Par Latvijas Republikas valdības un Kipras Republikas valdības nolīgumu par gaisa satiksmi
1.pants. 1999.gada 26.martā parakstītais Latvijas Republikas valdības un Kipras Republikas valdības nolīgums par gaisa satiksmi (turpmāk - Nolīgums) un tā pielikums (turpmāk - Pielikums) ar šo likumu tiek pieņemti un apstiprināti.
2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Nolīgums un Pielikums angļu valodā un to tulkojums latviešu valodā.
3.pants. Nolīgums stājas spēkā tā 23.panta 1.punktā noteiktajā laikā un kārtībā. Ārlietu ministrija publicē oficiālu paziņojumu par Nolīguma stāšanos spēkā laikrakstā "Latvijas Vēstnesis".
Likums Saeimā pieņemts 1999.gada 3.jūnijā.

Air Services Agreement between the Government of the Republic of Latvia and the Government of the Republic of Cyprus

The Government of the Republic of Latvia and the Government of the Republic of Cyprus (hereinafter referred to in this Agreement as the Contracting Parties),

Being parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944;

Desiring to conclude an Agreement for the purpose of establishing scheduled air services between and beyond their respective territories;

Have agreed as follows:

Article 1

DEFINITIONS

1. For the purpose of this Agreement, unless the context otherwise requires:

(a) the term "Convention" means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944, and includes any Annex adopted under Article 90 of that Convention and any amendment of the Annexes or Convention under Articles 90 and 94 thereof so far as those Annexes and amendments have become effective for both Contracting Parties;

(b) the term "aeronautical authorities" means in the case of the Government of the Republic of Latvia the Ministry of Transport and in the case of the Government of the Republic of Cyprus the Minister of Communications and Works or, in both cases, any other person or body authorized to perform any functions presently exercised by the said aeronautical authorities;

(c) the term "designated airline" means an airline which has been designated and authorized in accordance with Article 4 of this Agreement;

(d) the term "tariff" means the prices to be paid for the carriage of passengers and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services but excluding remuneration and conditions for the carriage of mail;

(e) the term "territory" in relation to a State has the meaning assigned to it in Article 2 of the Convention;

(f) the terms "air service" , "international air service" , "airline" and "stop for non-traffic purposes" have the meaning respectively assigned to them in Article 96 of the Convention.

2. It is understood that the titles given to the Articles of this Agreement do in no way restrict or extend the meaning of any of the provisions of this Agreement.

Article 2

APPLICABILITY OF CHICAGO CONVENTION

The provisions of this Agreement shall be subject to the provisions of the Convention insofar as those provisions are applicable to international air services.

Article 3

GRANTING OF RIGHTS

1. Each Contracting Party grants to the other Contracting Party the rights specified in this Agreement for the purpose of established and operating scheduled international air services on the routes specified in the Route Schedule annexed to this Agreement. Such services and routes are hereinafter called "the agreed services" and "the specified routes" respectively.

2. An airline designated by each Contracting Party shall enjoy, whilst operating an agreed service on a specified route, the following rights:

(a) to fly, without landing, across the territory of the other Contracting Party;

(b) to make stops in the said territory for non-traffic purposes; and

(c) to make stops in the said territory at the points specified for that route in the Route Schedule annexed to this Agreement, for the purpose of putting down and taking on international traffic in passengers, cargo and mail.

3. Nothing in paragraphs 1 and 2 of this Article shall be deemed to confer on the airline of one Contracting Party the privilege of taking on, in the territory of the other Contracting Party, passengers, cargo or mail carried for remuneration or hire and destined for another point in the territory of that other Contracting Party.

Article 4

DESIGNATION OF AIRLINES

1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one airline for the purpose of operating the agreed services on the specified routes.

2. On receipt of such designation the aeronautical authorities of the other Contracting Party shall, subject to the provisions of paragraph 3 of this Article and paragraph 1 of Article 5, without delay, grant to the airline designated the appropriate operating authorization.

3. The aeronautical authorities of one Contracting Party may require an airline designated by the other Contracting Party to satisfy them that it is qualified to fulfill the conditions prescribed under the laws and regulations normally applied to the operation of international air services by such authorities in conformity with the provisions of the Convention.

4. When an airline has been so designated and authorized it may begin at any time to operate the agreed services, provided that the airline complies with all applicable provisions of this Agreement, including the provisions of Article 16 relating to the tariffs in respect of those services.

Article 5

REFUSAL, REVOCATION OR SUSPENSION OF OPERATING AUTHORIZATION

1. Each Contracting Party shall have the right to refuse to grant or to revoke an operating authorization or to suspend the exercise of the rights specified in paragraph 2 of Article 3 of this Agreement by an airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of those rights:

(a) in any case where it is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in the nationals of such Contracting Party; or

(b) in case of failure by that airline to comply with the laws and/or regulations of the Contracting Party granting the rights; or

(c) in case the airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.

2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this Article is essential to prevent further infringements of laws and/or regulations, such rights shall be exercised only after consultation with the other Contracting Party

3. In the event of action by one Contracting Party under this Article, the rights of the other contracting Party under Article 19 shall not be prejudiced.

Article 6

CHARGES

The charges to be levied by either Contracting Party for the use of airports and other aviation facilities by the aircraft of the designated airline of the other Contracting Party shall not be higher than those paid by its national aircraft engaged in similar international services.

Article 7

EXEMPTION FROM CUSTOMS AND OTHER DUTIES

1. Aircraft of the designated airline of one Contracting Party operating international services as well as supplies of fuel, lubricating oils, other consumable technical supplies, spare parts, regular equipment and stores including food, beverages and tobacco shall, upon arriving in or leaving the territory of the other Contracting Party, be exempt on the basis of reciprocity from customs duties, inspection fees and other similar duties or charges, provided such equipment and supplies remain on board the aircraft up to such time as they are re-exported or are used or consumed by such aircraft on flights over that territory.

2. There shall also be exempt from all import duties and taxes, on a reciprocal basis, air tickets, shipping documents, labels for luggage, all printed with the name or the emblem of the airline and any printed advertising material, imported into the territory of either Contracting Party by the designated airline of the other Contracting Party or its agents, for the exclusive use for the servicing of its own aircraft and passengers.

3. Regular airborne equipment, as well as materials and supplies on board the aircraft of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of such other Party.

