted.

Section 37. This Agreement shall not itself operate so as to abrogate, or derogate from, any provisions of the Statute of the Agency or any rights or obligations which the Agency may otherwise have, acquire or assume.

Article XII

Final Provisions

Section 38. This Agreement shall be communicated to every Member of the Agency for acceptance. Acceptance shall be effected by the deposit with the Director General of an instrument of acceptance, and the Agreement shall come into force as regards each Member on the date of deposit of that Member's instrument of acceptance. It is understood that, when an instrument of acceptance is deposited on behalf of any State, that State will be in a position under its own law to give effect to the terms of this Agreement. The Director General shall transmit a certified copy of this Agreement to the Government of every State now or hereafter becoming a Member of the Agency, and shall inform all Members of the deposit of each instrument of acceptance and of the filing of any notification of denunciation provided for in section 39.

It shall be permissible for a Member to make reservations to this Agreement. Reservations may be made only at the time of the deposit of the Member's instrument of acceptance, and shall immediately be communicated by the Director General to all Members of the Agency.

Section 39. This Agreement shall continue in force as between the Agency and every Member which has deposited an instrument of acceptance for so long as that Member remains a Member of the Agency, or until a revised agreement has been approved by the Board of Governors and that Member has become a party to this revised agreement, provided that if a Member files a notification of denunciation with the Director General this Agreement shall cease to be in force with respect to such Member one year after the receipt of such notification by the Director General.

Section 40. At the request of one-third of the States parties to this Agreement, the Board of Governors of the Agency shall consider whether to approve amendments thereto. Amendments approved by the Board shall enter into force upon their acceptance in accordance with the procedure provided in section 38.

Nolīgums par aģentūras privilēģijām un imunitātēm

1. Šā nolīguma par Starptautiskās atomenerģijas aģentūras privilēģijām un imunitātēm tekstu Valde apstiprinājusi 1959. gada 1.jūlijā.

2. Saskaņā ar 38. nodaļu, ģenerāldirektors ir nosūtījis apstiprinātu šī nolīguma eksemplāru katrai Aģentūras dalībvalsts valdībai, un nosūtīs apstiprinātu šī nolīguma eksemplāru katrai valsts valdībai, kura kļuvusi par dalībvalsti vēlāk.

Nolīgums par Starptautiskās atomenerģijas aģentūras privilēģijām un imunitātēm  

ŅEMOT VĒRĀ Starptautiskās atomenerģijas aģentūras Statūtu XV.C pantu, kurš reglamentē juridisko tiesībspēju, privilēģijas un imunitātes, nosaka ar atsevišķu nolīgumu vai nolīgumiem starp Aģentūru, kuru šim nolūkam pārstāv Ģenerāldirektors, kurš darbojas atbilstoši Valdes pilnvarojumam, un dalībvalstīm;

ŅEMOT VĒRĀ, ka nolīgums, kas reglamentē Aģentūras un Apvienoto Nāciju Organizācijas attiecības, ir noslēgts atbilstoši Statūtu XVI pantam; un

ŅEMOT VĒRĀ, ka Apvienoto Nāciju Organizācijas Ģenerālā Asambleja, iecerot pēc iespējas unificēt privilēģijas un imunitātes, kuras bauda Apvienoto Nāciju Organizācija un dažādas aģentūras, kuras ir saistītas ar Apvienoto Nāciju Organizāciju, ir pieņēmušas Konvenciju par specializēto aģentūru privilēģijām un imunitātēm, un vairākas Apvienoto Nāciju Organizācijas dalībvalstis tai pievienojušās;

VALDE

1. IR APSTIPRINĀJUSI, neuzliekot nekādus pienākumus Valdē pārstāvētajām valdībām, zemāk doto tekstu, kas visumā atbilst Konvencijai par Specializēto aģentūru privilēģijām un imunitātēm; un

2. AICINA Aģentūras dalībvalstis izvērtēt šo Nolīgumu, un, ja tas ir pieņemams, akceptēt to.

I pants

Terminu skaidrojums

1. daļa. Šajā Nolīgumā:

(i) Termins "Aģentūra" nozīmē Starptautiskā atomenerģijas aģentūra;

(ii) III pantā lietotais termins "īpašums un aktīvi" ietver arī īpašumu un fondus, kas atrodas Aģentūras pārziņā vai Aģentūra tos pārvalda, lai pildītu tās Statūtos noteiktās funkcijas;

