prezidents izsludina šādu likumu:
Par Latvijas Republikas valdības un Izraēlas Valsts valdības līgumu par savstarpēju palīdzību muitas lietās
1.pants. 2001.gada 6.decembrī Rīgā parakstītais Latvijas Republikas valdības un Izraēlas Valsts valdības līgums par savstarpēju palīdzību muitas lietās (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.
2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Līgums latviešu un angļu valodā.
3.pants. Līgums stājas spēkā tā 15.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to informē laikrakstā "Latvijas Vēstnesis".
Likums Saeimā pieņemts 2002.gada 20.jūnijā.

LATVIJAS REPUBLIKAS VALDĪBAS UN IZRAĒLAS VALSTS VALDĪBAS LĪGUMS PAR SAVSTARPĒJU PALĪDZĪBU MUITAS LIETĀS

LATVIJAS REPUBLIKAS VALDĪBA UN IZRAĒLAS VALSTS VALDĪBA, (turpmāk "Puses");

ŅEMOT VĒRĀ, ka normatīvo aktu muitas lietās pārkāpumi nodara kaitējumu abu valstu ekonomiskajām, nodokļu un tirdzniecības interesēm;

ŅEMOT VĒRĀ muitas nodokļu un citu nodokļu precīzas uzlikšanas nodrošināšanas par preču importu un eksportu, šādu preču klasifikācijas, vērtības un izcelsmes pareizu noteikšanas, kā arī aizliegumu, ierobežojumu un kontroles noteikumu pareizas piemērošanas svarīgumu;

ŅEMOT VĒRĀ, ka narkotiku un psihotropo vielu nelikumīga pārvietošana rada draudus cilvēku veselībai un visai sabiedrībai;

ATZĪSTOT starptautiskās sadarbības nepieciešamību jautājumos, kas saistīti ar abu valstu normatīvo aktu muitas lietās piemērošanu un izpildīšanu;

BŪDAMAS PĀRLIECINĀTAS, ka pasākumus normatīvo aktu muitas lietās pārkāpumu novēršanai varētu padarīt efektīvākus, īstenojot abu valstu muitas administrāciju ciešu sadarbību;

ATSAUCOTIES uz Muitas Sadarbības padomes 1953.gada 5.decembra Rekomendācijām par savstarpējo administratīvo palīdzību;

ATSAUCOTIES arī uz Ņujorkas 1961.gada 30.marta Vienotās konvencijas par narkotiskajām vielām, Vīnes 1971.gada 21.februāra Konvencijas par psihotropajām vielām, kas sagatavota Apvienoto Nāciju Organizācijas uzraudzībā, noteikumiem;

ŅEMOT VĒRĀ Apvienoto Nāciju Organizācijas 1988.gada 19.decembra Vīnes Konvenciju pret narkotiku un psihotropo vielu nelegālu apgrozījumu,

IR VIENOJUŠĀS PAR TURPMĀK MINĒTO:

1.pants

Definīcijas

Šī Līguma izpratnē:

1. Termins "Normatīvie akti muitas lietās" nozīmē likumus un noteikumus, kurus piemēro Muitas administrācijas attiecībā uz preču importu, eksportu un tranzītu, kas attiecas vai nu uz muitas nodokļiem, nodevām un citiem nodokļiem, vai uz aizliegumiem, ierobežojumiem un citiem kontroles pasākumiem attiecībā uz preču pārvietošanu pāri valstu robežām.

2. Termins "Muitas iestādes" nozīmē Latvijas Republikā — Valsts ieņēmumu dienesta Galveno muitas pārvaldi un Izraēlas valstī — Finansu ministrijas Muitas un pievienotās vērtības nodokļa departamentu.

3. Termins "Muitas pārkāpums" nozīmē jebkuru normatīvo aktu muitas lietās pārkāpumu vai pārkāpuma mēģinājumu.

4. Termins "Pieprasītāja muitas iestāde" nozīmē muitas iestādi, kas pieprasa palīdzību saskaņā ar šo Līgumu vai kas saņem šādu palīdzību.

5. Termins "Pieprasījuma saņēmēja muitas iestāde" nozīmē muitas iestādi, kas saņem palīdzības pieprasījumu saskaņā ar šo Līgumu vai kas sniedz šādu palīdzību.

6. Termins "Informācija" nozīmē inter alia ziņojumus, pārskatus, uzskaiti, dokumentus un dokumentāciju, neatkarīgi no tā, vai tā ir vai nav datorizēta, kā arī to autentiskas kopijas.

7. Termins "Kontrolētā piegāde" nozīmē paņēmienu, kas atļauj kravu, kuras satur vai par kurām ir aizdomas, ka tās satur narkotikas, psihotropās vielas vai to aizstājējus, izvešanu, pārvietošanu caur vai ievešanu Pušu teritorijās to kompetento iestāžu uzraudzībā, nolūkā atklāt personas, kuras iesaistītas narkotiku un psihotropo vielu nelikumīgā pārvietošanā.

8. Termins "Persona" nozīmē jebkuru fizisku vai juridisku personu.

2.pants

Līguma darbības sfēra

1. Puses ar to muitas iestāžu palīdzību apņemas sniegt viena otrai palīdzību pārkāpumu, tai skaitā normatīvo aktu muitas lietās pārkāpumu, novēršanā, izmeklēšanā, apkarošanā un apsūdzības celšanā saskaņā ar šī Līguma noteikumiem.