4. There shall also be exempt from the same duties, fees and charges, with the exception of charges corresponding to the service performed:

(a) aircraft stores on board in the territory of a Contracting Party, within limits fixed by the authorities of the said Contracting Party, and for use on board outbound aircraft engaged in an international air service of the other Contracting Party;

(b) spare parts entered into the territory of either Contracting Party for the maintenance or repair of aircraft used on international air services by the designated airline of the other Contracting Party.

5. Materials referred to in paragraph 2, 3 and 4 above may be placed under the supervision or control of the customs authorities up to such time as they may be re-exported or otherwise disposed of in accordance with customs regulations.

Article 8

PRINCIPLES GOVERNING OPERATIONS OF THE AGREED SERVICES

1. The designated airlines of the two Contracting Parties shall be afforded fair and equal opportunity in the operation of the agreed services on the specified routes.

2. In operating the agreed services, the designated airline of each Contracting Party shall take into account the interests of the airline of the other Contracting Party so as not to affect unduly the services which the latter provides on the whole or part of the same routes.

3. The agreed services provided by the designates airlines of the Contracting Parties shall have as their primary objective the provision, at a reasonable load factor, of capacity adequate to carry the current and reasonably anticipated requirements for the carriage of passengers, cargo and mail between the territory of the Contracting Party designating the airline and the territory of the other Contracting Party.

Provision for the carriage of passengers and cargo including mail both taken on board and discharged at points on the specified routes in the territories of states other than that designating the airline shall be made in accordance with general principles that capacity shall be related to:

(a) traffic requirements to and from territory of the Contracting Party which has designated the airline;

(b) traffic requirements of the area through which the agreed service passes, after taking account of other transport services established by airlines of the states comprising the area;

(c) the requirements of through airline operation.

4. In order that the designated airlines may be afforded fair and equal treatment, the frequency of the services and their capacity, as well as the flight schedules shall be subject to approval by the aeronautical authorities of two Contracting Parties. This requirement should also be met in case of any change concerning the agreed services.

5. The aeronautical authorities of the two Contracting Parties should, if necessary, endeavour to reach a satisfactory arrangement regarding flight schedules, capacity and frequencies.

Article 9

RECOGNITION OF CERTIFICATES AND LICENSES

1. Certificates of airworthiness, certificates of competency and licenses issued or rendered valid by one of the Contracting Parties shall, during the period of their validity, be recognized as valid by the other Contracting Party, provided that the requirements under which such certificates or licenses were issued or rendered valid were equal to or above the minimum standards which may be established pursuant to the Convention.

2. Each Contracting Party reservs the right, however, to refuse to recognize as valid, for the purpose of flights over its own territory, certificates of competency and licences granted to or rendered valid for its own nationals by the other Contracting Party or by any other States,

Article 10

APPROVAL OF TIME - TABLES

The designated airline of either Contracting Party shall, not later than thirty (30) days prior to the date of operation of any agreed service(s), submit its proposed timetables to the aeronautical authorities of the other Contracting Party for approval. Such time-tables shall include the type of service and aircraft to be use, the flight schedule and any other relevant information. This shall, likewise, apply to any subsequent changes. In special cases this time limit may be reduced subject to the approval of the said authorities.

Article 11

SUPPLY OF STATISTIC

The aeronautical authorities of either Contracting Party shall supply to the aeronautical authorities of the other Contracting Party, at their request, such information and statistics relating to the traffic carried on the agreed services by their designated airlines to and from the territory of the other Contracting Party as may normally be prepared and submitted by the designated airline to its national aeronautical authorities. Such date shall include details on volume, distribution, origin and destination of the traffic. Any additional statistical traffic date which the aeronautical authorities of the Contracting Party may desire from the aeronautical authorities of the other Contracting Party shall, upon request, be a subject of mutual discussion and agreement between the two Contracting Parties.

Article 12

APPLICABILITY OF LAWS AND REGULATIONS

1. The laws and regulations of one Contracting Party shall apply to the navigation and operation of the aircraft of the airline designated by the other Contracting Party during entry into, stay in and departure from the territory of the other Contracting Party.

2. The laws and regulations of one Contracting Party governing entry into, stay in and departure from its territory of passengers, crew, cargo or mail such as formalities regarding entry, exit, emigration, imigration, customs, currency, health and quarantine shall apply to passengers, crew, cargo and mail carried by the aircraft of the designated airline of the other Contracting Party while they are within the said territory.

Article 13

TRANSFER OF EARNINGS

1. Each Contracting Party grants to the designated airline of the other Contracting Party the right of free transfer, in accordance with the foreign exchange regulations of the Contracting Party in the territory of which the revenue accrued, of the excess of receipt over expenditure earned by that airline in the territory of the other Contracting Party in connection with the carriage of passenger, cargo and mail.

2. If a contracting Party imposes restrictions on the transfer of excess of receipt over expenditure by the designated airline of the other Contracting Party, the latter shall have the right to impose reciprocal restrictions on the designated airline of that Contracting Party.

Article 14

AIRLINE COMMERCIAL REPRESENTATION

1. The designated airline of one Contracting Party shall be entitled, in accordance with the laws and regulations relating to entry, residence and employment of the other Contracting Party, to bring in and maintain in the territory of other Contracting Party those of its own managerial, technical and operational staff which is required for the provision of air services.

2. Each Contracting Party shall grant the designated airline or the other Contracting Party the right to engage in the sale of air transportation in its territory directly and, at the airline's discretion, through its agents. Each designated airline shall have the right to sell such transportation in the currency of that territory.

Article 15

AVIATION SECURITY

1. Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement. Without limiting the generality of their rights and obligations under international law the Contracting Parties shall, in particular, act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft signed at the Hague on 16 December 1970 and the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation signed at Montreal on 23 September 1971.

2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passenger and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.

3. The Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organization and designated as Annexes to the convention on International Civil Aviation to the extent that such security provisions are applicable to the Parties; they shall require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in their territory and the operators of airports in their territory act in conformity with such aviation security provisions.

4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 above required by the other Contracting Party for entry into, departure from, or while within the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.

5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safety such incident or thereat thereof.