(iii) V un VIII pantā lietotais termins "dalībvalstu pārstāvji" ietver visus pārvaldniekus, pārstāvjus, pilnvarotos, padomdevējus, tehniskos ekspertus un delegāciju sekretārus;

(iv) 12., 13., 14. un 27. daļā lietotais termins "Aģentūras sasauktās sapulces" nozīmē sēdes, kurās sanāk:

    (1) Aģentūras ģenerālā konference un Valdes konference;

    (2) jebkāda Aģentūras sasaukta starptautiska konference, simpozijs, seminārs vai ekspertu grupas sapulce; un

    (3) jebkura šo institūciju komiteja;

(v) VI un IX pantā lietotais termins "Aģentūras amatpersonas" nozīmē Ģenerāldirektoru un Aģentūras sekretariāta darbiniekus, izņemot vietējos darbiniekus, kuri strādā pēc stundu likmes.

II pants

Juridiskais statuss

2. daļa. Aģentūrai ir juridiskas personas statuss. Tai ir tiesībspēja (a) slēgt kontraktus, (b) iegādāties un realizēt kustamo un nekustamo īpašumu, (c) ierosināt tiesas procesus.

III pants

Īpašums, fondi un aktīvi

3. daļa. Aģentūra, tās īpašums un aktīvi, neatkarīgi no tā kur tie atrodas un kas tos pārvalda, bauda imunitāti pret jebkura veida juridisku procesu, izņemot gadījumu, ja Aģentūra nav noteikti atteikusies no imunitātes kādā atsevišķā gadījumā. Tomēr, ir saprotams, ka atteikšanās no imunitātes neattiecas uz jebkuru tiesas lēmumu.

4. daļa. Aģentūras telpas ir neaizskaramas. Aģentūras īpašums un aktīvi neatkarīgi no tā kur tie atrodas un kas tos pārvalda nedrīkst tikt pakļauti pārmeklēšanai, rekvizīcijai, konfiskācijai, ekspropriācijai un jebkurai citai īpašuma aizskaršanas formai, neatkarīgi no tā, vai tā saistīta ar izpildu, administratīvu, tiesas vai likumdošanas darbību.

5. daļa. Aģentūras arhīvi un visi tai piederošie vai pārvaldītie dokumentiem ir neaizskarami, neatkarīgi no tā, kur tie atrodas.

6. daļa. Nepakļaujoties nekādai finansu kontrolei, noteikumiem vai moratorijam:

(a) Aģentūrai var piederēt fondi, zelts vai jebkura veida valūta un tā var veikt finansu operācijas jebkurā valūtā;

(b) Aģentūra var brīvi pārsūtīt savus fondus, zeltu vai valūtu no vienas valsts uz citu vai jebkuras valsts robežās un konvertēt jebkuru tai piederošo valūtu citā valūtā;

7. daļa. Aģentūra, izmantojot savas 6. daļā noteiktās tiesības, ņem vērā jebkuras valsts valdības, kura ir šī Nolīguma dalībvalsts, pieprasījumu, ja zināms, ka šo pieprasījumu var izpildīt, nekaitējot Aģentūras interesēm.

8. daļa. Aģentūra, tās aktīvi, ienākumi un citi īpašumi:

(a) Ir atbrīvoti no visiem tiešiem nodokļiem; tomēr, ir saprotams, ka Aģentūra neprasa atbrīvot no nodokļiem, kuri, faktiski, nav nekas vairāk kā maksājumi par komunālajiem pakalpojumiem;

(b) Ir atbrīvoti no muitas nodokļiem un importa un eksporta aizliegumiem un ierobežojumiem, kādus uzliek priekšmetiem, kurus Aģentūra importē vai eksportē savām dienesta vajadzībām; tomēr, ir saprotams, ka šādi atbrīvotus importētus priekšmetus nepārdos valstī, kurā tie ievesti, izņemot gadījumus, kad par to vienojas ar šīs valsts valdību;

(c) Ir atbrīvoti no nodokļiem, importa un eksporta aizliegumiem un ierobežojumiem, attiecībā uz Aģentūras preses izdevumiem.

9. daļa. Kaut arī Aģentūra parasti nemēdz prasīt atbrīvot to no akcīzes nodokļiem vai nodokļiem par kustamā un nekustamā īpašuma pārdošanu, kuri ietilpst cenā, tomēr, ja Aģentūra dienesta vajadzībām iegādājas ievērojamu īpašuma daudzumu un tas ir aplikts vai pakļauts aplikšanai ar šādiem nodokļiem un nodevām, šī Nolīguma dalībvalstis, ja iespējams, noslēdz atbilstošu administratīvu vienošanos par nodokļu atlaišanu vai atmaksāšanu.