2. Palīdzība šī Līguma ietvaros tiek sniegta atbilstoši Pieprasījuma saņēmējas Puses normatīvajiem aktiem.

3. Šī Līguma noteikumi ir paredzēti, lai Pušu muitas iestādes sniegtu savstarpēju palīdzību. Tie nekādā veidā nerada jebkurai fiziskai vai juridiskai personai tiesības iegūt, noklusēt vai izslēgt jebkurus pierādījumus vai kavēt pieprasījuma izpildi.

3.pants

Vispārējās palīdzības saturs

1. Palīdzība, saskaņā ar šo Līgumu, ietver inter alia pēc Muitas iestādes pašas iniciatīvas vai pēc pieprasījuma informācijas sniegšanu, lai nodrošinātu normatīvo aktu muitas lietās pareizu piemērošanu, muitas nodokļu un nodokļu par preču importu un eksportu precīzu uzlikšanu un šādu preču klasifikācijas, vērtības un izcelsmes pareizu noteikšanu, ko veic Muitas iestādes. Šāda informācija arī ietver, bet neaprobežojas ar:

a) izpildu darbībām, kas varētu būt lietderīgas pārkāpumu novēršanā un, īpaši, pārkāpumu apkarošanas speciālajiem līdzekļiem;

b) pārkāpumu izdarīšanas jaunajām metodēm;

c) novērojumiem un konstatējumiem, kas izdarīti jaunu normatīvo aktu muitas lietās pārkāpumu novēršanas nodrošināšanas līdzekļu un paņēmienu piemērošanas rezultātā;

d) pasažieru muitas formalitāšu veikšanas un kravas noformēšanas paņēmieniem un uzlabotajām metodēm; un

e) informāciju par normatīvajiem aktiem muitas lietās.

2. Šī panta 1.daļā paredzētā palīdzība tiek sniegta Pieprasītājai muitas iestādei izmantošanai visos procesos, vai nu tiesu, vai administratīvajos procesos vai izmeklēšanas darbībās, un tā ietver, bet neaprobežojas ar darbībām preču klasifikācijas, vērtības, izcelsmes un citu īpašību noteikšanā saistībā ar normatīvo aktu muitas lietās izpildīšanu.

3. Puses ar to muitas iestāžu starpniecību, ja tas nav pretrunā ar Pušu normatīvajiem aktiem, sadarbosies:

a) noteiktu apmācību programmu savam personālam uzsākšanā, izstrādē vai uzlabošanā;

b) sakaru sistēmu izveidošanā un uzturēšanā starp to Muitas iestādēm, lai sekmētu drošu un ātru informācijas apmaiņu;

c) efektīvas koordinācijas sekmēšanā starp Muitas iestādēm, tai skaitā personāla, ekspertu apmaiņā un sadarbības amatpersonu iecelšanā;

d) jaunu iekārtu vai procedūru izmantošanas jautājuma izskatīšanā un to pārbaudē;

e) atbilstošo muitas procedūru vienkāršošanā un harmonizēšanā; un

f) jebkuru citu vispārēju administratīvu jautājumu risināšanā, kam laiku pa laikam ir nepieciešamas Pušu kopīgas darbības;

g) palīdzība, saskaņā ar šo Līgumu, sevī neietver ne personu aizturēšanu vai arestu, ne muitas nodokļu, citu nodokļu, soda naudu vai citu maksājumu iekasēšanu vai piedziņu otras Muitas iestādes labā.

4.pants

Speciālās palīdzības saturs

1. Muitas iestādes pēc pieprasījuma sniedz viena otrai informāciju, vai preces, kuras tiek eksportētas no/vai importētas vienas Puses teritorijā, ir likumīgi importētas vai eksportētas no otras Puses teritorijas. Informācija pēc pieprasījuma tiek sniegta par preču muitošanā piemēroto muitas procedūru un/vai jebkuriem muitas kontroles pasākumiem, kas piemēroti šīm precēm.

2. Savas kompetences robežās vienas Puses Muitas iestāde, pēc otras Puses Muitas iestādes pieprasījuma vai pēc savas iniciatīvas un pēc pēdējās tūlītēja rakstiska apstiprinājuma veic īpašu uzraudzību pār:

a) transporta līdzekļiem, par kuriem ir aizdomas, ka tie tiek izmantoti muitas pārkāpumos pieprasītājas Puses teritorijā;

b) precēm, kuras pieprasītāja Puse ir atzinusi par bieži izmantotām slepenā tirdzniecībā, kur šī Puse ir galamērķa valsts;

c) īpašām personām, par kurām pieprasījuma saņēmējai Pusei ir zināms, ka tās ir izdarījušas muitas pārkāpumu vai tai ir aizdomas par pārkāpuma izdarīšanu, īpaši iebraucot un izbraucot no tās teritorijas;

d) īpašām vietām, kur ir izveidoti preču krājumi, par kurām ir iemesls domāt, ka tās tiek izmantotas saistībā ar nelikumīgu preču importu pieprasītājas Puses teritorijā.

3. Pušu Muitas iestādes sniedz viena otrai visu pieejamo informāciju par darbībām, kā rezultātā var tikt izdarīti pārkāpumi otras Puses teritorijā. Gadījumos, kas varētu būt saistīti ar būtiska kaitējuma nodarīšanu ekonomikai, sabiedrības veselībai, sabiedrības drošībai vai jebkurām citām otras Puses būtiskām interesēm, šāda informācija tiek sniegta, kad vien iespējams, bez pieprasījuma.