Article 16

TARIFFS

1. The tariffs to be charged by the airlines if the Contracting Parties for the agreed services shall be established at reasonable levels, due regard being paid to all relevant factors including cost of operation, reasonable profit, characteristics of service and the tariffs of other airlines operating scheduled services over the whole or part of the same routes.

2. The tariffs referred to in paragraph 1 of this Article shall, if possible, be agreed by the designated airlines of both Contracting Parties, after consultation with the other airlines operating over the whole or part of the route and such agreement shall, wherever possible, be reached by the use of the procedures of the International Air Transport Association for the working out of tariffs.

3. The tariffs so agreed shall be submitted for the approval of the aeronautical authorities of both Contracting Parties at least thirty (30) days prior to the proposed date of their introduction. In special cases this time limit may be reduced subject to the agreement of the said authorities.

4. Approval may be given expressly. If neither of the aeronautical authorities has expressed disapproval within thirty (30) days from the date of submission in accordance with paragraph 3 of this Article, these tariffs shall be considered as approved. In the event of the period for submission being reduced, as provided for in paragraph 3, the aeronautical authorities may agree that period within which disapproval must be notified shall be less than thirty (30) days.

5. If a tariff cannot be agreed in accordance with paragraph 2 of this Article or if, during the period applicable in accordance with paragraph 4 of this Article, one aeronautical authority gives the other aeronautical authority notice of its disapproval of a tariff agreed in accordance with the provisions of paragraph 2 of this Article, the aeronautical authorities of the two Contracting Parties shall, after consultation with the aeronautical authorities of any other state or with any authority whose advice they may consider useful, endeavour to determine the tariff by mutual agreement.

6. If the aeronautical authorities cannot on any tariff submitted to them under paragraph 3 of this Article, or on the determination of any tariff under paragraph 5 of this Article, the dispute shall be settled in accordance with the provisions of Article 20 of this Agreement.

7. A tariff established in accordance with the provisions of this Article shall remain in force until a new tariff has been established.

Article 17

CONSULTATIONS AND AMENDMENTS

1. In a spirit of close co-operation the two Contracting Parties or their aeronautical authorities shall consult each other from time to time with a view to ensuring the implementation of and satisfactory compliance with the provisions of this Agreement and the Annexes thereto.

2. If either Contracting Party considers it desirable to amend any of the provisions of this Agreement, it may request consultation with the other Contracting Party. Such consultation shall being within a period of sixty (60) days from the date of request. Any amendments so agreed shall come into force when they have been confirmed by an exchange of diplomatic notes following completion of the constitutional or otherwise required procedures.

3. Amendments relating only to the provisions of the Agreement other than those of the annexed Route Schedules shall be approved by each Contracting Party in accordance with its constitutional procedures.

4. Amendments relating only to the provisions of the annexed Route Schedules may be agreed upon between the aeronautical authorities of both Contracting Parties. Such amendments will become effective as soon as they are approved by both aeronautical authorities.

Article 18

CONFORMITY WITH MULTILATERAL CONVENTIONS

This Agreement and its Annexes will be amended so as to conform with any multilateral convention which may become binding upon the Contracting Parties.

Article 19

TERMINATION

1. Either Contracting Party may, at any time, give notice to the other Contracting Party of its decision to terminate this Agreement. Such notice shall simultaneously be communicated to the International Civil Aviation Organization.

2. In such the Agreement shall terminate twelve (12) months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by mutual agreement before the expiry of this period. In the absence of acknowledgment of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization.

Article 20

SETTLEMENT OF DISPUTES

1. If any dispute arise between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall, in the first place, endeavour to settle it by negotiation.

2. If the Contracting Parties fail to reach a settlement by negotiation, they may agree to refer the dispute for decision to some person or body; if they do not so agree, the dispute shall, at the request of either Contracting Party, be submitted for decision to a tribunal of three arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two so nominated. Each of the Contracting Parties shall nominate an arbitrator within a period of sixty (60) days from the date of receipt by either Contracting Party from the other of a notice through diplomatic channels requesting arbitration of the dispute by such a tribunal, and the third arbitrator shall be appointed within a further period of sixty (60) days. If either of the Contracting Parties fails to nominate arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified, the President of the Council of the International Civil Aviation Organization may at the request of either Contracting Party appoint an arbitrator or arbitrators as the case requires. In such case, the third arbitrator shall be a national of a third state and shall act as President of the arbitral tribunal.

3. The Contracting Parties shall comply with any decision given under paragraph 2 of this Article.

4. The expenses of the arbitration shall be equally shared between the Contracting Parties.

Article 21

REGISTRATION WITH ICAO

This Agreement and any amendments thereto shall be registered with the International Civil Aviation Organization.

Article 22

ANNEXES

Annexes to this Agreement shall be deemed to be part of the Agreement and all references to them shall include reference to the Annexes, except where otherwise expressly provided.

Article 23

ENTRY INTO FORCE

1. This Agreement shall enter into force on the 30th day after the Contracting Parties have notified each other through diplomatic notes that the required constitutional formalities have been fulfilled.

This Agreement is drawn in two originals in the English language both originals being equally authentic. Each Party retains one copy for implementation.

IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed the present Agreement.

Latvijas Republikas valdības un Kipras Republikas valdības nolīgums par gaisa satiksmi

Latvijas Republikas valdība un Kipras Republikas valdība (turpmāk — Līgumslēdzējas Puses),

būdamas Konvencijas par starptautisko civilo aviāciju, kas atklāta parakstīšanai 1944.gada 7.decembrī Čikāgā, dalībnieces,

vēloties noslēgt šo Nolīgumu, lai nodibinātu gaisa satiksmi starp to attiecīgajām teritorijām un aiz to robežām,

ir vienojušās par sekojošo:

1.pants

DEFINĪCIJAS

1. Šajā Nolīgumā, ja kontekstā nav paredzēts citādi:

a) termins "Konvencija" nozīmē Konvenciju par starptautisko civilo aviāciju, kas atklāta parakstīšanai 1944.gada 7.decembrī Čikāgā un ietver pielikumus, kas pieņemti saskaņā ar šīs Konvencijas 90.pantu un šo pielikumu vai Konvencijas grozījumus, kas izdarīti saskaņā ar šīs Konvencijas 90. un 94.pantu, ciktāl minētie pielikumi un grozījumi ir stājušies spēkā abām Līgumslēdzējām Pusēm;

b) termins "aviācijas institūcijas" attiecībā uz Latvijas Republiku nozīmē Satiksmes ministriju un attiecībā uz Kipras Republiku - Komunikāciju un darba ministru vai abos gadījumos - jebkuru personu vai institūciju, kas pilnvarota veikt minēto institūciju funkcijas;

c) termins "nozīmētā aviokompānija" nozīmē aviokompāniju, kas nozīmēta un pilnvarota saskaņā ar šī Nolīguma 4.pantu;

d) termins "tarifs" nozīmē cenas, kas tiek maksātas par pasažieru un kravas pārvadāšanu un nosacījumus, kādos šīs cenas tiek piemērotas, ieskaitot cenas par aģentu un citiem palīgpakalpojumiem un to piemērošanas nosacījumus, bet izņemot maksu par pasta pārvadāšanu un tās nosacījumus;

e) terminam "teritorija" attiecībā uz valsti ir Konvencijas 2.pantā paredzētā nozīme;

f) terminiem "gaisa satiksme", "starptautiskā gaisa satiksme" , "aviokompānija" un "apstāšanās nekomerciālos nolūkos" attiecīgi ir Konvencijas 96.pantā paredzētā nozīme.

2. Šī Nolīguma pantu nosaukumi nekādā veidā neierobežo vai nepaplašina nevienu šī Nolīguma noteikumu.

ČIKĀGAS KONVENCIJAS PIEMĒROŠANA

Šī Nolīguma noteikumiem jāatbilst Konvencijas noteikumiem, ciktāl minētie noteikumi ir piemērojami starptautiskajai gaisa satiksmei.

3.pants

TIESĪBU PIEŠĶIRŠANA

1. Lai izveidotu un veiktu Nolīgumā paredzēto regulāro starptautisko gaisa satiksmi šim Nolīgumam pievienotajā Maršrutu sarakstā noteiktajos maršrutos, katra Līgumslēdzēja Puse piešķir otrai Līgumslēdzējai Pusei šajā Nolīgumā paredzētās tiesības. Šī satiksme un maršruti turpmāk attiecīgi tiek dēvēti par "Nolīgumā paredzēto satiksmi" un "noteiktajiem maršrutiem" .

2. Katras Līgumslēdzējas Puses nozīmētajai aviokompānijai, veicot Nolīgumā paredzēto satiksmi noteiktajos maršrutos, ir šādas tiesības:

a) bez nosēšanās lidot pāri otras Līgumslēdzējas Puses valsts teritorijai;

b) apstāties minētajā teritorijā nekomerciālos nolūkos; un

c) apstāties minētajā teritorijā šim Nolīgumam pievienotajā Maršrutu sarakstā noteiktajos maršruta punktos, lai, veicot starptautisko satiksmi, uzņemtu un izsēdinātu pasažierus, iekrautu un izkrautu kravu un pastu.

3. Neko šī panta 1. un 2.punktā nedrīkst iztulkot kā tiesību piešķiršanu vienas Līgumslēdzējas Puses aviokompānijai uzņemt otras Līgumslēdzējas Puses valsts teritorijā pasažierus, kravu vai pastu, lai par atlīdzību vai uz nomas līguma pamata pārvadātu uz citu punktu tās pašas otras Līgumslēdzējas Puses valsts teritorijā.

4.pants

AVIOKOMPĀNIJU NOZĪMĒŠANA

1. Lai veiktu Nolīgumā paredzēto satiksmi noteiktajos maršrutos, katrai Līgumslēdzējai Pusei ir tiesības rakstiski nozīmēt otrai Līgumslēdzējai Pusei vienu aviokompāniju.

2. Pēc šāda nozīmējuma saņemšanas otras Līgumslēdzējas Puses aviācijas institūcijām saskaņā ar šī panta 3.punktu un 5.panta 1.punktu nozīmētajai aviokompānijai bez kavēšanās jāizsniedz attiecīga pārvadājumu atļauja.

3. Vienas Līgumslēdzējas Puses aviācijas institūcijas var pieprasīt, lai otras Līgumslēdzējas Puses nozīmētā aviokompānija tām pierādītu, ka tā spēj pildīt likumu un normatīvo aktu prasības, kuras saskaņā ar Konvencijas noteikumiem minētās institūcijas parasti piemēro starptautiskajai gaisa satiksmei.

4. Pēc nozīmēšanas un pilnvarošanas aviokompānija jebkurā laikā drīkst uzsākt Nolīgumā paredzēto satiksmi, ja aviokompānija izpilda visus šī Nolīguma noteikumus, tajā skaitā 16.panta noteikumus, kuri attiecas uz šīs satiksmes tarifiem.

5.pants

PĀRVADĀJUMU ATĻAUJAS IZSNIEGŠANAS ATTEIKUMS, ATĻAUJAS ATSAUKŠANA VAI APTURĒŠANA

1. Katrai Līgumslēdzējai Pusei ir tiesības atteikties izsniegt otras Līgumslēdzējas Puses nozīmētajai aviokompānijai piešķirto pārvadājumu atļauju vai to atsaukt, vai apturēt šī Nolīguma 3.panta 2.punktā paredzēto tiesību izmantošanu, vai pieprasīt izpildīt nosacījumus, kuru izpildi tā uzskata par nepieciešamu, izmantojot šīs tiesības:

a) jebkurā gadījumā, kad tai nav pierādījumu, ka reālā īpašuma tiesības uz šo aviokompāniju un efektīvā kontrole pār to ir Līgumslēdzējai Pusei, kas nozīmējusi šo aviokompāniju, vai tās pilsoņiem vai pastāvīgajiem iedzīvotājiem; vai

b) ja šī aviokompānija nespēj izpildīt Līgumslēdzējas Puses, kas piešķīrusi šīs tiesības, likumus un/vai normatīvos aktus; vai

c) ja aviokompānija citā veidā nespēj darboties saskaņā ar šajā Nolīgumā paredzētajiem noteikumiem.

2. Ja šī panta 1.punktā minētā tūlītējā atļaujas atsaukšana, apturēšana vai nosacījumu izpildes uzlikšana nav nepieciešama, lai novērstu turpmāku likumu un/vai normatīvo aktu pārkāpšanu, šīs tiesības jāizmanto tikai pēc konsultācijām ar otru Līgumslēdzēju Pusi.

