prezidents izsludina šādu likumu:
Par Konvencijas par prettiesisku darbību pret kuģošanas drošību apkarošanu 2005.gada Protokolu un Protokola par tādu nelikumīgu darbību novēršanu, kas vērstas pret kontinentālajā šelfā esošu stacionāru platformu drošību, 2005.gada Protokolu
1.pants. 1988.gada 10.marta Konvencijas par prettiesisku darbību pret kuģošanas drošību apkarošanu 2005.gada 14.oktobra Protokols (turpmāk — Konvencijas 2005.gada Protokols) un 1988.gada 10.marta Protokola par tādu nelikumīgu darbību novēršanu, kas vērstas pret kontinentālajā šelfā esošu stacionāru platformu drošību, 2005.gada 14.oktobra Protokols (turpmāk — Protokola 2005.gada Protokols) ar šo likumu tiek pieņemti un apstiprināti.
2.pants. Saskaņā ar Konvencijas 2005.gada Protokola 8.bis panta 15.punktu Ārlietu ministrija paziņo Starptautiskās Jūras organizācijas ģenerālsekretāram, ka atbildīgās institūcijas, kas apstiprina kuģa valsts piederību un sniedz pilnvarojumu veikt attiecīgus pasākumus, ir Drošības policija un Ģenerālprokuratūra savas kompetences ietvaros.
3.pants. Saskaņā ar Konvencijas 2005.gada Protokola 8.bis panta 15.punktu Ārlietu ministrija paziņo Starptautiskās Jūras organizācijas ģenerālsekretāram, ka atbildīgā institūcija, kas saņem palīdzības pieprasījumus un atbild uz tiem, ir Latvijas Republikas Nacionālo bruņoto spēku Jūras spēku Krasta apsardzes dienests.
4.pants. Konvencijas 2005.gada Protokolā un Protokola 2005.gada Protokolā paredzēto saistību izpildi koordinē Satiksmes ministrija.
5.pants. Konvencijas 2005.gada Protokols stājas spēkā tās 18.pantā noteiktajā laikā un kārtībā, Protokola 2005.gada Protokols stājas spēkā tā 9.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā “Latvijas Vēstnesis”.
6.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Konvencijas 2005.gada Protokols un Protokola 2005.gada Protokols angļu valodā un to tulkojums latviešu valodā.
Likums Saeimā pieņemts 2009.gada 8.oktobrī.

PROTOCOL OF 2005 TO THE CONVENTION FOR THE SUPPRESSION OF UNLAWFUL ACTS AGAINST THE SAFETY OF MARITIME NAVIGATION

 Preamble

THE STATES PARTIES to this Protocol,

BEING PARTIES to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation done at Rome on 10 March 1988,

ACKNOWLEDGING that terrorist acts threaten international peace and security,

MINDFUL of resolution A.924(22) of the Assembly of the International Maritime Organization requesting the revision of existing international legal and technical measures and the consideration of new measures in order to prevent and suppress terrorism against ships and to improve security aboard and ashore, and thereby to reduce the risk to passengers, crews and port personnel on board ships and in port areas and to vessels and their cargoes,

CONSCIOUS of the Declaration on Measures to Eliminate International Terrorism, annexed to United Nations General Assembly resolution 49/60 of 9 December 1994, in which, inter alia, the States Members of the United Nations solemnly reaffirm their unequivocal condemnation of all acts, methods and practices of terrorism as criminal and unjustifiable, wherever and by whomever committed, including those which jeopardize the friendly relations among States and peoples and threaten the territorial integrity and security of States,

NOTING United Nations General Assembly resolution 51/210 of 17 December 1996 and the Declaration to Supplement the 1994 Declaration on Measures to Eliminate International Terrorism annexed thereto,

RECALLING resolutions 1368 (2001) and 1373 (2001) of the United Nations Security Council, which reflect international will to combat terrorism in all its forms and manifestations, and which assigned tasks and responsibilities to States, and taking into account the continued threat from terrorist attacks,

RECALLING ALSO resolution 1540 (2004) of the United Nations Security Council, which recognizes the urgent need for all States to take additional effective measures to prevent the proliferation of nuclear, chemical or biological weapons and their means of delivery,

RECALLING FURTHER the Convention on Offences and Certain Other Acts Committed on Board Aircraft, done at Tokyo on 14 September 1963; the Convention
for the Suppression of Unlawful Seizure of Aircraft, done at The Hague on 16 December 1970; the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on 23 September 1971; the Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents, adopted by the General Assembly of the United Nations on 14 December 1973; the International Convention against the Taking of Hostages, adopted by the General Assembly of the United Nations on 17 December 1979; the Convention on the Physical Protection of Nuclear Material, done at Vienna on 26 October 1979 and amendments thereto adopted on 8 July 2005; the Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, supplementary to the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on 24 February 1988; the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, done at Rome on 10 March 1988; the Convention on the Marking of Plastic Explosives for the Purpose of Detection, done at Montreal on 1 March 1991; the International Convention for the Suppression of Terrorist Bombings, adopted by the General Assembly of the United Nations on 15 December 1997; the International Convention for the Suppression of the Financing of Terrorism, adopted by the General Assembly of the United Nations on 9 December 1999, and the International Convention for the Suppression of Acts of Nuclear Terrorism adopted by the General Assembly of the United Nations on 13 April 2005,

BEARING IN MIND the importance of the United Nations Convention on the Law of the Sea done at Montego Bay, on 10 December 1982, and of the customary international law of the sea,

CONSIDERING resolution 59/46 of the United Nations General Assembly, which reaffirmed that international co-operation as well as actions by States to combat terrorism should be conducted in conformity with the principles of the Charter of the United Nations, international law and relevant international conventions, and resolution 59/24 of the United Nations General Assembly, which urged States to become parties to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation and its Protocol, invited States to participate in the review of those instruments by the Legal Committee of the International Maritime Organization to strengthen the means of combating such unlawful acts, including terrorist acts, and also urged States to take appropriate measures to ensure the effective implementation of those instruments, in particular through the adoption of legislation, where appropriate, aimed at ensuring that there is a proper framework for responses to incidents of armed robbery and terrorist acts at sea,

CONSIDERING ALSO the importance of the amendments to the International Convention for the Safety of Life at Sea, 1974 and the International Ship and Port Facility Security (ISPS) Code both adopted by the 2002 Conference of Contracting Governments to that Convention in establishing an appropriate international technical framework involving co-operation between Governments, Government agencies, national and local administrations and the shipping and port industries to detect security threats and take preventative measures against security incidents affecting ships or port facilities used in international trade,

CONSIDERING FURTHER resolution 58/187 of the United Nations General Assembly, which reaffirmed that States must ensure that any measure taken to combat terrorism complies with their obligations under international law, in particular international human rights, refugee and humanitarian law,

BELIEVING that it is necessary to adopt provisions supplementary to those of the Convention, to suppress additional terrorist acts of violence against the safety and security of international maritime navigation and to improve its effectiveness,

HAVE AGREED as follows:

ARTICLE 1

For the purposes of this Protocol:

1. “Convention” means the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, done at Rome on 10 March 1988;

2. “Organization” means the International Maritime Organization (IMO); and

3. “Secretary-General” means the Secretary-General of the Organization.

ARTICLE 2

Article 1 of the Convention is amended to read as follows:

Article 1

1. For the purposes of this Convention,

(a) “ship” means a vessel of any type whatsoever not permanently attached to the sea-bed, including dynamically supported craft, submersibles, or any other floating craft;

(b) “transport” means to initiate, arrange or exercise effective control, including decision-making authority, over the movement of a person or item;

(c) “serious injury or damage” means

(i) serious bodily injury; or

(ii) extensive destruction of a place of public use, State or government facility, infrastructure facility, or public transportation system, resulting in major economic loss; or

(iii) substantial damage to the environment, including air, soil, water, fauna, or flora.

(d) “BCN weapon” means

(i) “biological weapons” which are:

(1) microbial or other biological agents, or toxins whatever their origin or method of production, of types and in quantities that have no justification for prophylactic, protective or other peaceful purposes; or

(2) weapons, equipment or means of delivery designed to use such agents or toxins for hostile purposes or in armed conflict.

(ii) “chemical weapons”, which are, together or separately:

(1) toxic chemicals and their precursors, except where intended for:

(A) industrial, agricultural, research, medical, pharmaceutical or other peaceful purposes; or

(B) protective purposes, namely those purposes directly related to protection against toxic chemicals and to protection against chemical weapons; or

(C) military purposes not connected with the use of chemical weapons and not dependent on the use of the toxic properties of chemicals as a method of warfare; or

(D) law enforcement including domestic riot control purposes;as long as the types and quantities are consistent with such purposes;

(2) munitions and devices, specifically designed to cause death or other harm through the toxic properties of those toxic chemicals specified in subparagraph (ii)(1), which would be released as a result of the employment of such munitions and devices;

(3) any equipment specifically designed for use directly in connection with the employment of munitions and devices specified in subparagraph (ii)(2).

(iii) nuclear weapons and other nuclear explosive devices.

(e) “toxic chemical” means any chemical which through its chemical action on life processes can cause death, temporary incapacitation or permanent harm to humans or animals. This includes all such chemicals, regardless of their origin or of their method of production, and regardless of whether they are produced in facilities, in munitions or elsewhere.

(f) “precursor” means any chemical reactant which takes part at any stage in the production by whatever method of a toxic chemical. This includes any key component of a binary or multicomponent chemical system.

(g) “Organization” means the International Maritime Organization (IMO).

(h) “Secretary-General” means the Secretary-General of the Organization.

2. For the purposes of this Convention,

(a) the terms “place of public use”, “State or government facility”, “infrastructure facility”, and public “transportation system” have the same meaning as given to those terms in the International Convention for the Suppression of Terrorist Bombings, done at New York on 15 December 1997, and

(b) the terms ”source material” and “special fissionable material” have the same meaning as given to those terms in the Statute of the International Atomic Energy Agency (IAEA), done at New York on 26 October 1956.

ARTICLE 3

The following text is added as article 2bis of the Convention:

Article 2bis

1. Nothing in this Convention shall affect other rights, obligations and responsibilities of States and individuals under international law, in particular the purposes and principles of the Charter of the United Nations and international human rights, refugee and humanitarian law.

2. This Convention does not apply to the activities of armed forces during an armed conflict, as those terms are understood under international humanitarian law, which are governed by that law, and the activities undertaken by military forces of a State in the exercise of their official duties, inasmuch as they are governed by other rules of international law.

3. Nothing in this Convention shall affect the rights, obligations and responsibilities under the Treaty on the Non-Proliferation of Nuclear Weapons, done at Washington, London and Moscow on 1 July 1968, the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on their Destruction, done at Washington, London and Moscow on 10 April 1972 or the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, done at Paris on 13 January 1993, of States Parties to such treaties.

ARTICLE 4

1. The chapeau of Article 3, paragraph 1 of the Convention is replaced by the following text:

Any person commits an offence within the meaning of this Convention if that person unlawfully and intentionally:

2 Article 3, paragraph 1(f) of the Convention is replaced by the following text:

(f) communicates information which that person knows to be false, hereby endangering the safe navigation of a ship.

3 Article 3, paragraph 1(g) of the Convention is deleted.

4 Article 3, paragraph 2 of the Convention is replaced by the following text:

2. Any person also commits an offence if that person threatens, with or without a condition, as is provided for under national law, aimed at compelling a physical or juridical person to do or refrain from doing any act, to commit any of the offences set forth in paragraph 1, subparagraphs (b), (c), and (e), if that threat is likely to endanger the safe navigation of the ship in question.

5. The following text is added as article 3bis of the Convention:

Article 3bis

1. Any person commits an offence with­in the meaning of this Convention if that person unlawfully and intentionally:

(a) when the purpose of the act, by its nature or context, is to intimidate a population, or to compel a Government or an international organization to do or to abstain from doing any act:

(i) uses against or on a ship or discharges from a ship any explosive, radioactive material or BCN weapon in a manner that causes or is likely to cause death or serious injury or damage; or

(ii) discharges, from a ship, oil, liquefied natural gas, or other hazardous or noxious substance, which is not covered by subparagraph (i), in such quantity or concentration that causes or is likely to cause death or serious injury or damage; or

(iii) uses a ship in a manner that causes death or serious injury or damage; or

(iv) threatens, with or without a condition, as is provided for under national law, to commit an offence set forth in subparagraph (i), (ii) or (iii); or

(b) transports on board a ship:

(i) any explosive or radioactive material, knowing that it is intended to be used to cause, or in a threat to cause, with or without a condition, as is provided for under national law, death or serious injury or damage for the purpose of intimidating a population, or compelling a Government or an international organization to do or to abstain from doing any act; or

(ii) any BCN weapon, knowing it to be a BCN weapon as defined in article 1; or

(iii) any source material, special fissionable material, or equipment or material especially designed or prepared for the processing, use or production of special fissionable material, knowing that it is intended to be used in a nuclear explosive activity or in any other nuclear activity not under safeguards pursuant to an IAEA comprehensive safeguards agreement; or

(iv) any equipment, materials or software or related technology that significantly contributes to the design, manufacture or delivery of a BCN weapon, with the intention that it will be used for such purpose.

2. It shall not be an offence within the meaning of this Convention to transport an item or material covered by subparagraph 1(b)(iii) or, insofar as it relates to a nuclear weapon or other nuclear explosive device, subparagraph 1(b)(iv), if such item or material is transported to or from the territory of, or is otherwise transported under the control of, a State Party to the Treaty on the Non-Proliferation of Nuclear Weapons where:

(a) the resulting transfer or receipt, including internal to a State, of the item or material is not contrary to such State Party’s obligations under the Treaty on the Non-Proliferation of Nuclear Weapons and,

(b) if the item or material is intended for the delivery system of a nuclear weapon or other nuclear explosive device of a State Party to the Treaty on the Non-Proliferation of Nuclear Weapons, the holding of such weapon or device is not contrary to that State Party’s obligations under that Treaty.

6. The following text is added as Article 3ter of the Convention:

Article 3ter

Any person commits an offence within the meaning of this Convention if that person unlawfully and intentionally transports another person on board a ship knowing that the person has committed an act that constitutes an offence set forth in articles 3, 3bis or 3quater or an offence set forth in any treaty listed in the Annex, and intending to assist that person to evade criminal prosecution.