4. Lai aizkavētu un apkarotu pārkāpumus, kas ir saistīti ar narkotikām un psihotropajām vielām, Pušu Muitas iestādes sniedz viena otrai, cik tas ir iespējams bez nepieciešamības nosūtīt pieprasījumu, visu informāciju saistībā ar iespējamiem otras Puses normatīvo aktu muitas lietās pārkāpumiem.

5.pants

Konfidencialitāte

1. Informācija un citi ziņojumi, kas ir saņemti savstarpējās palīdzības sniegšanas laikā var tikt izmantoti vienīgi šajā Līgumā paredzētajiem mērķiem, tai skaitā izmantošanai tiesu vai administratīvajos procesos.

2. Jebkura informācija vai citi ziņojumi, ko saņem jebkuras Puses Muitas iestāde, saskaņā ar šo Līgumu, tiek uzskatīti par konfidenciāliem, un tie netiek darīti zināmi jebkurai fiziskai vai juridiskai personai, kas atrodas ārpus pieprasītājas Muitas iestādes, kas tos ir saņēmusi, izņemot šajā Līgumā paredzētajos gadījumos.

Šāda informācija un ziņojumi ir pakļauti jebkādai papildus aizsardzībai attiecībā uz to konfidencialitāti un slepenību atbilstoši tās Puses normatīvajiem aktiem, kuras Muitas iestāde tos ir saņēmusi.

3. Šī panta 2.daļas noteikumi netiek piemēroti gadījumos attiecībā uz pārkāpumiem, kas ir saistīti ar narkotikām un psihotropajām vielām vai to aizstājējiem. Šāda informācija var tikt sniegta citām pieprasītājas Puses iestādēm, kas ir tieši iesaistītas nelikumīgas narkotiku pārvadāšanas apkarošanā.

4. Pieprasītāja Muitas iestāde neizmanto pierādījumus vai informāciju, kas ir iegūti saskaņā ar šo Līgumu, mērķiem, kas ir citādi, nekā tas ir noteikts pieprasījumā bez iepriekšējas pieprasījuma saņēmējas Muitas iestādes rakstiskas piekrišanas.

6.pants

Pieprasījumu nosūtīšana

1. Pieprasījumi saskaņā ar šo Līgumu tiek noformēti rakstiski. Pieprasījumam tiek pievienoti dokumenti, kas ir nepieciešami šādu pieprasījumu izpildei. Ja nepieciešams, situācijas steidzamības dēļ, var tikt pieņemti arī mutiski pieprasījumi, bet tie nekavējoties ir jāapstiprina rakstveidā.

2. Pieprasījumos, saskaņā ar šī panta 1.daļu, ir jābūt ietvertai šādai informācijai:

a) iestāde, kas izdara pieprasījumu;

b) veiktie kontroles pasākumi;

c) pieprasītā palīdzība un pieprasījuma priekšmets un iemesls;

d) pieprasījumā iesaistīto pušu vārdi (nosaukumi) un adreses, ja zināms;

e) apskatāmā jautājuma īss izklāsts un ar to saistītie tiesiskie aspekti; un

f) sakarība starp pieprasīto palīdzību un jautājumu, uz kuru tā attiecas.

3. Visi pieprasījumi ir jāiesniedz angļu valodā.

4. Ja pieprasījums neatbilst šī panta 2.daļā paredzētajām formālajām prasībām, var tikt pieprasīta labojumu izdarīšana tajā vai noformēšana. Ar šo nevajadzētu ietekmēt veicamos piesardzības pasākumus.

5. Attiecīgās Muitas iestādes sniedz palīdzību tieši viena otrai.

6. Gadījumā, ja pieprasījuma saņēmēja Muitas iestāde nav atbilstošā iestāde pieprasījuma izpildei, tai vai nu nekavējoties jāpārsūta pieprasījums atbilstošajai iestādei, kas rīkosies saskaņā ar pieprasījumu atbilstoši tās pilnvarām saskaņā ar normatīvajiem aktiem, vai sniegs konsultācijas pieprasītājai Muitas iestādei par veicamajiem atbilstošajiem pasākumiem attiecībā uz šo pieprasījumu.

7.pants

Pieprasījumu izpilde

1. Pieprasījuma saņēmēja Muitas iestāde veic visus saprātīgos pasākumus, lai izpildītu pieprasījumu saprātīgā laika periodā un, ja nepieciešams, pieliks visas pūles, lai veiktu jebkurus oficiālos vai tiesiskos pasākumus pieprasījuma izpildei.

2. Ja pieprasījuma saņēmējas Muitas iestādes rīcībā nav pieprasītās informācijas, tā pieliek visas pūles, lai iegūtu šādu informāciju, it kā tā rīkotos savā labā un pieprasītājas Muitas iestādes labā.

3. Katras Puses Muitas iestāde pēc otras Puses Muitas iestādes pieprasījuma veic jebkuras nepieciešamās izmeklēšanas darbības, tai skaitā, ekspertu un liecinieku vai par pārkāpuma izdarīšanu aizdomās turamo personu intervēšanu, un veic pārbaudes, kontroles pasākumus un izziņas darbības jautājumos, kas ir paredzēti šajā Līgumā. Par šādu izmeklēšanas darbību, pārbaužu, kontroles pasākumu un izziņas darbību rezultātiem tā nekavējoties paziņo pieprasītājai Muitas iestādei.