3. Vienai Līgumslēdzējai Pusei rīkojoties saskaņā ar šo pantu, netiek ierobežotas 19.pantā noteiktās otras Līgumslēdzējas Puses tiesības.

6.pants

MAKSĀJUMI

Maksājumi, kurus viena Līgumslēdzēja Puse iekasē no otras Līgumslēdzējas Puses nozīmētās aviokompānijas par to, ka tās gaisa kuģis izmanto lidostas un citas aviācijas iekārtas, nedrīkst būt augstāki par maksājumiem, kuri tiek piemēroti attiecībā uz tās nacionālo gaisa kuģi, kurš veic līdzīgu starptautisko gaisa satiksmi.

7.pants

ATBRĪVOŠANA NO MUITAS UN CITIEM NODOKĻIEM

1. Vienas Līgumslēdzējas Puses nozīmētās aviokompānijas starptautiskās satiksmes gaisa kuģis, kā arī tā degvielas, smērvielu, citu patērējamu tehnisku līdzekļu krājumi, rezerves daļas, parastais gaisa kuģa aprīkojums un gaisa kuģa krājumi, tajā skaitā ēdieni, dzērieni un tabakas izstrādājumi, šim gaisa kuģim ierodoties otras Līgumslēdzējas Puses valsts teritorijā vai to atstājot, uz savstarpējiem noteikumiem tiek atbrīvoti no muitas nodokļiem, pārbaudes maksājumiem un citiem līdzīgiem nodokļiem un maksājumiem, ja šis aprīkojums un krājumi paliek gaisa kuģī līdz to aizvešanai vai citādai izmantošanai vai patērēšanai šajā gaisa kuģī lidojot pāri minētajai teritorijai.

2. Uz savstarpējiem noteikumiem no visām importa nodevām un nodokļiem jāatbrīvo arī iespiestas aviobiļetes, pārvadājumu dokumenti, bagāžas etiķetes ar aviokompānijas nosaukumu vai emblēmu un jebkuri citi iespiesti reklāmas materiāli, kurus vienas Līgumslēdzējas Puses valsts teritorijā ieved otras Līgumslēdzējas Puses nozīmētā aviokompānija vai tās aģenti, lai izmantotu vienīgi savu gaisa kuģu un pasažieru apkalpošanai.

3. Vienas Līgumslēdzējas Puses gaisa kuģa parastais aprīkojums, kā arī materiāli un krājumi, kas atrodas gaisa kuģī, otras Līgumslēdzējas Puses valsts teritorijā var tikt izkrauti tikai pēc šīs otras Līgumslēdzējas Puses muitas institūciju piekrišanas.

4. No tiem pašiem nodokļiem un maksājumiem, izņemot maksu par sniegtajiem pakalpojumiem jāatbrīvo arī:

a) gaisa kuģa krājumi, kuri uzņemti vienas Līgumslēdzējas Puses valsts teritorijā minētās Līgumslēdzējas Puses institūciju noteiktā apjomā, lai izmantotu otras Līgumslēdzējas Puses starptautiskās satiksmes gaisa kuģī, kas aizlido no minētās teritorijas;

b) rezerves daļas, kas ievestas vienas Līgumslēdzējas Puses valsts teritorijā, lai veiktu otras Līgumslēdzējas Puses nozīmētās aviokompānijas starptautiskās satiksmes gaisa kuģa tehnisko apkopi vai remontu.

5. 2., 3. un 4.punktā minētos materiālus var novietot muitas institūciju uzraudzībā vai kontrolē līdz brīdim, kad tie saskaņā ar muitas noteikumiem tiks izvesti vai citādi izvietoti.

8.pants

NOLĪGUMĀ PAREDZĒTĀS SATIKSMES VEIKŠANAS PRINCIPI

1. Abu Līgumslēdzēju Pušu nozīmētajām aviokompānijām jādod brīvas un vienlīdzīgas iespējas veikt Nolīgumā paredzēto satiksmi noteiktajos maršrutos.

2. Veicot Nolīgumā paredzēto satiksmi, katras Līgumslēdzējas Puses nozīmētajai aviokompānijai jāņem vērā otras Līgumslēdzējas Puses aviokompānijas intereses, lai nekaitētu satiksmei, kuru tā veic pa to pašu maršrutu vai tā posmu.

3. Abu Līgumslēdzēju Pušu nozīmēto aviokompāniju veiktās Nolīgumā paredzētās satiksmes galvenajam mērķim jābūt pasažieru, kravas un pasta pārvadājumu nodrošināšanai starp aviokompāniju nozīmējušās Līgumslēdzējas Puses valsts teritoriju un otras Līgumslēdzējas Puses valsts teritoriju ar nosacījumu, ka, ievērojot saprātīgu noslodzes faktoru, kapacitātei jāatbilst esošajam un saprātīgi paredzamajam pieprasījumam pēc šiem pārvadājumiem. Pārvadājot pasažierus un kravu, tajā skaitā pastu, kuri uzņemti (iekrauti) un izsēdināti (izkrauti) punktos, kas atrodas to valstu teritorijās, kuras nav nozīmējušas aviokompānijas, jāievēro nosacījums, ka pārvadājumi jāveic saskaņā ar pamatprincipiem, ka kapacitātei jābūt atkarīgai no:

a) pieprasījuma pēc pārvadājumiem uz aviokompāniju nozīmējušās Līgumslēdzējas Puses valsts teritoriju un no tās;

b) pieprasījuma pēc pārvadājumiem apgabalā, pār kuru tiek veikta satiksme, ja ir ņemti vērā citi transporta pakalpojumi, kurus sniedz šim apgabalam blakus esošo valstu aviokompānijas;

c) pieprasījuma pēc aviokompāniju tranzīta pārvadājumiem.

4. Lai nozīmētās aviokompānijas varētu panākt brīvu un vienlīdzīgu attieksmi, satiksmes biežums un tās kapacitāte, kā arī lidojumu saraksti jāapstiprina abu Līgumslēdzēju Pušu aviācijas institūcijām. Šī prasība jāievēro arī tad, ja tiek izdarīti jebkādi grozījumi, kuri attiecas uz Nolīgumā paredzēto satiksmi.