IV pants

Sakaru līdzekļi

10. daļa. Aģentūra savu oficiālo sakaru jomā katras šī Nolīguma dalībvalsts teritorijā, ciktāl tas nav pretrunā ar starptautiskām konvencijām, noteikumiem un nolīgumiem, kuros šī valsts ir dalībniece, bauda ne mazāk labvēlīgus nosacījumus kā tos, ko šīs valsts valdība nodrošina jebkurai citai valdībai, ieskaitot pēdējās diplomātisko pārstāvniecību attiecībā uz prioritātēm, tarifiem, maksājumiem par pasta sūtījumiem un telekomunikāciju līdzekļu izmantošanu, kā arī attiecībā uz pazeminātu maksu par informāciju, ko sniedz presē un radio.

11. daļa. Aģentūras oficiālā korespondence un oficiālie sakari netiek pakļauti cenzūrai.

Aģentūrai ir tiesības lietot šifru un nosūtīt un saņemt korespondenci un izmantot citus oficiālus sakaru līdzekļus ar kurjeru vai aizzīmogotos pasta sūtījumos, uz kuriem attiecas tādas pašas imunitātes un privilēģijas kā uz diplomātiskiem kurjeriem un pasta sūtījumiem.

Neviens šīs daļas nosacījums nebūtu interpretējams kā kavējošs veikt atbilstošus drošības pasākumus, kas noteikti ar Aģentūras un šī Nolīguma dalībvalsts savstarpēju vienošanos.

V pants

Aģentūras dalībvalstu pārstāvniecība

12. daļa. Aģentūras dalībvalstu pārstāvji Aģentūras sasauktajās sapulcēs, izpildot savus dienesta pienākumus, un ceļā uz sanāksmes vietu vai atgriežoties no tās, bauda sekojošas privilēģijas un imunitātes:

(a) Imunitāti pret personas arestu vai aizturēšanu un personīgās bagāžas konfiscēšanu un imunitāti pret jebkura veida tiesas procesu, attiecībā uz mutiskiem vai rakstiskiem izteikumiem un visām darbībām, ko šie pārstāvji izpildījuši kā oficiālas amatpersonas;

(b) Visu dokumentu neaizskaramību;

(c) Tiesības lietot šifru un saņemt dokumentus un korespondenci ar kurjeru vai aizzīmogotā pasta sūtījumā;

(d) Pārstāvji un viņu dzīvesbiedri ir atbrīvoti no imigrācijas ierobežojumiem, nepilsoņu reģistrācijas vai valsts obligātā militārā dienesta pienākumiem valstī, kurā viņi apmetušies uz laiku vai atrodas caurbraucot, pildot savus dienesta pienākumus;

(e) Tādus pašus atvieglojumus attiecībā uz valūtu vai tās maiņu, kādi piešķirti ārvalstu valdību pārstāvjiem īslaicīgos dienesta komandējumos;

(f) Tādas pašas imunitātes un atvieglojumus attiecībā uz viņu bagāžu, kādi piešķirti diplomātisko misiju līdzvērtīga ranga darbiniekiem.

13. daļa. Lai Aģentūras dalībvalstu pārstāvjiem Aģentūras sasaukto sapulču laikā nodrošinātu pilnu vārda brīvību un neatkarību viņu pienākumu pildīšanai, imunitāte pret tiesas procesiem attiecībā uz mutiskiem vai rakstiskiem izteikumiem un visām darbībām, ko šie pārstāvji izpildījuši kā oficiālas amatpersonas, turpina darboties, neņemot vērā, ka minētās personas vairs neizpilda savus dienesta pienākumus.

14. daļa. Gadījumus, kad aplikšana ar jebkāda veida nodokļiem atkarīga no uzturēšanās kādā valstī, laiku, kurā Aģentūras dalībvalstu pārstāvji piedalās kādā dalībvalstī Aģentūras sasauktā sapulcē, veicot savus dienesta pienākumus, neuzskata par uzturēšanās laiku šajā valstī.