4. Pēc pieprasījuma, pieprasījuma saņēmēja Muitas iestāde var atļaut pieprasītājas Muitas iestādes amatpersonām būt klāt pieprasījuma saņēmējas Puses teritorijā laikā, kad tās amatpersonas veic pārkāpumu izmeklēšanu, kas ir saistīti ar pieprasītājas Muitas iestādi, tai skaitā piedalīšanos izmeklēšanas darbībās.

5. Pieprasītājas Muitas iestādes amatpersonu klātbūtnei pieprasījuma saņēmējas Puses teritorijā ir vienīgi konsultatīvs raksturs. Šajā pantā nekas netiks interpretēts tā, lai atļautu tām realizēt jebkādas tiesiskas vai izmeklēšanas pilnvaras, kas ir piešķirtas pieprasījuma saņēmējas Muitas iestādes muitas amatpersonām saskaņā ar pieprasījuma saņēmējas Puses normatīvajiem aktiem.

6. Pieprasītājai Muitas iestādei, ja tas ir nepieciešams, atbildot uz pieprasījumu, tiek paziņots par veicamās darbības laiku un vietu, lai šādu darbību varētu koordinēt.

7. Pieprasītājas Muitas iestādes amatpersonas, kas ir pilnvarotas izmeklēt normatīvo aktu muitas lietās pārkāpumus, var lūgt, lai pieprasījuma saņēmējas Muitas iestādes amatpersonas pārbauda jebkādu atbilstošo informāciju, tai skaitā, uzskaites žurnālus, reģistrus un citus dokumentus vai datu mēdijus un nosūta to kopijas vai sniedz jebkādu citu informāciju saistībā ar pārkāpumu.

8. Laikā, kad pieprasītājas Muitas iestādes amatpersonas atrodas pieprasījuma saņēmēja Puses teritorijā saskaņā ar šo Līgumu, tām jebkurā brīdī ir jābūt spējīgām pierādīt to oficiālo pilnvarojumu, un tās ir atbildīgas par jebkuru iespējami izdarītu pārkāpumu.

8.pants

Palīdzības sniegšanas pienākuma izņēmumi

1. Gadījumos, kad pieprasījuma saņēmēja Muitas iestāde uzskata, ka pieprasījuma izpilde saskaņā ar šo līgumu var kaitēt tās suverenitātei, drošībai, valsts politikai vai jebkurām citām būtiskām nacionālajām interesēm vai tā ir saistīta ar komerciālā, rūpnieciskā vai profesionālā noslēpuma pārkāpšanu, palīdzības sniegšana var tikt atteikta vai pieprasījuma izpilde var tikt pakļauta noteiktu nosacījumu vai prasību izpildei.

2. Gadījumā, ja pieprasījums nevar tikt izpildīts, pieprasītājai Muitas iestādei tas tiek nekavējoties paziņots, kā arī tā tiek informēta par atteikuma iemesliem.

3. Ja pieprasītāja Muitas iestāde pieprasa palīdzību, kuru tā pati nebūtu spējīga sniegt, tā šim faktam pievērsīs uzmanību pieprasījumā. Šāda pieprasījuma izpildīšana tad būs pilnībā pieprasījuma saņēmējas Muitas iestādes ziņā.

4. Pieprasījuma saņēmējas Muitas iestāde var atlikt uz laiku palīdzības sniegšanu, pamatojoties uz to, ka tādā veidā var tikt traucēta notiekošā izmeklēšana, lietas ierosināšana vai tiesvedība. Šādā gadījumā tā konsultējas ar pieprasītāju Muitas iestādi, lai noteiktu, vai palīdzība var tikt sniegta, pamatojoties uz tādiem noteikumiem vai nosacījumiem, ko var izvirzīt pieprasījuma saņēmēja Muitas iestāde.

9.pants

Reģistri, dokumenti un liecinieki

1. Pušu Muitas iestādes pēc pieprasījuma sniedz informāciju par preču transportēšanu un pārvadāšanu, uzrādot šo preču vērtību, izcelsmi, izvietojumu un galamērķi.

2. Pēc īpaša pieprasījuma informācijas un citu materiālu kopijas, kas sniegtas saskaņā ar šo Līgumu, tiek atbilstoši apstiprinātas. Šādas informācijas un citu materiālu oriģināli tiek pieprasīti vienīgi gadījumos, kad kopijas ir nepietiekamas.

3. Informācijas un citu materiālu oriģinālu sniegšana saskaņā ar šo Līgumu neietekmē ne pieprasījuma saņēmējas Muitas iestādes, ne trešo pušu tiesības. Šādi oriģināli tiek atdoti atpakaļ, cik ātri vien iespējams. Pēc pieprasījuma, oriģināli, kas ir nepieciešami tiesvedības vai līdzīgiem mērķiem, tiek atdoti atpakaļ nekavējoties.

4. Pieprasījuma saņēmēja Muitas iestāde kopā ar iesniegto informāciju iesniedz visus tās interpretācijai vai izmantošanai nepieciešamos norādījumus.