5. Abu Līgumslēdzēju Pušu aviācijas institūcijām, ja nepieciešams, jācenšas panākt apmierinošu vienošanos par lidojumu sarakstiem, kapacitāti un lidojumu biežumu.

9.pants

APLIECĪBU UN LICENČU ATZĪŠANA

1. Lidojumu drošības apliecības, kvalifikācijas apliecības un licences, kuras izdevusi vai atzinusi par derīgām viena Līgumslēdzēja Puse, to derīguma periodā otrai Līgumslēdzējai Pusei jāatzīst par derīgām, ja prasības, saskaņā ar kurām šīs apliecības vai licences izdotas vai atzītas par derīgām, atbilst Konvencijā noteiktajiem minimālajiem standartiem vai tos pārsniedz.

2. Katra Līgumslēdzēja Puse tomēr saglabā tiesības atteikties atzīt par derīgām lidojumiem pāri savai teritorijai kvalifikācijas apliecības un licences, kuras tās pilsoņiem izsniegusi vai atzinusi par derīgām otra Līgumslēdzēja Puse vai kāda cita valsts.

10.pants

SARAKSTU APSTIPRINĀŠANA

Katras Līgumslēdzējas Puses nozīmētajai aviokompānijai ne vēlāk kā trīsdesmit (30) dienas pirms Nolīgumā paredzētās satiksmes uzsākšanas plānotie lidojumu saraksti jāiesniedz apstiprināšanai otras Līgumslēdzējas Puses aviācijas institūcijām. Šajos sarakstos jāiekļauj ziņas par pakalpojumu veidu un izmantojamā gaisa kuģa tipu, lidojumu saraksts un cita attiecīga informācija. Tas tāpat attiecas uz jebkurām turpmākajām izmaiņām. Īpašos gadījumos pēc minēto institūciju piekrišanas sarakstu iesniegšanas termiņš var tikt saīsināts.

11.pants

STATISTIKAS DATU SNIEGŠANA

Katras Līgumslēdzējas Puses aviācijas institūcijām pēc otras Līgumslēdzējas Puses aviācijas institūciju pieprasījuma jāsniedz tām tāda informācija un statistikas dati par pārvadājumiem, kurus Nolīgumā paredzētās satiksmes ietvaros uz otras Līgumslēdzējas Puses valsts teritoriju un no tās veic attiecīgās Līgumslēdzējas Puses nozīmētā aviokompānija, kādu nozīmētā aviokompānija parasti sagatavo un iesniedz savas valsts aviācijas institūcijām. Šajā informācijā jāiekļauj detalizētas ziņas par satiksmes apjomu, iedalījumu, satiksmes sākuma un galapunktiem. Ja vienas Līgumslēdzējas Puses aviācijas institūcijas vēlas saņemt papildus statistikas datus no otras Līgumslēdzējas Puses aviācijas institūcijām, šis jautājums pēc pieprasījuma saņemšanas jāapspriež abām Līgumslēdzējām Pusēm un jāpanāk vienošanās.

12.pants

LIKUMU UN NOTEIKUMU PIEMĒROŠANA

1. Attiecībā uz vienas Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa kuģiem laikā, kad tie ierodas otras Līgumslēdzējas Puses valsts teritorijā, uzturas tajā vai to atstāj, jāpiemēro šīs otras Līgumslēdzējas Puses likumi un normatīvie akti.

2. Vienas Līgumslēdzējas Puses likumi un normatīvie akti, kuri nosaka pasažieru, apkalpes, kravas vai pasta ierašanos šīs Līgumslēdzējas Puses valsts teritorijā, uzturēšanos tajā vai tās atstāšanu, piemēram, ieceļošanas, aizceļošanas, emigrācijas, imigrācijas, muitas, valūtas, veselības aizsardzības un karantīnas formalitātes, jāpiemēro otras Līgumslēdzējas Puses nozīmētās aviokompānijas pasažieriem, apkalpei, kravai un pastam laikā, kad tie atrodas minētajā teritorijā.

13.pants

IENĀKUMU PĀRSŪTĪŠANA

1. Katra Līgumslēdzēja Puse piešķir otras Līgumslēdzējas Puses nozīmētajai aviokompānijai tiesības saskaņā ar ārvalstu valūtas maiņas noteikumiem tās valsts teritorijā, kurā ienākumi gūti, brīvi pārsūtīt naudas atlikumu, kas radies, šīs aviokompānijas ienākumiem par pasažieru, kravas un pasta pārvadājumiem minētās Līgumslēdzējas Puses valsts teritorijā pārsniedzot izdevumus.

2. Ja Līgumslēdzēja Puse ierobežo otras Līgumslēdzējas Puses nozīmētās aviokompānijas iespējas pārsūtīt naudas atlikumu, kas radies, ienākumiem pārsniedzot izdevumus, šai otrajai Līgumslēdzējai Pusei ir tiesības savstarpēji ierobežot minētās Līgumslēdzējas Puses iespējas.

14.pants

AVIOKOMPĀNIJU KOMERCIĀLĀS PĀRSTĀVNIECĪBAS

1. Katras Līgumslēdzējas Puses nozīmētajai aviokompānijai jādod tiesības saskaņā ar likumiem un normatīvajiem aktiem, kuri nosaka ierašanos, uzturēšanos un nodarbinātību otras Līgumslēdzējas Puses valsts teritorijā, ievest un uzturēt šīs otras Līgumslēdzējas Puses valsts teritorijā tās administratīvo, tehnisko un ar pārvadājumiem saistīto personālu, kas nepieciešams gaisa satiksmes nodrošināšanai.

2. Katrai Līgumslēdzējai Pusei savas valsts teritorijā jāpiešķir otras Līgumslēdzējas Puses nozīmētajai aviokompānijai tiesības pārdot gaisa satiksmes pakalpojumus tieši un pēc aviokompānijas ieskatiem - ar tās aģentu starpniecību. Katrai nozīmētajai aviokompānijai jāpiešķir tiesības pārdot šos pakalpojumus par attiecīgās valsts teritorijā lietojamo valūtu.