7. The following text is added as Article 3quater of the Convention:

Article 3quater

Any person also commits an offence within the meaning of this Convention if that person:

(a) unlawfully and intentionally injures or kills any person in connection with the commission of any of the offences set forth in article 3, paragraph 1, article 3bis, or article 3ter; or

(b) attempts to commit an offence set forth in article 3, paragraph 1, article 3bis, subparagraph 1(a)(i), (ii) or (iii) , or subparagraph (a) of this article; or

(c) participates as an accomplice in an offence set forth in article 3, article 3bis, article 3ter or subparagraph (a) or (b) of this article; or

(d) organizes or directs others to commit an offence set forth in article 3, article 3bis, article 3ter or subparagraph (a) or (b) of this article; or

(e) contributes to the commission of one or more offences set forth in article 3, article 3bis, article 3ter or subparagraph (a) or (b) of this article by a group of persons acting with a common purpose, intentionally and either:

(i) with the aim of furthering the criminal activity or criminal purpose of the group, where such activity or purpose involves the commission of an offence set forth in article 3, article 3bis or article 3ter; or

(ii) in the knowledge of the intention of the group to commit an offence set forth in article 3, article 3bis or article 3ter.

ARTICLE 5

1. Article 5 of the Convention is replaced by the following text:

Each State Party shall make the offences set forth in articles 3, 3bis, 3ter and 3quater punishable by appropriate penalties which take into account the grave nature of those offences.

2. The following text is added as Article 5bis of the Convention:

Article 5bis

1. Each State Party, in accordance with its domestic legal principles, shall take the necessary measures to enable a legal entity located in its territory or organized under its laws to be held liable when a person responsible for management or control of that legal entity has, in that capacity, committed an offence set forth in this Convention. Such liability may be criminal, civil or administrative.

2. Such liability is incurred without prejudice to the criminal liability of individuals having committed the offences.

3. Each State Party shall ensure, in particular, that legal entities liable in accordance with paragraph 1 are subject to effective, proportionate and dissuasive criminal, civil or administrative sanctions. Such sanctions may include monetary sanctions.

ARTICLE 6

1 The chapeau of Article 6, paragraph 1 of the Convention is replaced by the following text:

1. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 3, 3bis, 3ter and 3quater when the offence is committed:

2. Article 6, paragraph 3 of the Convention is replaced by the following text:

3. Any State Party which has established jurisdiction mentioned in paragraph 2 shall notify the Secretary-General. If such State Party subsequently rescinds that jurisdiction, it shall notify the Secretary-General.

3. Article 6, paragraph 4 of the Convention is replaced by the following text:

4. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 3, 3bis, 3ter and 3quater in cases where the alleged offender is present in its territory and it does not extradite the alleged offender to any of the States Parties which have established their jurisdiction in accordance with paragraphs 1 and 2 of this article.

ARTICLE 7

The following text is added as an Annex to the Convention:

ANNEX

1. Convention for the Suppression of Unlawful Seizure of Aircraft, done at The Hague on 16 December 1970.

2. Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on 23 September 1971.

3. Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents, adopted by the General Assembly of the United Nations on 14 December 1973.

4. International Convention against the Taking of Hostages, adopted by the General Assembly of the United Nations on 17 December 1979.

5. Convention on the Physical Protection of Nuclear Material, done at Vienna on 26 October 1979.

6. Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, supplementary to the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on 24 February 1988.

7. Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, done at Rome on 10 March 1988.

8. International Convention for the Suppression of Terrorist Bombings, adopted by the General Assembly of the United Nations on 15 December 1997.

9. International Convention for the Suppression of the Financing of Terrorism, adopted by the General Assembly of the United Nations on 9 December 1999.

ARTICLE 8

1. Article 8, paragraph 1 of the Convention is replaced by the following text:

1. The master of a ship of a State Party (the .flag State.) may deliver to the authorities of any other State Party (the .receiving State.) any person who the master has reasonable grounds to believe has committed an offence set forth in article 3, 3bis, 3ter, or 3quater.

2. The following text is added as Article 8bis of the Convention:

Article 8bis

1. States Parties shall co-operate to the fullest extent possible to prevent and suppress unlawful acts covered by this Convention, in conformity with international law, and shall respond to requests pursuant to this article as expeditiously as possible.

2. Each request pursuant to this article should, if possible, contain the name of the suspect ship, the IMO ship identification number, the port of registry, the ports of origin and destination, and any other relevant information. If a request is conveyed orally, the requesting Party shall confirm the request in writing as soon as possible. The requested Party shall acknowledge its receipt of any written or oral request immediately.

3. States Parties shall take into account the dangers and difficulties involved in boarding a ship at sea and searching its cargo, and give consideration to whether other appropriate measures agreed between the States concerned could be more safely taken in the next port of call or elsewhere.

4. A State Party that has reasonable grounds to suspect that an offence set forth in article 3, 3bis, 3ter or 3quater has been, is being or is about to be committed involving a ship flying its flag, may request the assistance of other States Parties in preventing or suppressing that offence. The States Parties so requested shall use their best endeavours to render such assistance within the means available to them.

5. Whenever law enforcement or other authorized officials of a State Party (“the requesting Party”) encounter a ship flying the flag or displaying marks of registry of another State Party (“the first Party”), located seaward of any State’s territorial sea, and the requesting Party has reasonable grounds to suspect that the ship or a person on board the ship has been, is or is about to be involved in the commission of an offence set forth in article 3, 3bis, 3ter or 3quater, and the requesting Party desires to board,

(a) it shall request, in accordance with paragraphs 1 and 2 that the first Party confirm the claim of nationality, and

(b) if nationality is confirmed, the requesting Party shall ask the first Party (hereinafter referred to as, “the flag State”) for authorization to board and to take appropriate measures with regard to that ship which may include stopping, boarding and searching the ship, its cargo and persons on board, and questioning the persons on board in order to determine if an offence set forth in article 3, 3bis, 3ter or 3quater has been, is being or is about to be committed, and

(c) the flag State shall either:

(i) authorize the requesting Party to board and to take appropriate measures set out in subparagraph 5(b), subject to any conditions it may impose in accordance with paragraph 7; or

(ii) conduct the boarding and search with its own law enforcement or other officials; or

(iii) conduct the boarding and search together with the requesting Party, subject to any conditions it may impose in accordance with paragraph 7; or

(iv) decline to authorize a boarding and search.

The requesting Party shall not board the ship or take measures set out in subparagraph 5(b) without the express authorization of the flag State.

(d) Upon or after depositing its instrument of ratification, acceptance, approval or accession, a State Party may notify the Secretary-General that, with respect to ships flying its flag or displaying its mark of registry, the requesting Party is granted authorization to board and search the ship, its cargo and persons on board, and to question the persons on board in order to locate and examine documentation of its nationality and determine if an offence set forth in article 3, 3bis, 3ter or 3quater has been, is being or is about to be committed, if there is no response from the first Party within four hours of acknowledgement of receipt of a request to confirm nationality.

(e) Upon or after depositing its instrument of ratification, acceptance, approval or accession, a State Party may notify the Secretary-General that, with respect to ships flying its flag or displaying its mark of registry, the requesting Party is authorized to board and search a ship, its cargo and persons on board, and to question the persons on board in order to determine if an offence under article 3, 3bis, 3ter or 3quater has been, is being or is about to be committed.

The notifications made pursuant to this paragraph can be withdrawn at any time.

6. When evidence of conduct described in article 3, 3bis, 3ter or 3quater is found as the result of any boarding conducted pursuant to this article, the flag State may authorize the requesting Party to detain the ship, cargo and persons on board pending receipt of disposition instructions from the flag State. The requesting Party shall inform promptly the flag State of the results of a boarding, search, and detention conducted pursuant to this article. The requesting Party shall also inform promptly the flag State of the discovery of evidence of illegal conduct that is not subject to this Convention.

7. The flag State, consistent with the other provisions of this Convention, may subject its authorization under paragraph 5 or 6 to conditions, including obtaining additional information from the requesting Party, and conditions relating to responsibility for and the extent of measures to be taken. No additional measures may be taken without the express authorization of the flag State, except when necessary to relieve imminent danger to the lives of persons or where those measures derive from relevant bilateral or multilateral agreements.

8. For all boardings pursuant to this article, the flag State has the right to exercise jurisdiction over a detained ship, cargo or other items and persons on board, including seizure, forfeiture, arrest and prosecution. However, the flag State may, subject to its constitution and laws, consent to the exercise of jurisdiction by another State having jurisdiction under article 6.

9. When carrying out the authorized actions under this article, the use of force shall be avoided except when necessary to ensure the safety of its officials and persons on board, or where the officials are obstructed in the execution of the authorized actions. Any use of force pursuant to this article shall not exceed the minimum degree of force which is necessary and reasonable in the circumstances.

10. Safeguards:

(a) Where a State Party takes measures against a ship in accordance with this article, it shall:

(i) take due account of the need not to endanger the safety of life at sea;

(ii) ensure that all persons on board are treated in a manner which preserves their basic human dignity, and in compliance with the applicable provisions of international law, including international law of human rights;

(iii) ensure that a boarding and search pursuant to this article shall be conducted in accordance with applicable international law;

(iv) take due account of the safety and security of the ship and its cargo;

(v) take due account of the need not to prejudice the commercial or legal interests of the flag State;

(vi) ensure, within available means, that any measure taken with regard to the ship or its cargo is environmentally sound under the circumstances;

(vii) ensure that persons on board against whom proceedings may be commenced in connection with any of the offences set forth in article 3, 3bis, 3ter or 3quater are afforded the protections of paragraph 2 of article 10, regardless of location;

(viii) ensure that the master of a ship is advised of its intention to board, and is, or has been, afforded the opportunity to contact the ship’s owner and the flag State at the earliest opportunity; and

(ix) take reasonable efforts to avoid a ship being unduly detained or delayed.

(b) Provided that authorization to board by a flag State shall not per se give rise to its liability, States Parties shall be liable for any damage, harm or loss attributable to them arising from measures taken pursuant to this article when:

(i) the grounds for such measures prove to be unfounded, provided that the ship has not committed any act justifying the measures taken; or

(ii) such measures are unlawful or exceed that reasonably required in light of available information to implement the provisions of this article.

States Parties shall provide effective recourse in respect of such damage, harm or loss.

(c) Where a State Party takes measures against a ship in accordance with this Convention, it shall take due account of the need not to interfere with or to affect:

(i) the rights and obligations and the exercise of jurisdiction of coastal States in accordance with the international law of the sea; or

(ii) the authority of the flag State to exercise jurisdiction and control in administrative, technical and social matters involving the ship.

(d) Any measure taken pursuant to this article shall be carried out by law enforcement or other authorized officials from warships or military aircraft, or from other ships or aircraft clearly marked and identifiable as being on government service and authorized to that effect and, notwithstanding articles 2 and 2bis, the provisions of this article shall apply.

(e) For the purposes of this article “law enforcement or other authorized officials” means uniformed or otherwise clearly identifiable members of law enforcement or other government authorities duly authorized by their government. For the specific purpose of law enforcement under this Convention, law enforcement or other authorized officials shall provide appropriate government-issued identification documents for examination by the master of the ship upon boarding.

11. This article does not apply to or limit boarding of ships, conducted by any State Party in accordance with international law, seaward of any State’s territorial sea, including boardings based upon the right of visit, the rendering of assistance to persons, ships and property in distress or peril, or an authorization from the flag State to take law enforcement or other action.

12. States Parties are encouraged to develop standard operating procedures for joint operations pursuant to this article and consult, as appropriate, with other States Parties with a view to harmonizing such standard operating procedures for the conduct of operations.

13. States Parties may conclude agreements or arrangements between them to facilitate law enforcement operations carried out in accordance with this article.

14. Each State Party shall take appropriate measures to ensure that its law enforcement or other authorized officials, and law enforcement or other authorized officials of other States Parties acting on its behalf, are empowered to act pursuant to this article.

15. Upon or after depositing its instrument of ratification, acceptance, approval or accession, each State Party shall designate the authority, or, where necessary, authorities to receive and respond to requests for assistance, for confirmation of nationality, and for authorization to take appropriate measures. Such designation, including contact information, shall be notified to the Secretary-General within one month of becoming a Party, who shall inform all other States Parties within one month of the designation. Each State Party is responsible for providing prompt notice through the Secretary-General of any changes in the designation or contact information.

ARTICLE 9

Article 10, paragraph 2 is replaced by the following text:

2. Any person who is taken into custody or regarding whom any other measures are taken or proceedings are being carried out pursuant to this Convention shall be guaranteed fair treatment, including enjoyment of all rights and guarantees in conformity with the law of the State in the territory of which that person is present and applicable provisions of international law, including international human rights law.

ARTICLE 10

1. Article 11, paragraphs 1, 2, 3 and 4 are replaced by the following text:

1. The offences set forth in articles 3, 3bis, 3ter and 3quater shall be deemed to be included as extraditable offences in any extradition treaty existing between any of the States Parties. States Parties undertake to include such offences as extraditable offences in every extradition treaty to be concluded between them.

2. If a State Party which makes ex­tradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, the requested State Party may, at its option, consider this Convention as a legal basis for extradition in respect of the offences set forth in articles 3, 3bis, 3ter and 3quater. Ex­tradition shall be subject to the other conditions provided by the law of the requested State Party.

3. States Parties which do not make extradition conditional on the existence of a treaty shall recognize the offences set forth in articles 3, 3bis, 3ter and 3quater as extraditable offences between themselves, subject to the conditions provided by the law of the requested State Party.

4. If necessary, the offences set forth in articles 3, 3bis, 3ter and 3quater shall be treated, for the purposes of extradition between States Parties, as if they had been committed not only in the place in which they occurred but also in a place within the jurisdiction of the State Party requesting extradition.

2. The following text is added as Article 11bis of the Convention:

Article 11bis

None of the offences set forth in article 3, 3bis, 3teror 3quater shall be regarded for the purposes of extradition or mutual legal assistance as a political offence or as an offence connected with a political offence or as an offence inspired by political motives. Accordingly, a request for extradition or for mutual legal assistance based on such an offence may not be refused on the sole ground that it concerns a political offence or an offence connected with a political offence or an offence inspired by political motives.

3. The following text is added as Article 11ter of the Convention:

Article 11ter

Nothing in this Convention shall be interpreted as imposing an obligation to extradite or to afford mutual legal assistance, if the requested State Party has substantial grounds for believing that the request for extradition for offences set forth in article 3, 3bis, 3ter or 3quater or for mutual legal assistance with respect to such offences has been made for the purpose of prosecuting or punishing a person on account of that person’s race, religion, nationality, ethnic origin, political opinion or gender, or that compliance with the request would cause prejudice to that person’s position for any of these reasons.