5. Pēc vienas Puses Muitas iestādes pieprasījuma otras Puses Muitas iestāde var pilnvarot savas amatpersonas, ja tās piekrīt, uzstāties kā lieciniekiem tiesu vai administratīvajos procesos pieprasītājas Puses teritorijā un uzrādīt šādus reģistrus, dokumentus vai citus materiālus vai to apstiprinātas kopijas, ko var uzskatīt par būtiskiem šajos procesos.

Šādā pieprasījumā ir jābūt ietvertai informācijai par procesa datumu un veidu, iesaistīto personu vārdiem, un amatpersonas kompetences robežas.

10.pants

Dokumentu nosūtīšana

1. Pēc pieprasījuma, pieprasījuma saņēmēja Muitas iestāde, saskaņā ar pieprasījuma saņēmējas Puses normatīvajiem aktiem, veic visus nepieciešamos pasākumus, lai nosūtītu visus dokumentus adresātam, kas dzīvo vai ir nodibināts tās teritorijā, un lai paziņotu tam par visiem pieņemtajiem lēmumiem, kas ietilpst šī Līguma darbības sfērā.

2. Pieprasījuma saņēmēja Muitas iestāde, cik vien iespējams, atdod atpakaļ nosūtīšanas vai izziņošanas pierādījumus tādā veidā, kā tas ir norādīts pieprasījumā. Ja tas nav iespējams vai ja pieprasījums nevar tikt nosūtīts norādītajā veidā, pieprasītāja Muitas iestāde par to tiek informēta un tai tiek paziņots par iemesliem.

11.pants

Izmaksas

1. Pušu Muitas iestādes parasti atsakās no visām prasībām par to izdevumu atlīdzināšanu, kas radušies šī Līguma izpildes gaitā, izņemot izdevumus lieciniekiem, ekspertu maksas un tulku, kuri nav valsts darbinieki, izmaksas.

2. Ja pieprasījuma izpildei ir vai būs nepieciešams izdarīt būtiska vai ārkārtēja rakstura izdevumus, Pušu Muitas iestādes konsultējas par noteikumiem un nosacījumiem, saskaņā ar kuriem pieprasījums var tikt izpildīts, kā arī par to, kā sadalāmi izdevumi.

12.pants

Kontrolētā piegāde

1. Muitas iestādes veic nepieciešamos pasākumus, savu iespēju robežās, lai atbilstoši izmantotu kontrolēto piegādi starptautiskā līmenī, lai identificētu personas, kas iesaistītas narkotiku, psihotropo vielu un to aizstājēju nelikumīgā pārvietošanā un veiktu pret tām tiesiskus pasākumus.

2. Lēmumi par kontrolētās piegādes veikšanu tiek pieņemti katrā atsevišķā gadījumā, un, ja nepieciešams, saskaņā ar jebkādām vienošanām vai līgumiem, kas ir panākti saistībā ar noteikto lietu. Muitas iestādes, ja nepieciešams, un ar nosacījumu, ka tas atbilst Pušu normatīvajiem aktiem, var ņemt vērā panāktās finansiālās vienošanās un veiktos pasākumus.

3. Aizliegto kravu pārvietošanu, par kuru kontrolēto piegādi kompetentas iestādes ir savstarpēji vienojušās, var apturēt vai atļaut tās pārvietot tālāk ar narkotikām un psihotropajām vielām neskartas, vai tās izņemot vai daļēji vai pilnīgi aizvietojot.

13.pants

Teritoriālā piemērojamība

Šis Līgums tiek piemērots abu Pušu muitas teritorijās.

14.pants

Līguma piemērošana

Muitas iestādes ir atbildīgas par šī Līguma piemērošanu.

Tās inter alia:

a) tieši sazinās, lai risinātu jautājumus, kas ir saistīti ar šo Līgumu;

b) pēc konsultācijām, ja nepieciešams, izdod jebkādas administratīvas direktīvas vai procedūras, par kurām ir panākta vienošanās šī Līguma ieviešanas īstenošanai;

c) cenšas atrisināt jebkuras nesaskaņas vai domstarpības, kas rodas šī Līguma vai jebkuras citas muitas lietas piemērošanas gaitā, kas var rasties starp tām;

d) vienojas par tikšanos, pēc vienas Puses pieprasījuma, lai apspriestu šī Līguma piemērošanu vai lai apspriestu jebkuras citas muitas lietas, kas radušās no to savstarpējām attiecībām; un

e) vienojas, lai to izziņu realizējošās struktūrvienības tieši sazinātos viena ar otru.

15.pants

Līguma stāšanās spēkā un darbības izbeigšana

1. Puses diplomātisko notu apmaiņas ceļā informē viena otru, ka visas iekšējās prasības, kas nepieciešamas, lai Līgums varētu stāties spēkā, ir izpildītas. Līgums stājas spēkā trīsdesmitajā dienā pēc pēdējā paziņojuma saņemšanas datuma.

2. Puses vienojas, ka tiksies, lai pārskatītu šo Līgumu, pēc pieprasījuma vai pēc piecu gadu perioda beigām no tā spēkā stāšanās datuma, ja vien tās viena otrai nepaziņos, ka šāda pārskatīšana nav nepieciešama.

3. Katra Puse šī Līguma darbību var izbeigt pēc tam, kad otra Puse pa diplomātiskiem kanāliem ir saņēmusi rakstisku paziņojumu; šajā gadījumā tas zaudē spēku sešus mēnešus pēc šāda paziņojuma saņemšanas. Pārtraukšanas brīdī uzsāktās procedūras, neatkarīgi no tā, tiks pabeigtas saskaņā ar šī Līguma noteikumiem.