15.pants

AVIĀCIJAS DROŠĪBA

1. Atbilstoši tiesībām un pienākumiem, kas izriet no starptautiskajām tiesībām, Līgumslēdzējas Puses no jauna apliecina, ka to saistības vienai pret otru aizsargāt civilās aviācijas drošību pret nelikumīgas iejaukšanās darbībām veido šī Nolīguma neatņemamu sastāvdaļu. Neierobežojot to tiesību un pienākumu vispārējo raksturu, Līgumslēdzējām Pusēm jādarbojas saskaņā ar Konvenciju par noziegumiem un dažām citām darbībām, kas izdarītas gaisa kuģos, kura parakstīta Tokijā 1963.gada 14.septembrī, Konvenciju par cīņu pret nelikumīgu gaisa kuģu sagrābšanu, kura parakstīta Hāgā 1970.gada 16.decembrī un Konvenciju par cīņu pret nelikumīgām darbībām, kas apdraud civilās aviācijas drošību, kura parakstīta Monreālā 1971.gada 23.septembrī.

2. Katrai Līgumslēdzējai Pusei pēc otras Līgumslēdzējas Puses lūguma jāsniedz tai visa nepieciešamā palīdzība, lai novērstu gaisa kuģa sagrābšanu un citas nelikumīgas darbības, kuras apdraud šī gaisa kuģa, tā pasažieru un apkalpes, lidostu un aeronavigācijas iekārtu drošību un jebkurus citus draudus civilās aviācijas drošībai.

3. Pusēm savstarpējās attiecībās jādarbojas saskaņā ar aviācijas drošības nosacījumiem, kurus noteikusi Starptautiskā civilās aviācijas organizācija un kuri kā pielikumi pievienoti Konvencijai par starptautisko civilo aviāciju, ciktāl šie drošības nosacījumi ir piemērojami Līgumslēdzējām Pusēm; tām jāpieprasa, lai to reģistrā reģistrēto gaisa kuģu ekspluatanti vai gaisa kuģu ekspluatanti, kuru pamatdarbības vieta vai pastāvīgā mītne ir to valsts teritorijā un to valsts teritorijā esošo lidostu ekspluatanti darbotos saskaņā ar šiem aviācijas drošības nosacījumiem.

4. Katra Līgumslēdzēja Puse piekrīt, ka to gaisa kuģu ekspluatantiem var pieprasīt ievērot 3.punktā minētos aviācijas drošības nosacījumus, kurus otra Līgumslēdzēja Puse piemēro ieceļojot, aizceļojot vai uzturoties šīs otras Līgumslēdzējas Puses valsts teritorijā. Katrai Līgumslēdzējai Pusei savas valsts teritorijā jānodrošina attiecīgu efektīvu pasākumu veikšana, lai aizsargātu gaisa kuģi un pārbaudītu tā pasažierus, apkalpi, pasažierim klātesošās mantas, bagāžu, kravu un gaisa kuģa krājumus pirms to iekāpšanas vai iekraušanas un tās laikā. Katrai Līgumslēdzējai Pusei ar sapratni jāuztver jebkurš otras Līgumslēdzējas Puses lūgums pēc saprātīgiem īpašiem drošības pasākumiem, lai novērstu konkrētus draudus.

5. Ja noticis nelikumīgas gaisa kuģa sagrābšanas incidents vai ir tā draudi, vai veiktas citas pret šī gaisa kuģa, tā pasažieru un apkalpes, lidostu vai aeronavigācijas iekārtu drošību vērstas nelikumīgas darbības, Līgumslēdzējām Pusēm jāsniedz savstarpēja palīdzība, atvieglojot sazināšanos un veicot citus attiecīgus pasākumus, lai ātri un droši pārtrauktu šo incidentu vai novērstu tā draudus.

16.pants

TARIFI

1. Tarifi, kurus Līgumslēdzēju Pušu aviokompānijas pieprasa par Nolīgumā paredzētās satiksmes veikšanu, jānosaka saprātīgā līmenī, pienācīgu uzmanību veltot visiem attiecīgajiem faktoriem, tajā skaitā ar satiksmes veikšanu saistītajiem izdevumiem, saprātīgai peļņai, pakalpojumu raksturojumam un citu aviokompāniju tarifiem, ja šīs aviokompānijas veic regulāru satiksmi pa to pašu maršrutu vai tā daļu.

2. Pēc konsultācijām ar citiem pārvadātājiem, kuri veic pārvadājumus tajā pašā maršrutā vai tā daļā, par šī panta 1.punktā minētajiem tarifiem, ja iespējams, jāvienojas abu Līgumslēdzēju Pušu nozīmētajām aviokompānijām, un šī vienošanās, ja iespējams, jāpanāk, izmantojot Starptautiskās gaisa transporta asociācijas noteiktās tarifu izstrādāšanas procedūras.

3. Tarifi, par kuriem panākta vienošanās, ne vēlāk kā trīsdesmit (30) dienas pirms to plānotās ieviešanas dienas jāiesniedz apstiprināšanai abu Līgumslēdzēju Pušu aviācijas institūcijām. Īpašos gadījumos pēc minēto institūciju vienošanās šis termiņš var tikt saīsināts.

4. Apstiprinājums jādod nekavējoties. Ja neviena aviācijas institūcija trīsdesmit (30) dienu laikā pēc to iesniegšanas dienas saskaņā ar šī panta 3.punktu nepaziņo par noraidīšanu, šie tarifi jāuzskata par apstiprinātiem. Ja iesniegšanas termiņš saskaņā ar 3.punktu ir saīsināts, aviācijas institūcijas var vienoties, ka termiņam, kurā jāpaziņo par noraidījumu, jābūt īsākam par trīsdesmit (30) dienām.

5. Ja par tarifiem nav panākta vienošanās saskaņā ar šī panta 2.punktu vai ja saskaņā ar šī panta 4.punktu paredzētā perioda laikā viena aviācijas institūcija paziņo otrai aviācijas institūcijai par saskaņā ar šī panta 2.punktu izstrādāta tarifa noraidīšanu, abu Līgumslēdzēju Pušu aviācijas institūcijām pēc konsultācijām ar jebkuras citas valsts aviācijas institūcijām vai ar jebkādu citu institūciju, kuras ieteikumu tās uzskata par lietderīgu, jācenšas tarifu noteikt pēc savstarpējas vienošanās.

6. Ja aviācijas institūcijas nevar vienoties par kādu tarifu, kas tām iesniegts saskaņā ar šī panta 3.punktu, vai nevar noteikt kādu tarifu saskaņā ar šī panta 5.punktu, strīds jāizšķir saskaņā ar šī Nolīguma 20.pantu.