ARTICLE 11

1. Article 12, paragraph 1 of the Convention is replaced by the following text:

1. States Parties shall afford one another the greatest measure of assistance in connection with criminal proceedings brought in respect of the offences set forth in articles 3, 3bis, 3ter and 3quater, including assistance in obtaining evidence at their disposal necessary for the proceedings.

2. The following text is added as Article 12bis of the Convention:

Article 12bis

1. A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of identification, testimony or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences set forth in article 3, 3bis, 3ter or 3quater may be transferred if the following conditions are met:

(a) the person freely gives informed consent; and

(b) the competent authorities of both States agree, subject to such conditions as those States may deem appropriate.

2. For the purposes of the present article:

(a) the State to which the person is transferred shall have the authority and obligation to keep the person transferred in custody, unless otherwise requested or authorized by the State from which the person was transferred;

(b) the State to which the person is transferred shall without delay implement its obligation to return the person to the custody of the State from which the person was transferred as agreed beforehand, or as otherwise agreed, by the competent authorities of both States;

(c) the State to which the person is transferred shall not require the State from which the person was transferred to initiate extradition proceedings for the return of the person;

(d) the person transferred shall receive credit for service of the sentence being served in the State from which the person was transferred for time spent in the custody of the State to which the person was transferred.

3. Unless the State Party from which a person is to be transferred in accordance with the present article so agrees, that person, whatever that person’s nationality, shall not be prosecuted or detained or subjected to any other restriction of personal liberty in the territory of the State to which that person is transferred in respect of acts or convictions anterior to that person’s departure from the territory of the State from which such person was transferred.

ARTICLE 12

Article 13 of the Convention is replaced by the following text:

1. States Parties shall co-operate in the prevention of the offences set forth in articles 3, 3bis, 3ter and 3quater, particularly by:

(a) taking all practicable measures to prevent preparation in their respective territories for the commission of those offences within or outside their territories;

(b) exchanging information in accordance with their national law, and co-ordinating administrative and other measures taken as appropriate to prevent the commission of offences set forth in articles 3, 3bis, 3ter and 3quater.

2. When due to the commission of an offence set forth in article 3, 3bis, 3ter or 3quater, the passage of a ship has been delayed or interrupted, any State Party in whose territory the ship or passengers or crew are present shall be bound to exercise all possible efforts to avoid a ship, its passengers, crew or cargo being unduly detained or delayed.

ARTICLE 13

Article 14 of the Convention is replaced by the following text:

Any State Party having reason to believe that an offence set forth in article 3, 3bis, 3ter or 3quater will be committed shall, in accordance with its national law, furnish as promptly as possible any relevant information in its possession to those States which it believes would be the States having established jurisdiction in accordance with article 6.

ARTICLE 14

Article 15, paragraph 3 of the Convention is replaced by the following text:

3 The information transmitted in accordance with paragraphs 1 and 2 shall be communicated by the Secretary-General to all States Parties, to Members of the Organization, to other States concerned, and to the appropriate international intergovernmental organizations.

ARTICLE 15

Interpretation and application

1. The Convention and this Protocol shall, as between the Parties to this Protocol, be read and interpreted together as one single instrument.

2. Articles 1 to 16 of the Convention, as revised by this Protocol, together with articles 17 to 24 of this Protocol and the annex thereto, shall constitute and be called the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, 2005 (2005 SUA Convention).

ARTICLE 16

The following text is added as article 16bis of the Convention:

Final clauses of the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, 2005

The final clauses of the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, 2005 shall be articles 17 to 24 of the Protocol of 2005 to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, 1988. References in this Convention to States Parties shall be taken to mean references to States Parties to that Protocol.

FINAL CLAUSES

ARTICLE 17

Signature, ratification, acceptance, approval and accession

1. This Protocol shall be open for signature at the Headquarters of the Organization from 14 February 2006 to 13 February 2007 and shall thereafter remain open for accession.

2. States may express their consent to be bound by this Protocol by:

(a) signature without reservation as to ratification, acceptance or approval; or

(b) signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or

(c) accession.

3. Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General.

4. Only a State which has signed the Convention without reservation as to ratification, acceptance or approval, or has ratified, accepted, approved or acceded to the Convention may become a Party to this Protocol.

ARTICLE 18

Entry into force

1. This Protocol shall enter into force ninety days following the date on which twelve States have either signed it without reservation as to ratification, acceptance or approval, or have deposited an instrument of ratification, acceptance, approval or accession with the Secretary-General.

2. For a State which deposits an instrument of ratification, acceptance, approval or accession in respect of this Protocol after the conditions in paragraph 1 for entry into force thereof have been met, the ratification, acceptance, approval or accession shall take effect ninety days after the date of such deposit.

ARTICLE 19

Denunciation

1. This Protocol may be denounced by any State Party at any time after the date on which this Protocol enters into force for that State.

2. Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General.

3. A denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after the deposit of the instrument with the Secretary-General.

ARTICLE 20

Revision and amendment

1. A conference for the purpose of revising or amending this Protocol may be convened by the Organization.

2. The Secretary-General shall convene a conference of States Parties to this Protocol for revising or amending the Protocol, at the request of one third of the States Parties, or ten States Parties, whichever is the higher figure.

3. Any instrument of ratification, acceptance, approval or accession deposited after the date of entry into force of an amendment to this Protocol shall be deemed to apply to the Protocol as amended.

ARTICLE 21

Declarations

1. Upon depositing its instrument of ratification, acceptance, approval or accession, a State Party which is not a party to a treaty listed in the Annex may declare that, in the application of this Protocol to the State Party, the treaty shall be deemed not to be included in article 3ter. The declaration shall cease to have effect as soon as the treaty enters into force for the State Party, which shall notify the Secretary-General of this fact.

2. When a State Party ceases to be a party to a treaty listed in the Annex, it may make a declaration as provided for in this article, with respect to that treaty.

3. Upon depositing its instrument of ratification, acceptance, approval or accession, a State Party may declare that it will apply the provisions of article 3ter in accordance with the principles of its criminal law concerning family exemptions of liability.

ARTICLE 22

Amendments to the Annex

1. The Annex may be amended by the addition of relevant treaties that:

(a) are open to the participation of all States;

(b) have entered into force; and

(c) have been ratified, accepted, approved or acceded to by at least twelve States Parties to this Protocol.

2. After the entry into force of this Protocol, any State Party thereto may propose such an amendment to the Annex. Any proposal for an amendment shall be communicated to the Secretary-General in written form. The Secretary-General shall circulate any proposed amendment that meets the requirements of paragraph 1 to all members of the Organization and seek from States Parties to this Protocol their consent to the adoption of the proposed amendment.

3. The proposed amendment to the Annex shall be deemed adopted after more than twelve of the States Parties to this Protocol consent to it by written notification to the Secretary-General.

4. The adopted amendment to the Annex shall enter into force thirty days after the deposit with the Secretary-General of the twelfth instrument of ratification, acceptance or approval of such amendment for those States Parties to this Protocol that have deposited such an instrument. For each State Party to this Protocol ratifying, accepting or approving the amendment after the deposit of the twelfth instrument with the Secretary-General, the amendment shall enter into force on the thirtieth day after deposit by such State Party of its instrument of ratification, acceptance or approval.

ARTICLE 23

Depositary

1. This Protocol and any amendments adopted under articles 20 and 22 shall be deposited with the Secretary-General.

2. The Secretary-General shall:

(a) inform all States which have signed this Protocol or acceded to this Protocol of:

(i) each new signature or deposit of an instrument of ratification, acceptance, approval or accession together with the date thereof;

(ii) the date of the entry into force of this Protocol;

(iii) the deposit of any instrument of denunciation of this Protocol together with the date on which it is received and the date on which the denunciation takes effect;

(iv) any communication called for by any article of this Protocol;

(v) any proposal to amend the Annex which has been made in accordance with article 22. paragraph 2;

(vi) any amendment deemed to have been adopted in accordance with article 22, paragraph 3;

(vii) any amendment ratified, accepted or approved in accordance with article 22, paragraph 4, together with the date on which that amendment shall enter into force; and

(b) transmit certified true copies of this Protocol to all States which have signed or acceded to this Protocol.

3. As soon as this Protocol enters into force, a certified true copy of the text shall be transmitted by the Secretary-General to the Secretary-General of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

ARTICLE 24

Languages

This Protocol is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.

PROTOCOL OF 2005 TO THE PROTOCOL FOR THE SUPPRESSION OF UNLAWFUL ACTS AGAINST THE SAFETY OF FIXED PLATFORMS LOCATED ON THE CONTINENTAL SHELF

THE STATES PARTIES to this Protocol,

BEING PARTIES to the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf done at Rome on 10 March 1988,

RECOGNIZING that the reasons for which the Protocol of 2005 to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation was elaborated also apply to fixed platforms located on the continental shelf,

TAKING account of the provisions of those Protocols,

HAVE AGREED as follows:

ARTICLE 1

For the purposes of this Protocol:

1. “1988 Protocol” means the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, done at Rome on 10 March 1988;

2. ”Organization” means the International Maritime Organization; and

3. “Secretary-General” means the Secretary-General of the Organization.

ARTICLE 2

Article 1, paragraph 1, of the 1988 Protocol is replaced by the following text:

1. The provisions of article 1, subparagraphs (1)(c), (d), (e), (f), (g), (h) and 2(a), of articles 2bis, 5, 5bis and 7, and of articles 10 to 16, including articles 11bis, 11ter and 12bis, of the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, as amended by the Protocol of 2005 to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, shall also apply mutatis mutandis to the offences set forth in articles 2, 2bis and 2ter of this Protocol where such offences are committed on board or against fixed platforms located on the continental shelf.

ARTICLE 3

1 Article 2, paragraph 1(d) of the 1988 Protocol is replaced by the following text:

(d) places or causes to be placed on a fixed platform, by any means whatsoever, a device or substance which is likely to destroy that fixed platform or likely to endanger its safety.

2. Article 2, paragraph 1(e) of the 1988 Protocol is deleted.

3. Article 2, paragraph 2 of the 1988 Protocol is replaced by the following text:

2 Any person also commits an offence if that person threatens, with or without a condition, as is provided for under national law, aimed at compelling a physical or juridical person to do or refrain from doing any act, to commit any of the offences set forth in subparagraphs 1(b) and (c), if that threat is likely to endanger the safety of the fixed platform.

ARTICLE 4

1. The following text is inserted as article 2bis:

Article 2bis

Any person commits an offence within the meaning of this Protocol if that person unlawfully and intentionally, when the purpose of the act, by its nature or context, is to intimidate a population, or to compel a Government or an international organization to do or to abstain from doing any act:

(a) uses against or on a fixed platform or discharges from a fixed platform any explosive, radioactive material or BCN weapon in a manner that causes or is likely to cause death or serious injury or damage; or

(b) discharges, from a fixed platform, oil, liquefied natural gas, or other hazardous or noxious substance, which is not covered by subparagraph (a), in such quantity or concentration that causes or is likely to cause death or serious injury or damage; or

(c) threatens, with or without a condition, as is provided for under national law, to commit an offence set forth in subparagraph (a) or (b).

2. The following text is inserted as Article 2ter:

Article 2ter

Any person also commits an offence within the meaning of this Protocol if that person:

(a) unlawfully and intentionally injures or kills any person in connection with the commission of any of the offences set forth in article 2, paragraph 1 or article 2bis; or

(b) attempts to commit an offence set forth in article 2, paragraph 1, article 2bis, paragraph 1 or 2, or subparagraph (a) of this article; or

(c) participates as an accomplice in an offence set forth in article 2, article 2bis or subparagraph (a) or (b) of this article; or

(d) organizes or directs others to commit an offence set forth in article 2, article 2bis or subparagraph (a) or (b) of this article; or

(e) contributes to the commission of one or more offences set forth in article 2, article 2bis or subparagraph (a) or (b) of this article by a group of persons acting with a common purpose, intentionally and either:

(i) with the aim of furthering the criminal activity or criminal purpose of the group, where such activity or purpose involves the commission of an offence set forth in article 2 or 2bis; or

(ii) in the knowledge of the intention of the group to commit an offence set forth in article 2 or 2bis.

ARTICLE 5

1. Article 3, paragraph 1 of the 1988 Protocol is replaced by the following text:

1 Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 2, 2bis and 2ter when the offence is committed:

(a) against or on board a fixed platform while it is located on the continental shelf of that State; or

(b) by a national of that State.

2. Article 3, paragraph 3 of the 1988 Protocol is replaced by the following text:

3. Any State Party which has established jurisdiction mentioned in paragraph 2 shall notify the Secretary-General. If such State Party subsequently rescinds that jurisdiction, it shall notify the Secretary-General.

3 Article 3, paragraph 4 of the 1988 Protocol is replaced by the following text:

4. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 2, 2bis and 2ter in cases where the alleged offender is present in its territory and it does not extradite the alleged offender to any of the States Parties which have established their jurisdiction in accordance with paragraphs 1 and 2.

ARTICLE 6

Interpretation and application

1. The 1988 Protocol and this Protocol shall, as between the Parties to this Protocol, be read and interpreted together as one single instrument.

2. Articles 1 to 4 of the 1988 Protocol, as revised by this Protocol, together with articles 8 to 13 of this Protocol shall constitute and be called the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, 2005 (2005 SUA Fixed Platforms Protocol).

ARTICLE 7

The following text is added as article 4bis of the Protocol:

Final clauses of the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, 2005

The final clauses of the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, 2005, shall be articles 8 to 13 of the Protocol of 2005 to the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, 1988. References in this Protocol to States Parties shall be taken to mean references to States Parties to the 2005 Protocol.

2. For a State which deposits an instrument of ratification, acceptance, approval or accession in respect of this Protocol after the conditions in paragraph 1 for entry into force thereof have been met, the ratification, acceptance, approval or accession shall take effect ninety days after the date of such deposit.

ARTICLE 10

Denunciation

1. This Protocol may be denounced by any State Party at any time after the date on which this Protocol enters into force for that State.

2. Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General.

3. A denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after the deposit of the instrument with the Secretary-General.

ARTICLE 11

Revision and amendment

1. A conference for the purpose of revising or amending this Protocol may be convened by the Organization.

2. The Secretary-General shall convene a conference of States Parties to this Protocol for revising or amending the Protocol, at the request of one third of the States Parties, or five States Parties, whichever is the higher figure.