TAM PAR APLIECINĀJUMU, apakšā parakstījušies, un būdami pilnvaroti savu Valdību vārdā parakstīt šo Līgumu,

Parakstīts 2001.gada 6.decembrī Rīgā, kas atbilst 5761.gada 21.kislev, divos eksemplāros, latviešu, ebreju un angļu valodās, un visi teksti ir vienlīdz autentiski. Jebkuru domstarpību gadījumā, interpretējot šo Līgumu, par pamatu tiks ņemts teksts angļu valodā.

AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF LATVIA AND THE GOVERNMENT OF THE STATE OF ISRAEL ON MUTUAL ASSISTANCE IN CUSTOMS MATTERS

The Government of the Republic of Latvia and the Government of the State of Israel (hereinafter referred to as the "Parties");

Considering that the offenses against the customs laws are prejudicial to the economic, fiscal and commercial interests of their respective countries;

Considering the importance of assuring the accurate assessment of customs duties and other taxes on the importation and exportation of goods, the correct determination of the classification, value and origin of such goods, as well as the proper implementation of measures of prohibition, restriction and control;

Considering that illicit trafficking in narcotic drugs and psychotropic substances constitutes a danger to public health and to society;

Recognizing the need for international cooperation in matters related to the administration and enforcement of the customs laws of their respective countries;

Convinced that action against customs offenses can be made more effective by cooperation between their Customs Authorities;

Having regard to the Recommendations of the Customs Cooperation Council on Mutual Administrative Assistance of December 5, 1953;

Having regard also to the provisions of the Single Convention on Narcotic Drugs (New York, 30 March 1961), the Convention on Psychotropic Substances (Vienna, 21 February 1971) drawn up under the auspices of the United Nations Organisation;

Recalling the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (Vienna, 19 December 1988),

Have agreed as follows:

Article 1

Definitions

For the purposes of the present Agreement;

1. The term "Customs Laws" shall mean such laws and regulations enforced by the Customs Authorities, concerning the importation, exportation, and transit of goods, as they relate to customs duties, charges and other taxes or to prohibitions, restrictions and other controls respecting the movement of goods across national boundaries.

2. The term "Customs Authorities" shall mean, in the Republic of Latvia, the State Revenue Service National Customs Board, and in the State of Israel, the Department of Customs and Value Added Tax of the Ministry of Finance.

3. The term "Offense" shall mean any violation of the customs laws, as well as any attempted violation thereof.

4. The term "Requesting Customs Authority" shall mean the Customs Authority that makes a request for assistance under this Agreement or that receives such assistance.

5. The term "Requested Customs Authority" shall mean the Customs Authority that receives a request for assistance under this Agreement or that provides such assistance.

6. The term "information" shall mean, inter alia, communications, reports, records, documents and documentation, whether computerized or not, as well as authenticated copies thereof.

7. The term "Controlled Delivery" shall mean the technique of allowing consignments which contain, or are suspected of containing, narcotic drugs, psychotropic substances, or substances substituted for them, to pass out of, through, or into the territories of the Parties, with the knowledge and under the supervision of the competent authorities, for the purpose of identifying persons involved in the illicit trafficking in narcotic drugs and psychotropic substances.

8. The term "person" shall mean a natural person or a legal entity.

Article 2

Scope of Agreement

1. The Parties agree to assist each other through their Customs Authorities in preventing, investigating, combating and prosecuting offenses involving the violation of customs laws in accordance with the provisions of the present Agreement.

2. All assistance under the present Agreement shall be provided subject to the domestic law of the requested Party.

3. The provisions of this Agreement are intended solely to provide for mutual assistance between the Customs Authorities of the Parties. They shall in no way give rise to a right on the part of any private person or legal entity to obtain, suppress or exclude any evidence, or to impede the execution of a request.

Article 3

Scope of general assistance

1. Assistance, pursuant to this Agreement, shall include, inter alia, on a Customs Authority's own initiative or upon request, the provision of information apt to ensure the proper application of the customs laws, the accurate assessment of customs duties and taxes on the importation and exportation of goods and the correct determination of the classification, value and origin of such goods, by the Customs Authorities. Such information shall also include, but not be limited to:

a) enforcement actions that might be useful in preventing offenses and, in particular, special means of combating offenses;

b) new methods used in committing offenses;

c) observations and findings resulting from the successful application of new enforcement aids and techniques;

d) techniques and improved methods of processing passengers and cargo; and

e) information on customs laws.

2. Assistance as provided in Paragraph 1 shall be provided for use in all proceedings in the requesting Party, whether judicial, administrative, or investigative, and shall include, but not be limited to, proceedings on classification, value, origin and other characteristics relevant to the enforcement of the customs laws.

3. The Parties, through their respective Customs Authorities, shall, if not contrary to their domestic law, also seek to cooperate in:

a) initiating, developing or improving specific training programs for their personnel;

b) establishing and maintaining channels of communication between their Customs Authorities to facilitate the secure and rapid exchange of information;

c) facilitating effective coordination between their Customs Authorities including the exchange of personnel, experts and the posting of liaison officers;

d) the consideration and testing of new equipment or procedures;

e) the simplification and harmonizing of their respective customs procedures; and

f) any other general administrative matters that may from time to time require their joint action.

g) Assistance pursuant to this Agreement shall not include the arrest or detention of persons nor the collection or forced collection of customs duties, other taxes, fines, or other moneys on behalf of the other Customs Authority.