15. daļa. Privilēģijas un imunitātes tiek piešķirtas dalībvalstu pārstāvjiem nevis atsevišķu personu interešu dēļ, bet lai nodrošinātu viņu pienākumu pret Aģentūru neatkarīgu izpildi. No tā izriet, ka dalībvalstij ne tikai ir tiesības, bet arī pienākums atcelt savu pārstāvju imunitāti katrā gadījumā kad, pēc dalībvalsts uzskata, imunitāte traucētu likumīgu darbību un kad imunitāti var atcelt nekaitējot tiem mērķiem, kuru dēļ tā tika piešķirta.

16. daļa. 12., 13. un 14. daļas nosacījumi neattiecas uz pārvaldes institūcijām valstī, kuras pilsonis ir minētā persona, vai šī persona ir šīs valsts pārstāvis vai arī bijis tās pārstāvis.

VI pants

Amatpersonas

17. daļa. Aģentūra periodiski informē šī Nolīguma dalībvalstu valdības par to amatpersonu uzvārdiem, uz kuriem attiecas šī un IX panta nosacījumi.

18. daļa.

(a) Aģentūras amatpersonas:

(i) Ir imūnas pret jebkuru tiesas procesu attiecībā uz mutiskiem vai rakstiskiem izteikumiem un visām darbībām, ko tās izpildījušas, veicot dienesta pienākumus

(ii) Bauda tādu pašu atbrīvošanu no nodokļiem, ar kuriem apliek Aģentūras maksāto algu vai naudas prēmijas, un saskaņā ar tādiem pašiem noteikumiem kā Apvienoto Nāciju Organizācijas amatpersonas;

(iii) Ir kopā ar dzīvesbiedriem un no tiem atkarīgiem radiniekiem imūnas pret imigrācijas ierobežojumiem un nepilsoņu reģistrāciju;

(iv) Bauda tādas pašas privilēģijas attiecībā pret naudas maiņas atvieglojumiem kā līdzvērtīga ranga diplomātisko misiju amatpersonas;

(v) Bauda kopā ar dzīvesbiedriem un no tiem atkarīgiem radiniekiem, tādus pašus repatriācijas atvieglojumus starptautiska konflikta gadījumā, kā līdzvērtīga ranga diplomātisko misiju amatpersonas;

(vi) Bauda tiesības importēt bez nodokļu maksas mēbeles un citus priekšmetus, stājoties amatā minētajā valstī pirmo reizi;

(b) Aģentūras amatpersonas, pildot inspektora pienākumus, saskaņā ar Aģentūras Statūtu XII pantu, un pienākumus, kas saistīti ar projektu pārbaudi, saskaņā ar XI pantu, un dodoties kā amatpersonas uz savu pienākumu izpildes vietu vai atgriežoties no tās, bauda visas papildu privilēģijas un imunitātes, kas noteiktas šī Nolīguma VII pantā, ciktāl tas nepieciešams, lai efektīvi pildītu savus dienesta pienākumus.

19. daļa. Aģentūras amatpersonas ir atbrīvotas no valsts obligātā militārā dienesta, ja, attiecībā uz valstīm, kuru pilsoņi tie ir, šāda atbrīvošana attiecas tikai uz Aģentūras amatpersonām, kuru uzvārdi atrodas Aģentūras Ģenerāldirektora dienesta vajadzībām sastādītā sarakstā un to apstiprinājusi ieinteresētā valsts.

Gadījumā, ja citas Aģentūras amatpersonas iesauc valsts obligātā militārā dienestā, minētā valsts pēc Aģentūras lūguma nodrošina tādu īslaicīgu iesaukuma atlikšanu tām amatpersonām, kurām tas nepieciešams, lai nepārtrauktu kāda svarīga uzdevuma izpildi.

20. daļa. Bez 18. un 19. nodaļā minētajām privilēģijām un imunitātēm Aģentūras Ģenerāldirektors, tāpat arī jebkura amatpersona, kas pilda viņa pienākumus tā prombūtnes laikā, bauda attiecībā uz sevi, savu dzīvesbiedru un nepilngadīgiem bērniem, tādas pašas privilēģijas un imunitātes, atbrīvojumus un atvieglojumus kā diplomātiskie sūtņi, viņu dzīvesbiedri un nepilngadīgie bērni saskaņā ar starptautiskajām tiesībām. Tādas pašas privilēģijas, imunitātes, atbrīvojumi un atvieglojumi tiek piešķirti Ģenerāldirektora vietniekam un līdzvērtīga ranga Aģentūras amatpersonai.