3. Any instrument of ratification, acceptance, approval or accession deposited after the date of entry into force of an amendment to this Protocol shall be deemed to apply to the Protocol as amended.

ARTICLE 12

Depositary

1. This Protocol and any amendments adopted under article 11 shall be deposited

with the Secretary-General.

2. The Secretary-General shall:

(a) inform all States which have signed this Protocol or acceded to this Protocol of:

(i) each new signature or deposit of an instrument of ratification, acceptance, approval or accession together with the date thereof;

(ii) the date of the entry into force of this Protocol;

(iii) the deposit of any instrument of denunciation of this Protocol together with the date on which it is received and the date on which the denunciation takes effect;

(iv) any communication called for by any article of this Protocol; and

(b) transmit certified true copies of this Protocol to all States which have signed or acceded to this Protocol.

3. As soon as this Protocol enters into force, a certified true copy of the text shall be transmitted by the Secretary-General to the Secretary-General of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

ARTICLE 13

Languages

This Protocol is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.

Konvencijas par prettiesisku darbību pret kuģošanas drošību apkarošanu 2005. gada protokols

Preambula

Šā protokola dalībvalstis,

būdamas puses 1988. gada 10. martā Romā pieņemtajai Konvencijai par prettiesisku darbību pret kuģošanas drošību apkarošanu,

atzīstot, ka terorisma akti apdraud starptautisko mieru un drošību,

ņemot vērā Starptautiskās jūrniecības organizācijas Asamblejas rezolūciju A.924(22), kurā lūgts pārskatīt esošos starptautiskos juridiskos un tehniskos pasākumus un apsvērt jaunus pasākumus, lai novērstu un apkarotu terorismu pret kuģiem un uzlabotu drošību uz kuģiem un krastā, un tādējādi mazināt draudus pasažieriem, apkalpei un ostas darbiniekiem, kas atrodas uz kuģa un ostas teritorijā, kā arī kuģošanas līdzekļiem un to kravai,

ņemot vērā Deklarāciju par pasākumiem starptautiskā terorisma likvidēšanai, kas pievienota Apvienoto Nāciju Organizācijas Ģenerālās Asamblejas 1994. gada 9. decembra rezolūcijai 49/60, kurā inter alia Apvienoto Nāciju Organizācijas dalībvalstis svinīgi apstiprina, ka tās nepārprotami nosoda jebkādas terorisma darbības, metodes un prakses, neatkarīgi no tā, kur un kas tās ir veicis, tostarp tās, kuras apdraud draudzīgās attiecības starp valstīm un tautām, kā arī valstu teritoriālo integritāti un drošību,

atzīmējot Apvienoto Nāciju Organizācijas Ģenerālās Asamblejas 1996. gada 17. decembra rezolūciju 51/210 un tai pievienoto Deklarāciju, ar ko papildina 1994. gada Deklarāciju par pasākumiem starptautiskā terorisma likvidēšanai,

atgādinot Apvienoto Nāciju Organizācijas Drošības padomes rezolūcijas 1368 (2001) un 1373 (2001), kurās atspoguļota starptautiskā griba novērst visus terorisma veidus un izpausmes un kurās valstīm uzdoti uzdevumi un pienākumi, kā arī ņemot vērā ilgstošos terora aktu draudus,

atgādinot arī Apvienoto Nāciju Organizācijas Drošības padomes rezolūciju 1540 (2004), kurā atzīta vajadzība valstīm steidzami veikt papildu efektīvus pasākumus, lai novērstu kodolieroču, ķīmisko vai bioloģisko ieroču un to nogādes līdzekļu izplatīšanu,

turklāt atgādinot 1963. gada 14. septembrī Tokijā pieņemto Konvenciju par noziegumiem un dažām citām nelikumīgām darbībām, kas izdarītas gaisa kuģos, 1970. gada 16. decembrī Hāgā pieņemto Konvenciju par cīņu pret gaisa kuģu nelikumīgu sagrābšanu, 1971. gada 23. septembrī Monreālā pieņemto Konvenciju par cīņu pret nelikumīgām darbībām, kas apdraud civilās aviācijas drošību, 1973. gada 14. decembrī ANO Ģenerālās Asamblejas pieņemto Konvenciju par noziegumu novēršanu pret personām, kas bauda starptautisko aizsardzību, arī pret diplomātiskajiem aģentiem, un sodīšanu par šādiem noziegumiem, 1979. gada 17. decembrī ANO Ģenerālās Asamblejas pieņemto Starptautisko konvenciju pret ķīlnieku sagrābšanu, 1979. gada 26. oktobrī Vīnē pieņemto un 2005. gada 8. jūlijā grozīto Konvenciju par kodolvielu fizisko aizsardzību, 1988. gada 24. februārī Monreālā pieņemto Protokolu par cīņu pret nelikumīgu vardarbību lidostās, kas apkalpo starptautisko civilo aviāciju, kurš pievienots Konvencijai par cīņu pret nelikumīgām darbībām, kas apdraud civilās aviācijas drošību, 1988. gada 10. martā Romā pieņemto Protokolu par prettiesisku darbību pret nostiprinātu platformu drošību kontinentālajā šelfā apkarošanu, 1991. gada 1. martā Monreālā pieņemto Konvenciju par plastikas sprāgstvielu marķēšanu, lai veicinātu to atklāšanu, 1997. gada 15. decembrī ANO Ģenerālās Asamblejas pieņemto Starptautisko konvenciju par cīņu pret teroristu rīkotajiem sprādzieniem, 1999. gada 9. decembrī ANO Ģenerālās Asamblejas pieņemto Starptautisko konvenciju par cīņu pret terorisma finansēšanu un 2005. gada 13. aprīlī ANO Ģenerālās Asamblejas pieņemto Starptautisko konvenciju par kodolterorisma apkarošanu,

ņemot vērā 1982. gada 10. decembrī Montegobejā pieņemtās ANO Jūras tiesību konvencijas svarīgumu un starptautisko jūras tiesību paražu normu svarīgumu,

ņemot vērā ANO Ģenerālās Asamblejas rezolūciju 59/46, kurā atkārtoti apstiprināts, ka starptautiskajai sadarbībai, kā arī valstu darbībām cīņā pret terorismu jāatbilst Apvienoto Nāciju Organizācijas Statūtu principiem, starptautiskajiem tiesību aktiem un attiecīgajām starptautiskajām konvencijām, un ANO Ģenerālās Asamblejas rezolūciju 59/24, kurā valstis mudinātas kļūt par Konvencijas par prettiesisku darbību pret kuģošanas drošību apkarošanu un tās protokola pusēm, valstis aicinātas piedalīties Starptautiskās jūrniecības organizācijas Juridiskās komitejas veiktā šo aktu pārskatīšanā, lai nostiprinātu veidus, kā cīnīties pret šādām nelikumīgām darbībām, tostarp terora aktiem, un valstis mudina veikt atbilstošus pasākumus, lai nodrošinātu šo aktu efektīvu īstenošanu, proti, jo īpaši, attiecīgā gadījumā pieņemot tiesību aktus, kuru mērķis ir nodrošināt attiecīgus pamata noteikumus reaģēšanai uz bruņotas laupīšanas un terora aktu incidentiem jūrā,

ņemot vērā arī svarīgumu, kas piemīt šīs konvencijas līgumslēdzēju valdību konferencē 2002. gadā pieņemtajiem grozījumiem 1974. gada Starptautiskajā konvencijā par cilvēku dzīvības aizsardzību uz jūras un Starptautiskajā kuģu un ostas iekārtu aizsardzības kodeksā (IPSP), lai izstrādātu atbilstošus starptautiskus tehniskos pamata noteikumus, kuros iekļauta sadarbība starp valdībām, valsts aģentūrām, valsts un vietējām pārvaldes iestādēm, kā arī starp kuģniecības un ostu saimniecības nozarēm, lai konstatētu draudus drošībai un veiktu preventīvus pasākumus pret starpgadījumiem, kas saistīti ar drošību un kas ietekmē kuģus vai ostas iekārtas, kurus izmanto starptautiskajā tirdzniecībā,

turklāt ņemot vērā ANO Ģenerālās Asamblejas rezolūciju 58/187, kurā atkārtoti apstiprināts, ka valstīm jānodrošina, lai visi veiktie pasākumi terorisma apkarošanai atbilst šo valstu saistībām saskaņā ar starptautiskajām tiesībām, jo īpaši starptautiskajām cilvēktiesībām, bēgļu un humanitārajām tiesībām,

uzskatot, ka ir jāpieņem noteikumi, kas papildina attiecīgās konvencijas noteikumus, lai mazinātu terora aktus pret starptautiskās kuģošanas drošību un uzlabotu kuģošanas efektivitāti,

vienojušās.

1. pants

Šajā protokolā lieto šādus apzīmējumus:

1. “konvencija” ir 1988. gada 10. martā Romā pieņemtā Konvencija par prettiesisku darbību pret kuģošanas drošību apkarošanu,

2. “organizācija” ir Starptautiskā jūrniecības organizācija (IMO) un

3. “ģenerālsekretārs” ir organizācijas ģenerālsekretārs.

2. pants

Konvencijas 1. pantu groza šādi.

1.  pants

1. Šajā konvencijā:

a) “kuģis” ir jebkāda veida kuģošanas līdzeklis, kas nav pastāvīgi nostiprināts jūras dzīlēs, tostarp kuģis ar dinamisko cēlējspēku, zemūdens kuģis vai jebkurš cits kuģošanas līdzeklis,

b) “transportēt” nozīmē uzsākt, organizēt vai īstenot faktisko kontroli, tostarp lēmējiestādes kontroli, pār personu vai priekšmetu pārvadājumiem,

c) “būtisks kaitējums vai bojājums” ir:

i) smags miesas bojājums vai

ii) sabiedriskas vietas, valsts vai valdības iekārtas, infrastruktūras iekārtas vai sabiedriskā transporta sistēmas plaša iznīcināšana, kas rada būtisku mantisku kaitējumu, vai

iii) būtisks kaitējums videi, tostarp atmosfērai, augsnei, ūdenim, faunai vai florai,

d) “bioloģiskais, ķīmiskais un kodolierocis” ir:

i) “bioloģiskie ieroči”:

1) mikrobioloģiskās vai citas bioloģiskās kaujas vielas vai toksīni, neatkarīgi no to izcelsmes vai ražošanas metodes, veida un daudzuma, kas nav paredzēti lietošanai profilaktiskiem, aizsargājošiem vai citiem nemilitāriem nolūkiem, vai

2) ieroči, iekārtas vai ieroču nogādes līdzekļi, kuros šādas kaujas vielas vai toksīnus izmanto naidīgiem nolūkiem vai bruņotos konfliktos,

ii) “ķīmiskie ieroči”, kopā vai atsevišķi:

1) toksiskas ķīmiskas vielas un to prekursori, izņemot, ja tos izmanto:

A) rūpniecībā, lauksaimniecībā, pētniecībā, medicīnā, farmācijā vai citiem nemilitāriem nolūkiem, vai

B) aizsardzības nolūkā, proti, nolūkā, kas tieši saistīts ar aizsardzību pret toksiskām ķīmiskām vielām un ķīmiskiem ieročiem, vai

C) militāriem nolūkiem, kas nav saistīti ar ķīmisko ieroču izmantošanu un nav atkarīgi no ķīmisko vielu toksisko īpašību izmantošanas karadarbībā, vai

D) tiesībaizsardzībā, tostarp iekšzemes masu nekārtību novēršanā, ja to veids un daudzums atbilst šādam nolūkam,

2) munīcija un ierīces, kas īpaši paredzētas, lai izraisītu nāvi vai nodarītu citu kaitējumu, izmantojot ii) 1) apakšpunktā norādīto to toksisko ķīmisko vielu toksiskās īpašības, kas tiktu atbrīvotas šādas munīcijas un ierīču izmantošanas rezultātā,

3) jebkādas iekārtas, kas īpaši paredzētas izmantošanai savienojumā ar munīciju vai ierīcēm, kas norādītas ii) 2) apakšpunktā,

iii) kodolieroči un citas kodolsprādzienierīces,

e) “toksiska ķīmiska viela” ir jebkura ķīmiska viela, kuras ķīmiskā iedarbība uz dzīvības procesiem var izraisīt nāvi, pārejošu darbnespēju vai pastāvīgu kaitējumu cilvēku vai dzīvnieku veselībai. Pie toksiskām ķīmiskām vielām pieskaitāmas visas šādas ķīmiskas vielas, neatkarīgi no to izcelsmes vai ražošanas metodes un neatkarīgi no tā, vai tās tiek radītas iekārtās, munīcijā vai citur,

f) “prekursors” ir jebkura ķīmiski reaģējoša viela, kas izmantota kādā no ražošanas posmiem, neatkarīgi no toksiskās ķīmiskās vielas veida. Pie prekursoriem pieskaitāmas arī binārās vai daudzkomponentu ķīmiskās sistēmas jebkuru galveno sastāvdaļu,

g) “organizācija” ir Starptautiskā jūrniecības organizācija (IMO),

h) “ģenerālsekretārs” ir Organizācijas ģenerālsekretārs.

2. Šajā Konvencijā:

a) terminiem “sabiedriska vieta”, “valsts vai valdības iekārta”, “infrastruktūra” un “sabiedriskā transporta sistēma” ir tāda pati nozīme kāda šiem terminiem piešķirta 1997. gada 15. decembrī Ņujorkā pieņemtajā Starptautiskajā konvencijā par cīņu pret teroristu rīkotajiem sprādzieniem, un

b) terminiem “izejmateriāls” un “īpašais skaldmateriāls” ir tāda pati nozīme, kā terminiem Starptautiskās atomenerģijas aģentūras (IAEA) statūtos, kas pieņemti Ņujorkā 1956. gada 26. oktobrī.

3. pants

Šo tekstu pievieno kā Konvencijas 2.bis pantu:

2.bis pants

1. Šī Konvencija neietekmē citas valstu un indivīdu tiesības, saistības un pienākumus, kas noteikti saskaņā ar starptautiskajām tiesībām, jo īpaši Apvienoto Nāciju Organizācijas Statūtu mērķus un principus un starptautiskās cilvēktiesības, bēgļu un humanitārās tiesības.