Article 4

Scope of special assistance

1. Upon request, the Customs Authorities shall inform each other whether goods exported from or imported into the territory of one Party have been lawfully imported into or exported from the territory of the other Party. The information shall, upon request, contain the customs procedure used for clearing the goods and/or any customs control measures to which the goods have been subjected.

2. To the extent of its competence, the Customs Authority of one Party, either upon request of the Customs Authority of the other Party or on its own initiative and subject to the immediate written approval of the latter, shall exercise special surveillance over;

a) means of transportation suspected of being used in the commission of offenses within the territory of the requesting Party;

b) goods designated by the requesting Party as being the subject of an extensive clandestine trade of which that Party is the country of destination;

c) particular persons known to the requested Party to have committed a customs offense or suspected of doing so, particularly their moving into and out of its territory;

d) particular places where stocks of goods have been built up, giving reason to assume that they are to be used for illicit importation into the territory of the requesting Party.

3. The Customs Authorities of the Parties shall furnish each other all available information regarding acts which may result in offenses within the territory of the other Party. In cases which could involve substantial damage to the economy, public health, public security or any other vital interest of the other Party, such information shall be supplied whenever possible, without being requested.

4. For the purpose of preventing and combating offenses involving narcotics drugs and psychotropic substances, the Customs Authorities of the Parties shall communicate to each other as far as possible without the necessity of a request, all information regarding possible violations of the customs laws of the other Party.

Article 5

Confidentiality

1. Information and other communications received in the course of mutual assistance may only be used for the purposes specified in the present Agreement, including the use in judicial or administrative proceedings.

2. Any information or other communications received by the Customs Authority of either Party, pursuant to this Agreement, shall be treated as confidential and shall not be communicated to any person or entity outside the requesting Customs Authority that received them, except as provided for in this Agreement.

Such information and communications shall enjoy any additional protection as to their confidentiality and secrecy as provided for in the domestic law of the Party whose Customs Authority received them.

3. The provisions of Paragraph 2 of this Article shall not apply to cases concerning offenses relating to narcotic drugs and psychotropic substances or substances substituted for them. Such information may be communicated to other authorities of the requesting Party directly involved in combating illicit drug traffic.

4. The requesting Customs Authority shall not use evidence or information obtained under this Agreement for purposes other than those stated in the request without the prior written consent of the requested Customs Authority.

Article 6

Communication of requests

1. Requests pursuant to the present Agreement shall be made in writing. Documents necessary for the execution of such requests shall accompany the request. When required, because of the urgency of the situation, oral requests may also be accepted, but they shall be promptly confirmed in writing.

2. Requests pursuant to Paragraph 1 of this Article shall include the following information:

a) the authority making the request;

b) the nature of the proceedings;

c) the assistance sought and the object of and the reason for the request;

d) the names and addresses of the parties involved in the request, if known;

e) a brief description of the matter under consideration and the legal elements involved; and

f) the connection between the assistance sought and the matter to which it relates.

3. All requests shall be submitted in the English language.

4. If a request does not meet the formal requirements as per Paragraph 2 of this Article, its correction or completion may be requested. The ordering of precautionary measures need not be affected thereby.

5. Assistance shall be carried out by direct communication between the respective Customs Authorities.

6. In case the requested Customs Authority is not the appropriate agency to comply with a request, it shall either promptly transmit the request to the appropriate agency, which shall act upon the request according to its powers under the law, or advise the requesting Customs Authority of the appropriate procedure to be followed regarding such a request.

Article 7

Execution of requests

1. The requested Customs Authority shall take all reasonable measures to execute a request, within a reasonable amount of time and, if necessary, shall endeavor to seek any official or judicial measure necessary for the carrying out thereof.

2. If the requested Customs Authority does not have the information requested, it shall endeavor to obtain such information as if acting on its own behalf and on behalf of the requesting Customs Authority.

3. The Customs Authority of either Party shall, upon the request of the Customs Authority of the other Party, conduct any necessary investigation, including the questioning of experts and witnesses or persons suspected of having committed an offense, and undertake verifications, inspections and fact-finding inquiries in connection with the matters referred to in the present Agreement. The results of such investigations, verifications, inspections and fact-finding inquiries shall be communicated as soon as possible to the requesting Customs Authority.

4. Upon request, the requested Customs Authority may allow officials of the requesting Customs Authority to be present in the territory of the requested Party, when its officials are investigating offenses which are of concern to the requesting Customs Authority, including presence at such investigations.

5. The presence of officials of the requesting Customs Authority in the territory of the requested Party shall be solely in an advisory capacity. Nothing in this Article shall be construed to allow them to exercise any legal or investigative power granted to customs officials of the requested Customs Authority under the domestic law of the requested Party.

6. The requesting Customs Authority shall, if it so requests, be advised of the time and place of the action to be taken in response to a request so that such action may be coordinated.

7. Officials of the requesting Customs Authority, authorized to investigate offenses against customs laws, may ask that officials of the requested Customs Authority examine any relevant information including books, registers and other documents or data-media and supply copies thereof or provide any other information relating to the offense.

8. When officials of the requesting Customs Authority are present in the territory of the requested Party pursuant to this Agreement, they must be able at all times to furnish proof of their identity and shall be responsible for any offenses they might commit.