21. daļa. Privilēģijas un imunitātes tiek nodrošinātas tikai Aģentūras interesēs un nevis kādas atsevišķas personas interesēs. Aģentūrai ir tiesības un pienākums atcelt jebkuras personas imunitāti, gadījumā, ja Aģentūra uzskata, ka imunitāte traucētu likumīgu darbību un tā var tikt atcelta, nekaitējot Aģentūras interesēm.

22. daļa. Aģentūra pastāvīgi sadarbojas ar tās dalībvalstu atbilstošām valsts pārvaldes institūcijām, lai sekmētu taisnīguma ievērošanu, nodrošinātu policijas prasību ievērošanu un novērstu jebkuru konfliktu attiecībā uz privilēģijām, imunitātēm un atvieglojumiem, kas minētas šajā pantā.

VII pants

Aģentūras norīkotie eksperti

23. daļa. Ekspertiem (bet ne amatpersonām, saskaņā ar VI pantu), kas strādā Aģentūras komitejās vai Aģentūras uzdevumā atrodas komandējumā, tai skaitā kā inspektori saskaņā ar Aģentūras Statūtu XII pantu un kā inspektori, kas izdara projektu pārbaudi saskaņā ar XI pantu, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas nepieciešams šo ekspertu pienākumu efektīvai izpildei, ieskaitot pārbraucienu laiku, kas saistīti ar darbu šajās komitejās vai komandējumos:

(a) Imunitāti pret personas arestu vai aizturēšanu un personīgās bagāžas konfiscēšanu;

(b) Imunitāte pret tiesas procesiem attiecībā uz mutiskiem vai rakstiskiem izteikumiem un visām darbībām, ko viņi izdarījuši, pildot savus dienesta pienākumus, turpina darboties, neņemot vērā, ka minētās personas vairs nestrādā Aģentūras komitejās vai neatrodas komandējumā Aģentūras uzdevumā;

(c) Visu dokumentu neaizskaramību;

(d) Lai varētu sazināties ar Aģentūru, tiesības lietot šifru un saņemt papīrus un dokumentus ar kurjeru vai aizzīmogotā pasta sūtījumā;

(e) Tādi paši atvieglojumi attiecībā uz valūtu vai tās apmaiņu, kādi piešķirti ārzemju valdību pārstāvjiem īslaicīgos dienesta komandējumos;

(f) Tādas pašas imunitātes un atvieglojumi attiecībā uz viņu personīgo bagāžu, kādi piešķirti līdzvērtīga ranga diplomātisko misiju amatpersonām.

24. daļa. Neviens nosacījums 23. daļas (c) un (d) apakšpunktos nevar tikt interpretēts kā kavējošs veikt atbilstošus drošības pasākumus, kas noteikti ar Aģentūras un šī Nolīguma dalībvalsts savstarpēju vienošanos.

25. daļa. Privilēģijas un imunitātes tiek nodrošinātas tikai Aģentūras interesēs un nevis kādas atsevišķas personas interesēs. Aģentūrai ir tiesības un pienākums atcelt jebkura eksperta imunitāti, gadījumā, ja Aģentūra uzskata, ka imunitāte traucētu likumīgu darbību un tā var tikt atcelta, nekaitējot Aģentūras interesēm.

VIII pants

Privilēģiju ļaunprātīga izmantošana

26. daļa. Ja kāda no šī Nolīguma dalībvalstīm uzskata, ka notikusi šajā Nolīgumā noteikto privilēģiju vai imunitāšu ļaunprātīga izmantošana, tiek veiktas šīs valsts un Aģentūras konsultācijas, lai noskaidrotu, vai šāds pārkāpums ir noticis, un, ja ir noticis, mēģināt nepieļaut līdzīgu gadījumu atkārtošanos. Ja šādas konsultācijas nedod Aģentūru vai minēto valsti apmierinošus rezultātus, jautājums par to, vai kādu privilēģiju vai imunitāšu ļaunprātīga izmantošana notikusi, jārisina atbilstoši 34. daļā minētai procedūrai. Ja tiek atklāts, ka šāds pārkāpums noticis, šī Nolīguma dalībvalstij ir tiesības, iepriekš informējot Aģentūru, liegt tai pārkāpto privilēģiju un imunitāšu turpmāku izmantošanu. Tomēr, privilēģijas vai imunitātes atcelšana nedrīkst traucēt Aģentūras galvenajiem uzdevumiem un kavēt Aģentūras galveno funkciju izpildi.