2. Šī Konvencija neattiecas uz tām bruņoto spēku darbībām bruņotu konfliktu laikā, ko reglamentē starptautiskās humanitārās tiesības, tādā veidā, kādā šie termini tiek saprasti šajās tiesībās, kā arī uz valsts bruņoto spēku darbībām, kas veiktas pildot dienesta pienākumus tiktāl, ciktāl tās reglamentētas citās starptautisko tiesību normās.

3. Šī Konvencija neietekmē tiesības, saistības un pienākumus, kas noteikti attiecīgo līgumu pusēm saskaņā ar 1968. gada 1. jūlijā Vašingtonā, Londonā un Maskavā noslēgto Līgumu par kodolieroču neizplatīšanu, 1972. gada 10. aprīlī Vašingtonā, Londonā un Maskavā pieņemto Konvenciju par bakterioloģisko (bioloģisko) un toksisko ieroču izstrādāšanas, ražošanas un uzglabāšanas aizliegšanu un to iznīcināšanu un 1993. gada 13. janvārī Parīzē pieņemto Konvenciju par ķīmisko ieroču izmantošanas, izstrādāšanas, ražošanas un uzglabāšanas aizliegšanu un to iznīcināšanu.

4. pants

1. Konvencijas 3. panta 1. punkta pamatdaļu aizstāj ar šādu tekstu.

Jebkura persona ir izdarījusi nodarījumu šīs konvencijas nozīmē, ja šī persona nelikumīgi un ar nodomu:

2. Konvencijas 3. panta 1. punkta f) apakšpunktu aizstāj ar šādu tekstu:

f) sniedz informāciju, kuru šī persona uzskata par nepatiesu, tādējādi apdraudot kuģa drošu kuģošanu.

3. Konvencijā svītro 3. panta 1. punkta g) apakšpunktu.

4. Konvencijas 3. panta 2. punktu aizstāj ar šādu tekstu:

2. Jebkura persona izdara nodarījumu, ja šī persona apdraud – atbilstoši tiesību aktiem – ar nosacījumu vai bez nosacījuma, ka šo draudu mērķis ir piespiest fizisku vai juridisku personu veikt vai neveikt jebkādu darbību, lai izdarītu jebkuru no 1. punkta b), c) un e) apakšpunktā minētajiem nodarījumiem, ja tas iespējams apdraud attiecīgā kuģa drošu kuģošanu.

5. Šo tekstu pievieno kā Konvencijas 3.bis pantu.

3.bis pants

1. Jebkura persona ir izdarījusi nodarījumu šīs Konvencijas nozīmē, ja šī persona nelikumīgi un tīši:

a) ja šīs darbības mērķis būtības vai apstākļu ziņā ir iebiedēt iedzīvotājus vai piespiest valdību vai starptautisku organizāciju veikt vai neveikt jebkādu darbību:

i) pret kuģi vai uz tā izmanto vai izvada no tā jebkādas sprādzienbīstamas, radioaktīvas vielas vai bioloģiskos, ķīmiskos un kodolieročus tādā veidā, kas izraisa vai var izraisīt nāvi vai nodarīt būtisku kaitējumu vai bojājumu, vai

ii) izvada no kuģa naftu, sašķidrinātu dabasgāzi vai citas bīstamas vai kaitīgas vielas, kas nav minētas i) apakšpunktā, tādā daudzumā vai koncentrācijā, kura izraisa vai var izraisīt nāvi vai nodarīt būtisku kaitējumu vai bojājumu, vai

iii) izmanto kuģi tādā veidā, kas izraisa nāvi vai nodara būtisku kaitējumu vai bojājumu, vai

iv) draud, atbilstoši tiesību aktiem – ar nosacījumu vai bez tā, izdarīt nodarījumu, kas minēts i), ii) vai iii) apakšpunktā, vai

b) uz kuģa transportē:

i) jebkādus sprādzienbīstamus vai radioaktīvus materiālus, apzinoties, ka tie tiks izmantoti, lai, atbilstoši valsts tiesību aktiem – ar nosacījumu vai bez tā, izraisītu vai draudētu izraisīt nāvi vai nodarīt būtisku kaitējumu, lai iebiedētu iedzīvotājus vai piespiestu valdību vai starptautisku organizāciju veikt vai neveikt jebkādu darbību, vai

ii) jebkādus bioloģiskus, ķīmiskus vai kodolieročus, apzinoties, ka tie ir bioloģiskie, ķīmiskie vai kodolieroči, kas definēti 1. pantā, vai

iii) jebkādus izejmateriālus, īpašos skaldmateriālus, iekārtas vai materiālus, kas īpaši paredzēti vai sagatavoti, lai tos pārstrādātu, izmantotu vai no tiem ražotu īpašos skaldmateriālus, apzinoties, ka tos paredzēts izmantot, lai sarīkotu tādu kodolsprādzienu vai darbību kodolenerģijas jomā, kuri neatbilst drošības kontrolei saskaņā ar IAEA vispārējo aizsardzības pasākumu nolīgumu, vai

iv) jebkādas iekārtas, materiālus vai programmatūru, vai ar tiem saistītu tehnoloģiju, kas būtiski veicina bioloģisko, ķīmisko un kodolieroču izstrādi, ražošanu vai nogādi, ar nodomu, ka tos izmantos šādam nolūkam.

2. Šīs konvencijas nozīmē par nodarījumu neuzskata 1. punkta b) apakšpunkta iii) punktā iekļauto priekšmetu vai materiālu transportēšanu vai, ciktāl tas saistīts ar kodolieročiem vai citām kodolsprādzienierīcēm, kas minētas 1. punkta b) apakšpunkta iv) punktā, ja šādus priekšmetus vai materiālus transportē no vai uz Līguma par kodolieroču neizplatīšanu dalībvalsts teritoriju vai ja transportēšanu kontrolē Līguma par kodolieroču neizplatīšanu dalībvalsts, ja:

a) priekšmeta vai materiāla nosūtīšana vai saņemšana, tostarp arī valsts iekšienē, nav pretrunā šīs dalībvalsts saistībām saskaņā ar Līgumu par kodolieroču neizplatīšanu un,

b) ja priekšmets vai materiāls ir paredzēts Līguma par kodolieroču neizplatīšanu dalībvalsts kodolieroča vai kodolsprādzienierīces nogādes sistēmai, šādu ieroču uzglabāšanai vai ja ierīce nav pretrunā minētās dalībvalsts saistībām saskaņā ar šo līgumu.

6. Šo tekstu pievieno kā Konvencijas 3.ter pantu.

3.ter pants

Jebkura persona ir izdarījusi nodarījumu šīs konvencijas nozīmē, ja šī persona nelikumīgi un tīši uz kuģa klāja transportē citu personu, apzinoties, ka šī persona ir izdarījusi darbību, kas ir nodarījums, kurš minēts 3., 3.bis vai 3.quater pantā, vai nodarījums, kas minēts kādā no pielikumā uzskaitītajiem līgumiem, un veic to nolūkā palīdzēt šai personai izvairīties no kriminālvajāšanas.

7. Šo tekstu pievieno kā Konvencijas 3.quater pantu.

3.quarter pants

Jebkura persona izdara nodarījumu šīs konvencijas nozīmē, ja šī persona:

a) nelikumīgi un tīši savaino vai nogalina jebkuru personu, lai izdarītu jebkuru no 3. panta 1. punktā, 3.bis pantā, vai 3.ter pantā minētajiem nodarījumiem, vai

b) mēģina izdarīt 3. panta 1. punktā, 3.bis panta 1. punkta a) apakšpunkta i), ii) vai iii) punktā vai šā panta a) apakšpunktā minēto nodarījumu, vai

c) ir līdzdalībnieks nodarījumā, kas minēts 3. pantā, 3.bis pantā, 3.ter pantā vai šā panta a) vai b) apakšpunktā, vai

d) organizē vai vada citas personas, lai tiktu izdarīts nodarījums, kas minēts 3. pantā, 3.bis pantā, 3.ter pantā vai šā panta a) vai b) apakšpunktā, vai

e) sekmē to, ka personu grupa, kas darbojas ar vienotu mērķi, ar nodomu izdara vienu vai vairākus nodarījumus, kuri minēti 3. pantā, 3.bis pantā, 3.ter pantā vai šā panta a) vai b) apakšpunktā:

i) ar nolūku turpināt noziedzīgu darbību vai grupas noziedzīgā mērķa izpildi, ja šīs darbības veikšanai vai mērķa izpildei ir jāizdara nodarījums, kas minēts 3. pantā, 3.bis pantā vai 3.ter pantā, vai

ii) apzinoties grupas nodomu izdarīt nodarījumu, kas minēts 3. pantā, 3.bis pantā vai 3.ter pantā.

5. pants

1. Konvencijas 5. pantu aizstāj ar šādu tekstu.

Katra dalībvalsts atzīst 3., 3.bis, 3.ter un 3.quater pantā minētos nodarījumus par sodāmiem, paredzot attiecīgus sodus atbilstoši šo nodarījumu smagumam.

2. Šo tekstu pievieno kā Konvencijas 5.bis pantu:

5.bis pants

1. Katra dalībvalsts atbilstoši tās tiesību principiem veic vajadzīgos pasākumus, lai tās teritorijā esošu vai saskaņā ar tās tiesību aktiem izveidotu juridisku personu varētu saukt pie atbildības, ja persona, kas ir atbildīga par šīs juridiskās personas vadību un kontroli, pildot amata pienākumus, ir izdarījusi nodarījumu, kurš minēts šajā konvencijā. Šo personu var saukt pie kriminālatbildības, civiltiesiskās vai administratīvās atbildības.

2. Šī atbildība nav atkarīga no to indivīdu kriminālatbildības, kas izdarījuši šos nodarījumus.

3. Katra dalībvalsts nodrošina, ka uz juridiskajām personām, kuras sauc pie atbildības saskaņā ar 1. pantu, attiecas spēkā esošas, proporcionālas un preventīvas kriminālsankcijas, civiltiesiskās vai administratīvās sankcijas. Šādas sankcijas var ietvert arī naudas sodus.

6. pants

1. Konvencijas 6. panta 1. punkta pamatdaļu aizstāj ar šādu tekstu.

1. Katra dalībvalsts veic vajadzīgos pasākumus, lai ieviestu savu jurisdikciju attiecībā uz nodarījumiem, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, ja šo nodarījumu izdara:

2. Konvencijas 6. panta 3. punktu aizstāj ar šādu tekstu.

3. Jebkura dalībvalsts, kas ieviesusi 2. punktā minēto jurisdikciju, ziņo par to ģenerālsekretāram. Ja šī dalībvalsts vēlāk šo jurisdikciju atceļ, tai par to jāziņo ģenerālsekretāram.

3. Konvencijas 6. panta 4. punktu aizstāj ar šādu tekstu:

4. Katra dalībvalsts veic vajadzīgos pasākumus, lai ieviestu savu jurisdikciju attiecībā uz nodarījumiem, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, tajos gadījumos, kad iespējamais likumpārkāpējs atrodas tās teritorijā, un neizdod iespējamo likumpārkāpēju jebkurai no dalībvalstīm, kura ieviesusi savu jurisdikciju saskaņā ar šā panta 1. un 2. punktu.

7. pants

Šo tekstu pievieno kā Konvencijas pielikumu.

PIELIKUMS

1. Konvencija par cīņu pret nelikumīgu gaisa kuģu sagrābšanu, pieņemta Hāgā 1970. gada 16. decembrī.

2. Konvencija par cīņu pret nelikumīgām darbībām, kas apdraud civilās aviācijas drošību, pieņemta Monreālā 1971. gada 23. septembrī.

3. Konvencija par noziegumu novēršanu pret personām, kas bauda starptautisko aizsardzību, arī pret diplomātiskajiem aģentiem, un sodīšanu par šādiem noziegumiem, pieņēmusi ANO Ģenerālā Asambleja 1973. gada 14. decembrī.

4. Starptautiskā konvencijā pret ķīlnieku sagrābšanu, pieņēmusi ANO Ģenerālā Asambleja 1979. gada 17. decembrī.

5. Konvencija par kodolvielu fizisko aizsardzību, pieņemta Vīnē 1979. gada 26. oktobrī.

6. Protokols par cīņu pret nelikumīgu vardarbību lidostās, kas apkalpo starptautisko civilo aviāciju, kurš pievienots Konvencijai par cīņu pret nelikumīgām darbībām, kas apdraud civilās aviācijas drošību, pieņemts Monreālā 1988. gada 24. februārī.

7. Protokols par prettiesisku darbību pret nostiprinātu platformu drošību kontinentālajā šelfā apkarošanu, pieņemts Romā 1988. gada 10. martā.

8. Starptautiskā konvencija par cīņu pret teroristu rīkotajiem sprādzieniem, pieņēmusi ANO Ģenerālā Asambleja 1997. gada 15. decembrī.

9. Starptautiskā konvencija par cīņu pret terorisma finansēšanu, pieņēmusi ANO Ģenerālā Asambleja 1999. gada 9. decembrī.

8. pants

1. Konvencijas 8. panta 1. punktu aizstāj ar šādu tekstu.

1. Dalībvalsts (“kuģa karoga valsts”) kuģa kapteinis jebkuras citas dalībvalsts (“saņēmējvalsts”) varas iestādēm var nodot jebkuru personu, ja kapteinis pamatoti uzskata, ka tā ir izdarījusi nodarījumu, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā.

2. Šo tekstu pievieno kā Konvencijas 8.bis pantu.

8.bis pants

1. Dalībvalstis sadarbojas visplašākajā iespējamā apjomā, lai saskaņā ar starptautiskajiem tiesību aktiem novērstu un apkarotu prettiesiskas darbības, uz kurām attiecas šī Konvencija, un cik drīz vien iespējams atbildētu uz pieprasījumiem saskaņā ar šo pantu.

2. Katrā pieprasījumā saskaņā ar šo pantu, ja iespējams, jānorāda aizdomās turētā kuģa nosaukums, kuģa SJO identifikācijas numurs, pieraksta osta, izcelsmes un galamērķa osta, kā arī jebkura cita būtiska informācija. Ja pieprasījumu izsaka mutiski, tad pieprasījuma iesniedzēja dalībvalsts, cik ātri vien iespējams, apstiprina pieprasījumu rakstiski. Pieprasījuma saņēmēja puse uzreiz apstiprina, ka saņēmusi rakstisku vai mutisku pieprasījumu.