Article 8

Exemptions from assistance

1. In cases where the requested Party is of the opinion that the provision of assistance under this Agreement would infringe upon its sovereignty, security, public policy, or any other substantive national interest, or involve the violation of a commercial, industrial, or professional secret, assistance may be refused or compliance may be conditioned upon the satisfaction of certain conditions or requirements.

2. In the event that a request cannot be complied with, the requesting Customs Authority shall be promptly notified of the fact, and informed of the reasons thereof.

3. If the requesting Customs Authority requests assistance which it, itself, would not be able to provide, it shall draw attention to that fact in the request. Compliance with such a request shall then be within the discretion of the requested Customs Authority.

4. Assistance may be postponed by the requested Customs Authority on the ground that it will interfere with an ongoing investigation, prosecution or proceeding. In such a case, it shall consult with requesting Customs Authority to determine if assistance can be given subject to such terms or conditions as the requested Customs Authority may require.

Article 9

Files, documents, and witnesses

1. The Customs Authorities of the Parties shall, upon request, provide information relating to the transportation and shipment of goods showing the value, origin, disposition and destination of those goods.

2. Upon specific request, copies of information and other materials provided pursuant to this Agreement shall be appropriately authenticated. Originals of such information and other materials shall only be requested in cases wherein copies would be insufficient.

3. The provision of the originals of information and other materials pursuant to this Agreement shall not affect the rights of the requested Customs Authority nor of third parties thereto. Such originals shall be returned as soon as possible. Upon request, originals necessary for adjudicative or similar purposes shall be returned without delay.

4. The requested Customs Authority shall supply together with the information provided, all necessary instructions for its interpretation or utilization.

5. Upon request of the Customs Authority of one Party, the Customs Authority of the other Party shall authorize its officials, if such officials so consent, to appear as witnesses in judicial or administrative proceedings in the territory of the requesting Party, and to produce such files, documents, or other materials, or authenticated copies thereof, as may be considered essential for the proceedings.

Such a request shall include the date and type of the proceeding, the names of the parties involved, and the capacity in which the official is to appear.

Article 10

Delivery of documents

1. Upon request, the requested Customs Authority shall, in accordance with the legislation in the requested Party, take all necessary measures in order to deliver all documents to an addressee residing or established in its territory, and to notify him of all decisions falling within the scope of this Agreement.

2. The requested Customs Authority shall, as far as possible, return a proof of delivery or notification in the manner specified in the request. If this is not possible or if the request cannot be carried out in the manner specified, the requesting Customs Authority shall be so informed and shall be advised of the reasons thereof.

Article 11

Costs

1. The Customs Authorities of the Parties shall normally waive all claims for the reimbursement of costs incurred in the execution of the present Agreement, with the exception of expenses for witnesses, fees of experts and the cost of interpreters other than government employees.

2. If expenses of a substantial and extraordinary nature are or will be required to execute a request, the Customs Authorities of the Parties shall consult to determine the terms and conditions under which the request will be carried out, as well as the manner in which the costs shall be borne.

Article 12

Controlled delivery

1. The Customs Authorities shall take the necessary measures, within their possibilities, to allow for the appropriate use of controlled delivery at the international level for the purpose of identifying persons involved in the illicit trafficking in narcotic drugs and psychotropic substances and substances substituted for them and taking legal action against them.

2. Decisions to use controlled delivery shall be made on a case-by-case basis and, where necessary, in accordance with any arrangements or agreements which may have been reached concerning a particular case. The Customs Authorities may, if necessary, and provided it is in conformity with the domestic law of the Parties, take into account financial arrangements and understandings reached.

3. Illicit consignments whose controlled delivery is agreed to, by mutual consent of the competent authorities, may be intercepted and allowed to continue with the narcotic drugs and psychotropic substances intact, or removed or replaced in whole or in part.

Article 13

Territorial applicability

This Agreement shall apply to the customs territories of both Parties.

Article 14

Implementation of the Agreement

The Customs Authorities shall be responsible for the implementation of this Agreement. They shall, inter alia:

a) communicate directly for the purpose of dealing with matters arising out of the present Agreement;

b) after consultation, if necessary, issue any administrative directives or agreed upon procedures for the implementation of the present Agreement;

c) endeavor by mutual accord to resolve any problems or doubts arising from the application of this Agreement or any other customs matter which may arise between them;

d) agree to meet, if one of them so requests, in order to discuss the application of this Agreement or to discuss any other customs matters arising out of the relationship between them; and

e) arrange for their investigation departments to be in direct contact with one another.

Article 15

Entry into force and termination

1. The Parties shall notify one another by an exchange of diplomatic notes when all necessary national legal requirements for the entry into force of this Agreement have been fulfilled. This Agreement shall enter into force on the 30th day after the last such notification has been received.

2. The Parties agree to meet in order to review this agreement upon request or at the end of five years from the date of its entry into force, unless they notify one another that no such review is necessary.

3. This Agreement may be terminated by either Party, upon receipt by the other Party of written notice through diplomatic channels; in which case, it shall cease to be in force six months after such notice has been given. Ongoing proceedings at the time of termination shall, nevertheless, be completed according to the provisions of this Agreement.

IN WITNESS THEREOF, the undersigned, being duly authorized by their respective governments, have signed this Agreement.

Done at Riga on the 6th day of December 2001 which corresponds to the 21 day of kislev 5761 in duplicate in the Latvian, Hebrew and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