7. Tarifam, kas noteikts saskaņā ar šī panta noteikumiem, jābūt spēkā līdz dienai, kad tiek noteikts jauns tarifs.

17.pants

KONSULTĀCIJAS UN GROZĪJUMI

1. Ciešas sadarbības garā abām Līgumslēdzējām Pusēm vai to aviācijas institūcijām periodiski jākonsultē vienai otru, lai nodrošinātu šī Nolīguma un tā pielikuma noteikumu izpildi un apmierinošu darbošanos saskaņā ar tiem.

2. Ja viena Līgumslēdzēja Puse vēlas grozīt kādu šī Nolīguma noteikumu, tā var pieprasīt konsultācijas ar otru Līgumslēdzēju Pusi. Šīm konsultācijām jāsākas sešdesmit (60) dienu laikā pēc to pieprasījuma dienas. Jebkuriem grozījumiem, par kuriem panākta vienošanās, jāstājas spēkā pēc to apstiprināšanas, apmainoties ar diplomātiskajām notām, kas seko konstitucionālo vai citu nepieciešamo darbību izpildei.

3. Grozījumi, kas attiecas tikai uz šī Nolīguma noteikumiem atšķirībā no tiem, kas attiecas uz Maršrutu sarakstu šī Nolīguma pielikumā, jāapstiprina abu Līgumslēdzēju Pušu aviācijas institūcijām saskaņā ar to konstituciālajām prasībām.

4. Par grozījumiem, kuri attiecas tikai uz Maršrutu sarakstu šī Nolīguma pielikumā, var vienoties abu Līgumslēdzēju Pušu aviācijas institūcijas. Šie grozījumi stājas spēkā pēc tam, kad tos apstiprinājušas abu Līgumslēdzēju Pušu aviācijas institūcijas.

18.pants

ATBILSTĪBA DAUDZPUSĒJĀM KONVENCIJĀM

Šis Nolīgums un tā pielikumi jāgroza tā, lai tie atbilstu katrai daudzpusējai konvencijai, kura ir kļuvusi saistoša Līgumslēdzējām Pusēm.

19.pants

NOLĪGUMA DARBĪBAS IZBEIGŠANA

1. Katra Līgumslēdzēja Puse jebkurā laikā var paziņot otrai Līgumslēdzējai Pusei par savu lēmumu izbeigt šī Nolīguma darbību. Šis paziņojums vienlaikus jānosūta Starptautiskajai civilās aviācijas organizācijai.

2. Šajā gadījumā Nolīguma darbība tiek izbeigta pēc divpadsmit (12) mēnešiem, skaitot no dienas, kad otra Līgumslēdzēja Puse saņēmusi paziņojumu, ja paziņojums par Nolīguma darbības izbeigšanu pēc savstarpējas vienošanās netiek atsaukts līdz šī termiņa beigām. Ja otra Līgumslēdzēja Puse neapliecina paziņojuma saņemšanu, paziņojums jāuzskata par saņemtu pēc četrpadsmit (14) dienām no dienas, kad to saņēmusi Starptautiskā civilās aviācijas organizācija.

20.pants

STRĪDU IZŠĶIRŠANA

1. Ja Līgumslēdzējām Pusēm rodas strīds par šī Nolīguma iztulkošanu vai piemērošanu, Līgumslēdzējām Pusēm vispirms jācenšas to nokārtot sarunu ceļā.

2. Ja Līgumslēdzējas Puses nespēj strīdu nokārtot sarunu ceļā, tās var vienoties nodot strīdu izšķiršanai kādai personai vai institūcijai; ja tās nevar vienoties, strīds pēc vienas Līgumslēdzējas Puses lūguma jānodod izšķiršanai triju tiesnešu šķīrējtiesai, kurai katra Līgumslēdzēja Puse apstiprina vienu tiesnesi un trešo tiesnesi ieceļ abi apstiprinātie tiesneši. Katrai Līgumslēdzējai Pusei savs tiesnesis jāieceļ sešdesmit (60) dienu laikā pēc dienas, kad tā diplomātiskā ceļā saņēmusi otras Līgumslēdzējas Puses lūgumu par strīda izšķiršanu šķīrējtiesā, un trešais tiesnesis jāieceļ nākošo sešdesmit (60) dienu laikā. Ja kāda Līgumslēdzēja Puse noteiktajā laikā neapstiprina tiesnesi vai ja trešais tiesnesis netiek iecelts noteiktajā laikā, katra Līgumslēdzēja Puse var lūgt Starptautiskās civilās aviācijas organizācijas Padomes prezidentu iecelt nepieciešamo tiesnesi vai tiesnešus. Šajā gadījumā trešajam tiesnesim jābūt trešās valsts pilsonim un jāveic šķīrējtiesas prezidenta funkcijas.

3. Līgumslēdzējām Pusēm jāpilda visi saskaņā ar šī panta 2.punktu pieņemtie lēmumi.

4. Šķīrējtiesas izdevumi līdzīgās daļās jāsedz abām Līgumslēdzējām Pusēm.

21.pants

REĢISTRĒŠANA STARPTAUTISKAJĀ CIVILĀS AVIĀCIJAS ORGANIZĀCIJĀ

Šis Nolīgums un visi tā grozījumi jāreģistrē Starptautiskajā civilās aviācijas organizācijā.

22.pants

PIELIKUMI

Pielikums veido šī Nolīguma neatņemamu sastāvdaļu un, ja nav paredzēts citādi, visas atsauces uz šo Nolīgumu ietver sevī atsauces arī uz Pielikumu.

23.pants

STĀŠANĀS SPĒKĀ

1. Šis Nolīgums stājas spēkā trīsdesmitajā dienā pēc tam, kad Līgumslēdzējas Puses pa diplomātiskajiem kanāliem paziņojušas viena otrai, ka nepieciešamās konstitucionālās prasības ir izpildītas.

Šis Nolīgums ir parakstīts angļu valodā divos autentiskos eksemplāros. Katra Puse saņem vienu eksemplāru izpildei.

TO APLIECINOT, savu valstu valdību pienācīgi pilnvaroti pārstāvji paraksta šo Nolīgumu.