3. Dalībvalstis ņem vērā apdraudējumu un grūtības, kas saistītas ar uzkāpšanu uz kuģa jūrā un pārmeklējot tā kravu, un apsver, vai citi atbilstoši pasākumi, par kuriem ir vienojušās iesaistītās valstis, ir drošāki un vai tos var veikt nākamajā piestāšanas ostā vai citur.

4. Dalībvalsts, kam ir pamatotas aizdomas, ka saistībā ar kuģi, kurš brauc zem tās karoga, ir izdarīts, tiek veikts vai tiks izdarīts nodarījums, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā, var lūgt palīdzību citai dalībvalstij šā nodarījuma novēršanā vai apkarošanā. Dalībvalstis, kam to lūdz, pieliek visus pūliņus, lai sniegtu šādu palīdzību, izmantojot tām pieejamos līdzekļus.

5. Ja dalībvalsts (“pieprasījuma iesniedzēja puse”) tiesībaizsardzības iestādes darbinieks vai cita pilnvarota amatpersona konstatē, ka kuģis brauc zem citas dalībvalsts karoga vai varētu būt reģistrēts citas dalībvalsts valstī (“pirmā puse”), atrodas jūrā jebkuras valsts teritoriālajos ūdeņos, un pieprasījuma iesniedzējai pusei ir pamatotas aizdomas, ka kuģis vai kāda persona uz šā kuģa bija, ir vai būs iesaistīta nodarījumā, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā, un pieprasījuma iesniedzēja puse vēlas uzkāpt uz šā kuģa:

a) tā atbilstoši 1. un 2. punktam lūdz, lai pirmā puse apstiprina valstspiederības prasību un,

b) ja valstspiederība ir apstiprināta, pieprasījuma iesniedzēja puse lūdz pirmajai pusei (turpmāk tekstā kuģa karoga valsts) atļauju uzkāpt uz kuģa un veikt atbilstošus pasākumus, kas saistīti ar kuģi, tostarp kuģa apturēšanu, uzkāpšanu uz kuģiem un kuģa, kravas un personu pārmeklēšanu, kā arī uz kuģa esošo personu iztaujāšanu, lai noteiktu, vai ir izdarīts, tiek veikts vai tiks izdarīts nodarījums, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā, un

c) kuģa karoga valsts:

i) atļauj pieprasījuma iesniedzējai pusei uzkāpt uz kuģa un veikt atbilstošus pasākumus, kas minēti 5. punkta b) apakšpunktā, un uz ko attiecas visi nosacījumi, kurus tā var piemērot saskaņā ar 7. punktu, vai

ii) norīko, lai uz kuģa uzkāpj un kuģa pārmeklēšanu veic tās tiesībaizsardzības iestādes darbinieki vai citas amatpersonas, vai

iii) uz kuģa uzkāpj un kuģa pārmeklēšanu veic kopā ar pieprasījuma iesniedzēju pusi, ņemot vērā jebkādus nosacījumus, kurus tā var piemērot saskaņā ar 7. punktu, vai

iv) neļauj uzkāpt uz kuģa un veikt tā pārmeklēšanu.

Pieprasījuma iesniedzēja puse nedrīkst kāpt uz kuģa klāja un veikt pasākumus, kas minēti 5. punkta b) apakšpunktā, ja tā nav saņēmusi kuģa karoga valsts atļauju.

d) pēc ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumenta deponēšanas dalībvalsts ziņo ģenerālsekretāram, ka attiecībā uz kuģiem, kas brauc zem tās karoga, vai kas uzstādījuši tās reģistrācijas zīmi, pieprasījuma iesniedzējai pusei ir dota atļauja uzkāpt uz kuģa klāja un pārmeklēt kuģi, tā kravu un personas, kā arī iztaujāt uz kuģa esošās personas, lai atrastu un pārbaudītu to valstspiederības dokumentus un noteiktu, vai ir izdarīts, tiek veikts vai tiks izdarīts nodarījums, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā, ja četru stundu laikā pirmā puse nav apstiprinājusi, ka tā ir saņēmusi pieprasījumu apstiprināt valstspiederību,

e) pēc ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumenta deponēšanas dalībvalsts ziņo ģenerālsekretāram, ka attiecībā uz kuģiem, kas brauc zem tās karoga, vai kas uzstādījuši tās reģistrācijas zīmi, pieprasījuma iesniedzējai pusei ir atļauts uzkāpt uz kuģa klāja un pārmeklēt kuģi, tā kravu un personas, kā arī iztaujāt uz kuģa klāja esošās personas, lai noteiktu, vai ir izdarīts, tiek veikts vai tiks izdarīts nodarījums, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā.

Paziņojumus, kas izteikti saskaņā ar šo punktu, var atsaukt jebkurā laikā.

6. Ja pēc uzkāpšanas uz kuģa, kas veikta saskaņā ar šo pantu, ir pierādīta rīcība, kura aprakstīta 3., 3.bis, 3.ter vai 3.quater pantā, kuģa karoga valsts var dot atļauju pieprasījuma iesniedzējai pusei aizturēt kuģi, kravu un uz kuģa klāja esošās personas līdz izvietošanas norādījumu saņemšanai no kuģa karoga valsts. Pieprasījuma iesniedzēja puse uzreiz sniedz informāciju kuģa karoga valstij par uzkāpšanas uz kuģa klāja, pārmeklēšanas un aizturēšanas, kas veikta saskaņā ar šo pantu, rezultātiem. Pieprasījuma iesniedzēja puse kuģa karoga valstij uzreiz sniedz arī informāciju par tādas pretlikumīgas rīcības pierādījumiem, kas nav minēta šajā Konvencijā.

7. Kuģa karoga valsts atbilstoši citiem šīs Konvencijas noteikumiem, sniedzot atļauju saskaņā ar 5. vai 6. pantu, var piemērot atsevišķus nosacījumus, tostarp iegūt papildu informāciju no pieprasījuma iesniedzējas puses, kā arī nosacījumus, kas saistīti ar atbildību par veicamajiem pasākumiem un šo pasākumu apmēru. Nedrīkst veikt papildu pasākumus, ja nav saņemta kuģa karoga valsts atļauja, izņemot, ja tie vajadzīgi, lai novērstu draudus cilvēku dzīvībai, vai ja šie pasākumi izriet no atbilstošiem divpusējiem vai daudzpusējiem nolīgumiem.

8. Saistībā ar uzkāpšanu uz kuģa, kas veikta saskaņā ar šo pantu, kuģa karoga valstij ir tiesības izmantot jurisdikciju pār aizturēto kuģi, kravu vai citiem priekšmetiem un personām, kuras atrodas uz kuģa, tostarp aizturēšanu, atsavināšanu, apcietināšanu un saukšanu pie atbildības. Taču kuģa karoga valsts atbilstoši tās konstitūcijai un tiesību aktiem var piekrist, ka jurisdikciju izmanto cita valsts, kurai ir jurisdikcija saskaņā ar 6. pantu.

9. Veicot atļautās darbības saskaņā ar šo pantu, jāizvairās no spēka pielietošanas, izņemot, ja tas vajadzīgs, lai garantētu uz kuģa klāja esošo amatpersonu un personu drošību, vai ja amatpersonām tiek liegts veikt atļautās darbības. Spēka izmantošana saskaņā ar šo pantu nedrīkst pārsniegt to minimālo pakāpi, kas vajadzīga un pieņemama attiecīgajos apstākļos.

10. Drošības pasākumi.

a) Ja dalībvalsts veic pasākumus pret kuģi atbilstoši šim pantam, tā:

i) pienācīgi ņem vērā vajadzību neapdraudēt cilvēku dzīvības drošību uz jūras,

ii) nodrošina, ka pret visām uz kuģiem esošām personām izturas respektējot cilvēka cieņu un atbilstoši piemērojamām starptautisko tiesību normām, tostarp starptautiskajām cilvēktiesībām,

iii) nodrošina, ka uzkāpšana uz kuģa un pārmeklēšana saskaņā ar šo pantu notiek atbilstoši piemērojamiem starptautisko tiesību aktiem,

iv) pienācīgi ņem vērā kuģa un tā kravas drošību un aizsardzību,

v) pienācīgi ņem vērā vajadzību ievērot kuģa karoga valsts saimnieciskās vai juridiskās intereses,

vi) atbilstoši tās rīcībā esošajiem līdzekļiem nodrošina, ka jebkurš pasākums, kas veikts saistībā ar kuģi vai tā kravu, attiecīgajos apstākļos ir videi nekaitīgs,

vii) nodrošina, ka uz kuģiem esošām personām, pret kurām var uzsākt tiesas procesus saistībā ar jebkādiem nodarījumiem, kas minēti 3., 3.bis, 3.ter vai 3.quater pantā, sniedz 10. panta 2. punktā minēto aizsardzību neatkarīgi no atrašanās vietas,

viii) nodrošina, ka kuģa kapteinis ir informēts par tās nodomu uzkāpt uz kuģa klāja, un viņam ir vai tiks dota iespēja sazināties ar kuģa īpašnieku un kuģa karoga valsti, cik vien drīz iespējams, un

ix) veic saprātīgi vajadzīgos pasākumus, lai kuģis netiktu nepamatoti aizturēts vai aizkavēts.

b) Ja kuģa karoga valsts dotā atļauja uzkāpt uz kuģa klāja per se nepalielina tās atbildību, dalībvalstis uzņemas atbildību par bojājumiem, kaitējumu vai zaudējumiem, kas radušies to pasākumu dēļ, kuri veikti atbilstoši šim pantam, ja:

i) šo pasākumu pamatojums izrādās nepietiekams, ar nosacījumu, ka kuģis nav izdarījis nevienu darbību, kas pamatotu veiktos pasākumus, vai

ii) šie pasākumi ir prettiesiski vai pārsniedz to, kas, ņemot vērā pieejamo informāciju, pamatoti vajadzīgs, lai īstenotu šā panta noteikumus.

Dalībvalstis sniedz tiesisku aizsardzību saistībā ar šādiem bojājumiem, kaitējumu vai zaudējumiem.

c) Ja dalībvalsts veic pasākumus pret kuģi atbilstoši šai Konvencijai, tā pienācīgi pārskata vajadzību neiejaukties vai neietekmēt:

i) piekrastes valstu tiesības un pienākumus, un jurisdikciju atbilstoši starptautiskajām jūras tiesībām vai

ii) kuģa karoga valsts pilnvaras īstenot jurisdikciju un kontrolēt administratīvos, tehniskos un sociālos jautājumus, kas saistīti ar kuģi.

d) Jebkuru saskaņā ar šo pantu veiktu pasākumu veic tiesībaizsardzības iestādes amatpersonas vai citas pilnvarotās amatpersonas no karakuģiem vai militārās aviācijas gaisa kuģiem, vai no citiem kuģiem vai gaisa kuģiem, kas ir skaidri marķēti, un ir nosakāms, ka tie ir valsts dienestā un ir pilnvaroti darboties, un šā panta noteikumi ir spēkā neatkarīgi no 2. un 2.bis panta.

e) Šajā pantā “tiesībaizsardzības iestādes amatpersonas vai citas pilnvarotas amatpersonas” ir tiesībaizsardzības iestāžu vai citu valsts iestāžu darbinieki, kas ir uniformēti vai noteikti atpazīstami citādā veidā. Lai sasniegtu tiesībaizsardzības mērķi saskaņā ar šo Konvenciju, tiesībaizsardzības iestādes amatpersonas vai citas pilnvarotās amatpersonas uzkāpjot uz kuģa klāja uzrāda tā kapteinim valdības izsniegtos identifikācijas dokumentus.

11. Šis pants neattiecas uz uzkāpšanu uz kuģa, kuru atbilstoši starptautiskajiem tiesību aktiem veic jebkura dalībvalsts, ja kuģis atrodas tās teritoriālajos ūdeņos, kā arī neierobežo uzkāpšanu uz tā, ieskaitot uzkāpšanu uz kuģa, pamatojoties uz apmeklējuma tiesībām, kā arī lai sniegtu palīdzību personām, kuģim vai īpašumam, kas atrodas briesmās vai ir apdraudēts, vai lai veiktu tiesībaizsardzības vai citas darbības, pamatojoties uz kuģa karoga valsts pilnvarojumu.

12. Dalībvalstis tiek mudinātas izveidot standartizētas operatīvās procedūras kopīgām darbībām, ko veic atbilstoši šim pantam, un attiecīgā gadījumā konsultēties ar citām dalībvalstīm pusēm, lai saskaņotu šādas standartizētas operatīvās procedūras.

13. Lai sekmētu tiesībaizsardzības operācijas, ko veic saskaņā ar šo pantu, dalībvalstis var noslēgt nolīgumus vai vienošanās.

14. Katra dalībvalsts veic attiecīgus pasākumus, lai nodrošinātu, ka tiesībaizsardzības iestāžu amatpersonas vai citas pilnvarotās amatpersonas, kā arī citu dalībvalstu pušu tiesībaizsardzības iestāžu amatpersonas vai citas pilnvarotās amatpersonas, kas darbojas viņu vārdā, ir pilnvarotas veikt darbībās atbilstoši šim pantam.

15. Pēc ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumenta deponēšanas katra dalībvalsts nosaka iestādi vai, ja vajadzīgs, iestādes, kas saņems un atbildēs uz palīdzības pieprasījumiem, apstiprinās valstspiederību, kā arī sniegs pilnvarojumu veikt attiecīgus pasākumus. Informāciju par šo noteikšanu, tostarp kontaktinformāciju, viena mēneša laikā kopš kļūšanas par dalībvalsti pusi nosūta ģenerālsekretāram, kas viena mēneša laikā pēc šīs noteikšanas šo informāciju nosūta visām pārējām dalībvalstīm pusēm. Katra dalībvalsts uzreiz informē ģenerālsekretāru, ja tiek noteikta cita iestāde vai mainās šīs iestādes kontakinformācija.

9. pants

10. panta 2. punktu aizstāj ar šādu tekstu.

2. Jebkurai personai, ko aiztur vai kam piemēro jebkādus citus pasākumus vai pret ko uzsāk tiesas procesu atbilstoši šai konvencijai, nodrošina taisnīgu attieksmi, tostarp visas tiesības un garantijas atbilstoši tās valsts tiesību aktiem, kuras teritorijā šī persona atrodas, un starptautisko tiesību normām, tostarp starptautiskajām cilvēktiesībām.

10. pants

1. 11. panta 1., 2., 3. un 4. punktu aizvieto ar šādu tekstu.