27. daļa. Aģentūras dalībvalstu pārstāvjus Aģentūras sasauktajās sapulcēs, izpildot savus pienākumus un dodoties uz sapulces vietu vai atgriežoties no tās, un amatpersonas (kā skaidrots 1. (v) nodaļā) teritoriālie pārvaldes orgāni nevar izraidīt no valsts, kamēr Aģentūras pārstāvji pilda jebkurus dienesta stāvokļa uzliktos pienākumus. Tomēr, ja šādas personas pārkāpušas privilēģijas, kas saistītas ar uzturēšanās laiku kādā valstī, ar darbību, kas neietilpst šo personu dienesta pienākumos, tad šīs valsts valdība var tās izraidīt, ar noteikumu, ka

(a) Aģentūras dalībvalstu pārstāvjus vai personas, uz kurām attiecas 20. daļas noteiktās privilēģijas, nevar tikt izraidītas citādi, kā tikai saskaņā ar diplomātisko procedūru, kādu piemēro šajā valstī akreditētajiem sūtņiem;

(b) Ja uz šo amatpersonu nav attiecināmi 20. daļas nosacījumi, vietējās varas pārstāvji nevar izdot pavēli par izraidīšanu citādi, kā tikai ar minētās valsts ārlietu ministrijas piekrišanu, pie tam šāda piekrišana var tikt saņemta tikai pēc konsultēšanās ar Aģentūras Ģenerāldirektoru; ja tiek ierosināts tiesas process par izraidīšanu pret kādu amatpersonu, ģenerāldirektoram ir tiesības uzstāties šīs amatpersonas vārdā.

IX pants

Caurlaides

28. daļa. Aģentūras amatpersonām ir tiesības izmantot Apvienoto Nāciju Organizācijas caurlaides saskaņā ar administratīviem nolīgumiem, kas noslēgti starp Aģentūras Ģenerāldirektoru un Apvienoto Nāciju Organizācijas Ģenerālsekretāru. Aģentūras Ģenerāldirektors informē katru šī Nolīguma dalībvalsti par šādiem noslēgtiem administratīviem nolīgumiem.

29. daļa. Xl Nolīguma dalībvalstis atzīst un pieņem Aģentūras amatpersonām izsniegtās Apvienoto Nāciju Organizācijas caurlaides kā spēkā esošu ceļojumu dokumentu.

30. daļa. Pieprasījumi vīzu izsniegšanai, kur tās nepieciešamas Aģentūras amatpersonām, kurām ir Apvienoto Nāciju Organizācijas caurlaides, tiek izskatīti iespējami īsā laikā, ja šādi pieprasījumi tiek iesniegti vienlaicīgi ar apliecinājumu, ka šīs personas atrodas dienesta ceļojumā Aģentūras uzdevumā. Bez tam šādām personām jānodrošina atviegloti dienesta ceļojuma noteikumi.

31. daļa. Līdzīgus atvieglojumus, kā norādīts 30. daļā, piešķir ekspertiem un citām personām, kurām nav Apvienoto Nāciju Organizācijas caurlaides, bet ir apliecinājums, ka tās atrodas dienesta ceļojumā Aģentūras uzdevumā.

32. daļa. Aģentūras Ģenerāldirektors, viņa vietnieki un citas amatpersonas, ne zemāka ranga kā daļas vadītājs, veicot dienesta braucienu ar Apvienoto Nāciju Organizācijas caurlaidēm un Aģentūras uzdevumā, bauda tādus pašus ceļojuma atvieglojumus, kā līdzvērtīga ranga diplomātiskās amatpersonas.

X pants

Strīdu izskatīšana

33. daļa. Aģentūra izstrādā noteikumus, lai atbilstošā kārtībā izšķirtu:

(a) Strīdus, kas izraisījušies sakarā ar kontraktiem vai personīga rakstura strīdus, kuros Aģentūra ir viena no pusēm;

(b) Strīdus, kas saistīti kādu Aģentūras amatpersonu vai kādu ekspertu, kas saskaņā ar savu oficiālo statusu bauda imunitāti, ja tā nav atcelta saskaņā ar attiecīgajiem 21. un 25. daļas noteikumiem.