1. Nodarījumus, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, uzskata par iekļautiem visos starp dalībvalstīm pusēm noslēgtajos līgumos par izdošanu kā pārkāpumus, kuru dēļ var piemērot izdošanu. Dalībvalstis apņemas šādus nodarījumus iekļaut katrā starp tām noslēgtā līgumā par izdošanu kā pārkāpumus, kuru dēļ var piemērot izdošanu.

2. Ja dalībvalsts, kas veic izdošanu ar nosacījumu, ka ir noslēgts līgums par izdošanu, saņem pieprasījumu veikt izdošanu no citas dalībvalsts, ar kuru tai nav noslēgts līgums par izdošanu, pieprasījuma saņēmēja puse saistībā ar nodarījumiem, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, var uzskatīt šo konvenciju par juridisku pamatu izdošanai. Izdošanai piemēro citus nosacījumus, kas paredzēti pieprasījuma saņēmējas dalībvalsts tiesību aktos.

3. Dalībvalstis, kurās izdošana nav atkarīga no noslēgta līguma par izdošanu, savstarpēji atzīst nodarījumus, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, par nodarījumiem, kuru dēļ var piemērot izdošanu, un izdošanai piemēro nosacījumus, kas paredzēti pieprasījuma saņēmējas dalībvalsts tiesību aktos.

4. Izdošanas nolūkā starp dalībvalstīm pusēm vajadzības gadījumā nodarījumus, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, var uzskatīt par izdarītiem ne tikai tajā vietā, kur tie izdarīti, bet arī vietā, kas atrodas tās dalībvalsts jurisdikcijā, kura lūdz veikt izdošanu.

2. Šo tekstu pievieno kā Konvencijas 11.bis pantu.

11.bis pants

Izdošanas vai savstarpējās juridiskās palīdzības nolūkā nevienu no nodarījumiem, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā, neuzskata par politisku noziegumu vai nodarījumu, kas saistīts ar politisku noziegumu, vai nodarījumu, kas izdarīts politisku motīvu dēļ. Tādējādi izdošanas vai savstarpējās juridiskās palīdzības pieprasījumu, kas pamatots ar šādu nodarījumu, nevar atteikt, pamatojot tikai ar to, ka tas ir politisks noziegumus vai nodarījums, kurš saistīts ar politisku noziegumu, vai nodarījums, kas izdarīts politisku motīvu dēļ.

3. Šo tekstu pievieno kā Konvencijas 11.ter pantu.

11.ter pants

Šo Konvenciju neinterpretē tādā nozīmē, lai izdošana vai savstarpējās juridiskās palīdzības sniegšana tiktu uzlikta par pienākumu, ja pieprasījuma saņēmējai dalībvalstij ir pamats uzskatīt, ka izdošanas pieprasījums par nodarījumiem, kuri minēti 3., 3.bis, 3.ter vai 3.quater pantā, vai par savstarpējo juridisko palīdzību saistībā ar šādu noziegumu iesniegts, lai personu apsūdzētu vai sodītu šīs personas rases, reliģiskās pārliecības, valstspiederības, etniskās izcelsmes, politisko uzskatu vai dzimuma dēļ, vai ja šā pieprasījuma apmierināšana var kaitēt šīs personas stāvoklim jebkura minētā iemesla dēļ.

11. pants

1. Konvencijas 12. panta 1. punktu aizstāj ar šādu tekstu.

1. Dalībvalstis savstarpēji sniedz lielāko iespējamo palīdzību saistībā ar kriminālprocesiem, kas uzsākti saistībā ar nodarījumiem, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, ieskaitot palīdzību šo valstu rīcībā esošo pierādījumu iegūšanai, kas vajadzīgi tiesas procesos.

2. Šo tekstu pievieno kā Konvencijas 12.bis pantu.

12.bis pants

1. Personu, kura aizturēta vai izcieš sodu vienas dalībvalsts teritorijā un kuras klātbūtne vajadzīga citā dalībvalstī, lai veiktu identificēšanu, sniegtu liecību vai citādā veidā sekmētu pierādījumu iegūšanu izmeklēšanā vai kriminālvajāšanā par nodarījumiem, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, var pārvietot, ja ir izpildīti šādi nosacījumi:

a) attiecīgā persona dod apzinātu piekrišanu un

b) abu valstu kompetentās iestādes ir vienojušās, ņemot vērā nosacījumus, ko šīs valstis uzskata par atbilstošiem.

2. Šajā pantā:

a) valstij, uz kuru persona tiek pārvietota, ir pilnvaras un pienākums turēt pārvietoto personu apcietinājumā, ja vien valsts, no kuras persona tika pārvietota, nelūdz vai neliek rīkoties citādi,

b) valstij, uz kuru persona tiek pārvietota, uzreiz jāpilda savs pienākums nogādāt personu atpakaļ apcietinājumā valstī, no kuras persona tika pārvietota, ievērojot iepriekš noslēgto vienošanos vai citu vienošanos, ko noslēgušas abu valstu kompetentās iestādes,

c) valsts, uz kuru persona tiek pārvietota, nedrīkst pieprasīt valstij, no kuras persona pārvietota, uzsākt izdošanas procedūru par šīs personas nogādāšanu atpakaļ,

d) pārvietotās personas izciešamo sodu, ko tā izcieš valstī, no kuras tā tika pārvietota, samazina par tik ilgu laiku, cik ilgi persona pavadījusi apcietinājumā valstī, uz kuru tā tika pārvietota.

3. Ja vien dalībvalsts, no kuras personu jāpārvieto saskaņā ar šo pantu, neiebilst, tad šo personu, neatkarīgi no tās valstspiederības, valsts teritorijā, uz kuru tā tiks pārvietota, neapsūdz vai neaiztur, vai neierobežo tās brīvību saistībā ar darbībām un notiesāšanām, kas notikušas pirms šīs personas aizbraukšanas no tās valsts teritorijas, no kuras tā tika pārvietota.

12. pants

Konvencijas 13. pantu aizstāj ar šādu tekstu.

1. Dalībvalstis sadarbojas, lai novērstu nodarījumus, kas minēti 3., 3.bis, 3.ter un 3.quater pantā, jo īpaši:

a) veicot praktiskus pasākumus, lai attiecīgo valstu teritorijās novērstu gatavošanos minēto nodarījumu izdarīšanai šo valstu teritorijās vai ārpus tām,

b) apmainoties ar informāciju atbilstoši saviem tiesību aktiem un saskaņojot administratīvos un citus pasākumus, ko atbilstoši veic, lai novērstu to nodarījumu izdarīšanu, kas minēti 3., 3.bis, 3.ter un 3.quater pantā.

2. Ja tāda nodarījuma izdarīšanas dēļ, kas minēts 3., 3.bis, 3.ter vai 3.quater pantā, ir aizkavēta vai pārtraukta kuģa pārvietošanās, jebkura dalībvalsts, kuras teritorijā atrodas kuģa, pasažieri vai apkalpe, veic visu iespējamo, lai novērstu kuģa, tā pasažieru, apkalpes vai kravas nepamatotu aizturēšanu vai aizkavēšanu.

13. pants

Konvencijas 14. pantu aizstāj ar šādu tekstu.

Jebkura dalībvalsts, kam ir pamats uzskatīt, ka tiks izdarīts nodarījums, kurš minēts 3., 3.bis, 3.ter vai 3.quater pantā, saskaņā ar valsts tiesību aktiem, cik ātri vien iespējams, sniedz tās rīcībā esošo attiecīgo informāciju tām valstīm, kam pēc tās ieskatiem varētu būt jurisdikcija saskaņā ar 6. pantu.

14. pants

Konvencijas 15. panta 3. punktu aizstāj ar šādu tekstu.

3. Saskaņā ar 1. un 2. punktu sniegto informāciju ģenerālsekretārs nosūta visām dalībvalstīm pusēm, organizācijas locekļiem un citām iesaistītajām valstīm, kā arī attiecīgajām starptautiskajām starpvaldību organizācijām.

15. pants

Interpretācija un piemērošana

1. Konvenciju un šo protokolu attiecībās starp šā protokola pusēm uzskata un interpretē kā vienotu dokumentu.

2. Konvencijas 1.-16. pantu, kas grozīti ar šo protokolu, kopā ar šā protokola 17.-24. pantu un pievienoto pielikumu uzskata un sauc par 2005. gada Konvenciju par prettiesisku darbību pret kuģošanas drošību apkarošanu (2005. gada SUA konvencija).

16. pants

Šo tekstu pievieno kā Konvencijas 16.bis pantu.

2005. gada Konvencijas par prettiesisku darbību pret kuģošanas drošību apkarošanu nobeiguma noteikumi ir 1988. gada Konvencijas par prettiesisku darbību pret kuģošanas drošību apkarošanu 2005. gada protokola 17.-24. pants. Atsauces uz dalībvalstīm pusēm, kas minētās šajā Konvencijā, uzskata par atsaucēm uz 2005. gada protokola dalībvalstīm pusēm.

NOBEIGUMA NOTEIKUMI

17. pants

Parakstīšana, ratifikācija, pieņemšana, apstiprināšana un pievienošanās

1. Šo protokolu var parakstīt organizācijas galvenajā mītnē no 2006. gada 14. februāra līdz 2007. gada 13. februārim, un pēc tam var pievienoties tam.

2. Valstis var izteikt savu piekrišanu, uzņemoties saistības saskaņā ar šo protokolu:

a) parakstot to bez atrunām attiecībā uz ratifikāciju, pieņemšanu vai apstiprināšanu vai

b) ar parakstīšanu, kas jāratificē, jāpieņem vai jāapstiprina un kam seko tā ratifikācija, pieņemšana vai apstiprināšana, vai

c) ar pievienošanos.

3. Ratificēšana, pieņemšana, apstiprināšana vai pievienošanās notiek, deponējot attiecīgo dokumentu ģenerālsekretāram.

4. Par šā protokola pusi var kļūt tikai valsts, kas parakstījusi konvenciju bez atrunām attiecībā uz ratifikāciju, pieņemšanu vai apstiprināšanu, vai ratificējusi, pieņēmusi, apstiprinājusi konvenciju vai pievienojusies tai.

18. pants

Stāšanās spēkā

1. Šis protokols stājas spēkā dienā, kad ir pagājušas deviņdesmit dienas no datuma, kurā divpadsmit valstis to parakstījušas bez atrunām attiecībā uz ratifikāciju, pieņemšanu vai apstiprināšanu vai deponējušas ģenerālsekretāram ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumentu.

2. Valstij, kas deponē ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumentu attiecībā uz šo protokolu pēc tam, kad ir izpildīti 1. punkta nosacījumi par stāšanos spēkā, ratifikācija, pieņemšana, apstiprināšana vai pievienošanās stājas spēkā dienā, kad ir pagājušas deviņdesmit dienas kopš šādas deponēšanas datuma.

19. pants

Denonsēšana

1. Jebkura protokola dalībvalsts var denonsēt šo protokolu jebkurā laikā pēc šā protokola stāšanās spēkā šajā valstī.

2. Denonsēšana notiek, deponējot denonsēšanas dokumentu ģenerālsekretāram.

3. Denonsēšana stājas spēkā pēc viena gada skaitot no datuma, kurā ģenerālsekretārs saņēmis denonsēšanas dokumentu, vai pēc ilgāka laika, kas var būt noteikts denonsēšanas dokumentā.

20. pants

Pārskatīšana un grozījumi

1. Organizācija var sasaukt konferenci, lai pārskatītu vai grozītu šo Protokolu.

2. Ģenerālsekretārs sasauc šā protokola dalībvalstu pušu konferenci, lai pārskatītu vai grozītu šo protokolu, ja to lūdz viena trešdaļa dalībvalstu pušu vai desmit protokola dalībvalstis, atkarībā no tā, kurš skaitlis lielāks.

3. Jebkurš ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokuments, kas deponēts pēc datuma, kurā stājas spēkā šā protokola grozījumi, attiecas uz grozīto protokolu.

21. pants

Deklarācijas

1. Deponējot ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumentu, dalībvalsts, kas nav pievienojusies kādam no pielikumā uzskaitītajiem līgumiem, var paziņot, ka, piemērojot šo Protokolu šai dalībvalstij, šo līgumu neuzskata par iekļautu 3.ter pantā. Šī deklarācija vairs nav spēkā tiklīdz šis līgums stājas spēkā attiecībā uz šo dalībvalsti, kas par to ziņo ģenerālsekretāram.

2. Ja kāds no pielikumā uzskaitītajiem līgumiem kādai dalībvalstij vairs nav saistošs, tā saistībā ar šo līgumu var izteikt deklarāciju, kā norādīts šajā pantā.

3. Pēc ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumenta deponēšanas dalībvalsts var deklarēt, ka tā piemēros 3.ter panta noteikumus saskaņā ar tās krimināltiesību principiem attiecībā uz ģimenes atbrīvojumiem no atbildības.

22. pants

Pielikuma grozīšana

1. Pielikumu var grozīt, pievienojot attiecīgus līgumus, ja:

a) tajos var piedalīties visas valstis,

b) tie ir stājušies spēkā un

c) tos ir ratificējušas, pieņēmušas, apstiprinājušas vai tam pievienojušās vismaz divpadsmit šā protokola dalībvalstis.

2. Pēc šā protokola stāšanās spēkā jebkura dalībvalsts var piedāvāt veikt grozījumus pielikumā. Jebkuru piedāvājumu par grozījumiem rakstveidā nosūta ģenerālsekretāram. Ģenerālsekretārs izsūta jebkuru grozījuma piedāvājumu visiem organizācijas locekļiem, ja tas atbilst 1. punkta prasībām, un gaida šā protokola dalībvalstu pušu piekrišanu, lai pieņemtu piedāvātos grozījumus.

3. Piedāvāto pielikuma grozījumu uzskata par pieņemtu pēc tam, kad divpadsmit šā protokola dalībvalstis ģenerālsekretāram nosūtījušas rakstiskus paziņojumus, ka tam piekrīt.

4. Pieņemtais pielikuma grozījums stājas spēkā pēc trīsdesmit dienām skaitot no datuma, kurā ģenerālsekretāram deponēts šā grozījuma ratifikācijas, pieņemšanas vai apstiprināšanas dokuuments, un tas attiecas uz tām šā protokola dalībvalstīm pusēm, kas deponējušas minēto dokumentu. Katrai šā protokola dalībvalstij, kas grozījumu ratificē, pieņem vai apstiprina pēc divpadsmitā dokumenta deponēšanas ģenerālsekretāram, šis grozījums stājas spēkā pēc trīsdesmit dienām skaitot no datuma, kurā šī dalībvalsts deponējusi savu ratifikācijas, pieņemšanas vai apstiprināšanas dokumentu.