34. daļa. Ja puses nevienojas par citu strīdus izšķiršanas kārtību, tad visas domstarpības, ko izraisa šī Nolīguma interpretēšana vai pielietošana, iesniedz Starptautiskajā Tiesā saskaņā ar Tiesas Statūtiem. Ja domstarpības rodas Aģentūras un tās dalībvalsts starpā, un puses nevienojas par citu strīdus izšķiršanas kārtību, tad tiek pieprasīts konsultatīvs slēdziens par jebkuru ar minētajām domstarpībām saistītu juridisku jautājumu saskaņā ar Apvienoto Nāciju Organizācijas Statūtu 96. pantu un Tiesas Statūtu 65. pantu un attiecīgiem noteikumiem nolīgumā, kas noslēgts starp Apvienoto Nāciju Organizāciju un Aģentūru. Tiesas slēdziens abām pusēm ir galīgs.

XI pants

Interpretācija

35. daļa. Nolīguma nosacījumi interpretējami, vadoties no Aģentūras funkcijām, kā tās izklāstītas Aģentūras Statūtos.

36. daļa. XI Nolīguma nosacījumi nekādā veidā neierobežo un nekavē privilēģijas un imunitātes, kuras piešķirtas vai var tikt piešķirtas nākotnē kādai Aģentūras dalībvalstij, ņemot vērā, ka šīs valsts teritorijā atrodas Aģentūras Galvenā mītne vai reģionālās daļas vai darbinieki, eksperti, materiāli, iekārtas vai tehniskie līdzekļi, kas paredzēti Aģentūras projektu īstenošanai vai darbībai, tai skaitā garantiju piemērošana Aģentūras projektiem vai citiem pasākumiem. Tiek uzskatīts, ka šis Nolīgums netraucē Aģentūru un jebkuru tās dalībvalsti slēgt papildu nolīgumus, kas regulē šī Nolīguma noteikumus, paplašina vai sašaurina šī Nolīguma noteikto privilēģiju un imunitāšu robežas.

37. daļa. Šis Nolīgums nevar tikt izmantots tā, lai anulētu vai mazinātu kāda Aģentūras Statūtu vai kādu citu tiesību un pienākumu nozīmi, kurus Aģentūra var pieņemt, iegūt vai uzņemties.

XII pants

Noslēguma nosacījumi

38. daļa. Šis Nolīgums tiek izsūtīts akceptēšanai visām Aģentūras dalībvalstīm. Nolīgums ir akceptēts no tā brīža, kad Ģenerāldirektoram tiek iesniegts akceptēšanas akts un stājas spēkā katrai dalībvalstij, ar to dienu, kad tā iesniedz savu akceptēšanas aktu. Tiek pieņemts, ka valsts, kuras vārdā tiek iesniegts akceptēšanas akts, balstoties uz savu likumdošanu, varēs īstenot šī Nolīguma noteikumus. Ģenerāldirektors nodod apstiprinātu Nolīguma kopiju katras valsts valdībai, kura kļuvusi vai drīzumā kļūs par Aģentūras locekli, un informē katru dalībvalsti par katra akceptēšanas akta iesniegšanu un par katru iesniegumu vai denonsēšanu kā norādīts 39. daļā.

Nolīguma dalībvalsts var izteikt iebildumus attiecībā uz Nolīgumu. Iebildumus var izteikt tikai tajā laikā, kad dalībvalsts nodod glabāšanā savu akceptēšanas aktu, un Ģenerāldirektors nekavējoties informē par šiem iebildumiem visas Aģentūras dalībvalstis. tis.

39. daļa. Šis Nolīgums ir spēkā starp Aģentūru un katru tās dalībvalsti, kura nodevusi glabāšanā savu akceptēšanas aktu, tik ilgi, kamēr šī valsts ir Aģentūras locekle, vai kamēr Valde nebūs apstiprinājusi grozīto nolīgumu un minētā dalībvalsts nekļūs par grozītā nolīguma dalībnieci, ar noteikumu, ja dalībvalsts nosūtīs Ģenerāldirektoram paziņojumu par izstāšanos, nolīgums šai valstij paliks spēkā vienu gadu pēc iesnieguma iesniegšanas Ģenerāldirektoram.

40.  daļa. Pēc vienas trešdaļas šī Nolīguma dalībvalstu pieprasījuma Aģentūras Valdei jāapspriež jautājums par attiecīgo labojumu izdarīšanas Nolīgumā. Labojumi, ko apstiprinājusi Valde, stājas spēkā pēc to pieņemšanas saskaņā ar 38.daļas nosacījumiem.