23. pants

Depozitārijs

1. Šo protokolu un jebkuru saskaņā ar 20. un 22. pantu pieņemtu grozījumu deponē ģenerālsekretāram.

2. Ģenerālsekretārs:

a) informē visas valstis, kas parakstījušas šo protokolu vai tam pievienojušās, par:

i) katru jaunu ratificēšanas, pieņemšanas, apstiprināšanas vai pievienošanās dokumenta parakstīšanu vai deponēšanu un attiecīgo datumu,

ii) šā protokola spēkā stāšanās datumu,

iii) par jebkura šā protokola denonsēšanas dokumenta deponēšanu, kā arī datumu, kad tas saņemts, un datumu, kad denonsēšana stājas spēkā,

iv) jebkuru paziņojumu, kas veikts pamatojoties uz jebkuru šā protokola pantu,

v) jebkuru priekšlikumu grozīt pielikumu, kas izteikts saskaņā ar 22. panta 2. punktu,

vi) jebkuru grozījumu, ko uzskata par pieņemtu saskaņā ar 22. panta 3. punktu,

vii) jebkuru grozījumu, kas ratificēts, pieņemts vai apstiprināts saskaņā ar 22. panta 4. punktu, kā arī par datumu, kurā šis grozījums stāsies spēkā, un

b) nosūta šā protokola apstiprinātas kopijas visām valstīm, kas parakstījušas šo Protokolu vai pievienojušās tam.

3. Uzreiz pēc šā protokolā stāšanās spēkā ģenerālsekretārs nosūta šā teksta apstiprinātu kopiju Apvienoto Nāciju Organizācijas ģenerālsekretāram reģistrēšanai un publicēšanai saskaņā ar Apvienoto Nāciju Organizācijas Statūtu 102. pantu.

24. pants

Valodas

Šis protokols izstrādāts vienā eksemplārā angļu, arābu, franču, krievu, ķīniešu, un spāņu valodā, un visi teksti ir vienlīdz autentiski.

Londonā, divi tūkstoši piektā gada četrpadsmitajā oktobrī.

Šā protokola dalībvalstis,

būdamas puses Protokolam par tādu nelikumīgu darbību novēršanu, kas vērstas pret stacionāru platformu uz kontinentālā šelfa drošību, kurš pieņemts Romā, 1988. gada 10. martā,

atzīstot, ka iemesli, kuru dēļ izstrādāja 2005. gada protokolu pie Konvencijas par tādu nelikumīgu darbību novēršanu, kas vērstas pret jūras navigācijas drošību, attiecas arī uz stacionārām platformām, kuras atrodas kontinentālajā šelfā,

ņemot vērā šo protokolu noteikumus,

ir vienojušās par turpmāko.

1. PANTS

Šajā protokolā:

1. “1988. gada protokols” ir Protokols par tādu nelikumīgu darbību novēršanu, kas vērstas pret stacionāru platformu uz kontinentālā šelfa drošību, kurš pieņemts Romā, 1988. gada 10. martā,

2. “Organizācija” ir Starptautiskā jūrniecības organizācija un

3. “Ģenerālsekretārs” ir Organizācijas ģenerālsekretārs.

2. PANTS

1988. gada protokola 1. panta 1. punktu aizstāj ar šādu tekstu.

1. Konvencijas par tādu nelikumīgu darbību novēršanu, kas vērstas pret jūras navigācijas drošību, kura grozīta ar 2005. gada protokolu pie Konvencijas par tādu nelikumīgu darbību, kas vērstas pret jūras navigācijas drošību, novēršanu, 1. panta 1. punkta c), d), e), f), g), h) apakšpunkta un 2. punkta a) apakšpunkta, 2.bis, 5., 5.bis, un 7. panta, kā arī 10.-16. panta, ieskaitot 11.bis, 11.ter un 12.bis pantu, noteikumi mutatis mutandis attiecas arī uz nodarījumiem, kas minēti šā protokola 2., 2.bis un 2.ter pantā, ja šie nodarījumi izdarīti uz kontinentālajā šelfā esoša kuģa vai pret tajā esošām stacionārām platformām.

3. PANTS

1. 1988. gada protokola 2. panta 1. punkta d) apakšpunktu aizstāj ar šādu tekstu:

d) ar jebkādiem līdzekļiem novieto vai sekmē to, ka uz stacionāras platformas tiek novietota ierīce vai viela, kas var iznīcināt šo stacionāro platformu vai apdraudēt tās drošību.

2. 1988. gada protokolā svītro 2. panta 1. punkta e) apakšpunktu.

3. 1988. gada protokola 2. panta 2. punktu aizstāj ar šādu tekstu.

2. Jebkura persona izdara nodarījumu, ja šī persona rada draudus atbilstoši valsts tiesību aktiem, ar nosacījumu vai bez nosacījuma, ka šo draudu mērķis ir piespiest fizisku vai juridisku personu veikt vai neveikt jebkādu darbību, lai izdarītu jebkuru no 1. punkta b) un c) apakšpunktā minētajiem nodarījumiem, ja tie apdraud stacionārās platformas drošību.

4. PANTS

1. Šo tekstu iekļauj kā 2.bis pantu.

2.bis pants

Jebkura persona izdara nodarījumu šā protokola nozīmē, ja šī persona nelikumīgi un tīši – ja šīs darbības nolūks, rakstura vai konteksta ziņā, ir iebiedēt iedzīvotājus vai piespiest valdību vai starptautisku organizāciju veikt vai neveikt jebkādu darbību:

a) izmanto pret stacionāru platformu vai izvada no tās jebkādas sprādzienbīstamas, radioaktīvas vielas vai bioloģiskos, ķīmiskos vai kodolieročus tādā veidā, kas izraisa vai var izraisīt nāvi vai smagus miesas bojājumus, vai kaitējumu, vai

b) izvada no stacionāras platformas naftu, sašķidrinātu dabasgāzi vai citas bīstamas vai kaitīgas vielas, kuras nav minētas a) apakšpunktā, tādā daudzumā vai koncentrācijā, kas izraisa vai var izraisīt nāvi vai smagus miesas bojājumus, vai kaitējumu, vai

c) draud – atbilstoši valsts tiesību aktiem, ar nosacījumu vai bez tā, – izdarīt kādu no a) vai b) apakšpunktā minētajiem nodarījumiem.

2. Šo tekstu iekļauj kā 2.ter pantu.

2.ter pants

Jebkura persona izdara nodarījumu šā protokola nozīmē, ja šī persona:

a) nelikumīgi un tīši savaino vai nogalina jebkuru personu, lai izdarītu jebkuru no 2. panta 1. punktā vai 2.bis pantā minētajiem nodarījumiem,vai

b) mēģina izdarīt nodarījumu, kas minēts 2. panta 1. punktā, 2.bis panta 1. vai 2. punktā vai šā panta a) apakšpunktā,vai

c) ir līdzdalībnieks nodarījumā, kas minēts 2. pantā, 2.bis pantā vai šā panta a) vai b) apakšpunktā,vai

d) organizē vai vada citas personas, lai tiktu izdarīts nodarījums, kas minēts 2. pantā, 2.bis pantā vai šā panta a) vai b) apakšpunktā, vai

e) sekmē to, ka personu grupa, kas darbojas ar vienotu nolūku, ar nodomu izdara vienu vai vairākus nodarījumus, kas minēti 2. pantā, 2.bis pantā vai šā panta a) vai b) apakšpunktā:

i) ar nolūku sekmēt šīs grupas noziedzīgu darbību vai grupas noziedzīgus nolūkus, ja šīs darbība vai nolūks saistīts ar 2. vai 2.bis pantā minētā nodarījuma izdarīšanu, vai

ii) apzinoties grupas nodomu izdarīt 2. vai 2.bis pantā minēto nodarījumu.

5. PANTS

1. 1988. gada protokola 3. panta 1. punktu aizstāj ar šādu tekstu.

1. Katra dalībvalsts veic vajadzīgos pasākumus, lai ieviestu savu jurisdikciju attiecībā uz nodarījumiem, kas minēti 2., 2.bis un 2.ter pantā, ja šo nodarījumu izdara:

a) pret stacionāru platformu vai uz tās tajā laikā, kad tā atrodas šīs valsts kontinentālajā šelfā, vai

b) šīs valsts piederīgais.

2. 1988. gada protokola 3. panta 3. punktu aizstāj ar šādu tekstu.

3. Jebkura dalībvalsts, kas ieviesusi 2. punktā minēto jurisdikciju, ziņo par to Ģenerālsekretāram. Ja šī dalībvalsts vēlāk atceļ šo jurisdikciju, šī dalībvalsts par to paziņo Ģenerālsekretāram.

3. 1988. gada protokola 3. panta 4. punktu aizstāj ar šādu tekstu.

4. Katra dalībvalsts veic vajadzīgos pasākumus, lai ieviestu savu jurisdikciju attiecībā uz nodarījumiem, kas minēti 2., 2.bis un 2.ter pantā, tajos gadījumos, kad iespējamais likumpārkāpējs atrodas tās teritorijā, un šī dalībvalsts neizdod šo iespējamo likumpārkāpēju jebkurai no dalībvalstīm, kura ieviesusi savu jurisdikciju saskaņā ar 1. un 2. punktu.

6. PANTS

Interpretācija un piemērošana

1. 1988. gada protokolu un šo protokolu attiecībās starp šā protokola dalībvalstīm uzskata un interpretē kā vienotu dokumentu.

2. 1988. gada protokola 1.-4. pantu, kas grozīti ar šo protokolu, kopā šā protokola 8.-13. pantu uzskata un sauc par 2005. gada Protokolu par tādu nelikumīgu darbību novēršanu, kas vērstas pret kontinentālajā šelfā esošu stacionāru platformu drošību (2005. gada SUA stacionāro platformu protokols).

7. PANTS

Šo tekstu pievieno kā protokola 4.bis pantu.

NOBEIGUMA NOTEIKUMI

8. PANTS

Parakstīšana, ratifikācija, pieņemšana, apstiprināšana un pievienošanās

1. Šo protokolu var parakstīt Organizācijas galvenajā mītnē no 2006. gada 14. februāra līdz 2007. gada 13. februārim, un pēc šā datuma tam joprojām var pievienoties.

2. Valstis var izteikt savu piekrišanu uzņemties saistības saskaņā ar šo protokolu:

3. Ratifikācija, pieņemšana, apstiprināšana vai pievienošanās notiek, deponējot attiecīgo dokumentu pie Ģenerālsekretāra.

4. Par šā protokola dalībvalsti var kļūt tikai valsts, kas ir vai nu parakstījusi 1988. gada protokolu bez atrunām par ratifikāciju, pieņemšanu vai apstiprināšanu, vai ratificējusi, pieņēmusi, apstiprinājusi vai pievienojusies 1988. gada protokolam.

9. PANTS

Stāšanās spēkā

1. Šis protokols stājas spēkā dienā, kad pagājušas deviņdesmit dienas kopš datuma, kurā trīs valstis to parakstījušas bez atrunām par ratifikāciju, pieņemšanu vai apstiprināšanu vai deponējušas Ģenerālsekretāram ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumentu. Taču šis protokols nestājas spēkā pirms nav stājies spēkā 2005. gada protokols pie Konvencijas par nelikumīgu darbību, kas vērstas pret jūras navigācijas drošību, novēršanu.

2. Valstij, kas deponē ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumentu attiecībā uz šo protokolu pēc tam, kad ir izpildīti 1. punkta nosacījumi par stāšanos spēkā, ratifikācija, pieņemšana, apstiprināšana vai pievienošanās stājas spēkā dienā, kad ir pagājušas deviņdesmit dienas kopš šādas deponēšanas datuma.

10. PANTS

Denonsēšana

1. Jebkura protokola dalībvalsts var denonsēt šo protokolu jebkurā laikā pēc datuma, kurā tas stājas spēkā šajā valstī.

2. Denonsēšana notiek, deponējot denonsēšanas dokumentu Ģenerālsekretāram.

3. Denonsēšana stājas spēkā vienu gadu pēc datuma, kurā Ģenerālsekretārs saņēmis denonsēšanas dokumentu, vai pēc ilgāka laika, kas var būt precizēts denonsēšanas dokumentā.

11. PANTS

Pārskatīšana un grozījumi

1. Organizācija var sasaukt konferenci, lai pārskatītu vai grozītu šo protokolu.

2. Ģenerālsekretārs sasauc šā protokola dalībvalstu konferenci, lai pārskatītu vai grozītu šo protokolu, ja to lūdz viena trešdaļa dalībvalstu vai piecas protokola dalībvalstis, neatkarīgi no tā, kurš skaitlis ir lielāks.

3. Uz grozīto protokolu attiecas jebkurš ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokuments, kas deponēts pēc datuma, kurā stājas spēkā šā protokola grozījumi.

12. PANTS

Depozitārs

1. Šo protokolu un jebkuru saskaņā ar 11. pantu pieņemtu grozījumu deponē Ģenerālsekretāram.

2. Ģenerālsekretārs:

a) informē visas valstis, kas parakstījušas šo protokolu vai pievienojušās tam, par:

i) katru jauna ratifikācijas, pieņemšanas, apstiprināšanas vai pievienošanās dokumenta parakstīšanu vai deponēšanu un tās datumu,

ii) šā protokola spēkā stāšanās datumu,

iii) jebkura šā protokola denonsēšanas dokumenta deponēšanu, kā arī datumu, kad tas saņemts, un datumu, kad denonsēšana stājas spēkā,

iv) jebkuru paziņojumu, kas vajadzīgs atbilstoši kādam šā protokola pantam, un

b) nosūta šā protokola apstiprinātas kopijas visām valstīm, kas parakstījušas šo protokolu vai pievienojušās tam.

3. Tiklīdz šis protokols stājas spēkā, Ģenerālsekretārs nosūta šā teksta apstiprinātu kopiju Apvienoto Nāciju Organizācijas ģenerālsekretāram reģistrēšanai un publicēšanai atbilstoši Apvienoto Nāciju Organizācijas Statūtu 102. pantam.

Šis protokols sastādīts vienā eksemplārā angļu, arābu, franču, krievu, ķīniešu un spāņu valodā, un visi teksti ir vienlīdz autentiski.

Londonā, divi tūkstoši piektā gada četrpadsmitajā oktobrī.
