Par Latvijas Republikas un Nīderlandes Karalistes līgumu par sakaru virsnieku privilēģijām un imunitāti
1.pants. Latvijas Republikas 2005.gada 25.aprīļa notas Nr.41/651-3235 un Nīderlandes Karalistes 2004.gada 17.februāra notas Nr.41/04 apmaiņas ceļā noslēgtais Latvijas Republikas un Nīderlandes Karalistes līgums par sakaru virsnieku privilēģijām un imunitāti (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.
2.pants. Līgums stājas spēkā diplomātiskajās notās noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".
3.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Līgums angļu valodā un tā tulkojums latviešu valodā.
Likums Saeimā pieņemts 2005.gada 15.septembrī.

The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the Republic of Latvia and has the honour to propose, with reference to Article 41, paragraph 2 of the Convention based on Article K.3 of the Treaty on European Union on the establishment of a European Police Office (Europol Convention, 26 July 1995) that the privileges and immunities necessary for the proper performance of the tasks of the liaison officers at Europol be agreed upon as set out in the Attachment.

If this proposal is acceptable to the Ministry of Foreign Affairs of the Republic of Latvia, the Embassy proposes that this note and the affirmative note of the Ministry of Foreign Affairs shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Latvia, which shall enter into force on the first day of the second month following the date on which the Republic of Latvia and the Kingdom of Netherlands have informed each other that the formalities required for the entry into force have been complied with.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry the assurances of its highest consideration.

Attachment

1. Definitions

In this Agreement:

a. "Liaison officer" means any official stationed at Europol in accordance with Article 5 of the Europol Convention;

b. "Government" means the Government of the Kingdom of the Netherlands;

c. "Host State authorities" means such State, municipal or other authorities of the Kingdom of the Netherlands as may be appropriate in the context of and in accordance with the laws and customs applicable in the Kingdom of the Netherlands;

d. "Member State" means the Republic of Latvia;

e. "Archives of the liaison officer" means all records, correspondence, documents, manuscripts, computer and media data, photographs, films, video and sound recordings belonging to or held by the liaison officer, and any other similar material which in the unanimous opinion of the Member State and the Government forms part of the archives of the liaison officer.

2. Privileges and immunities

1. Subject to the provisions of this Agreement, the liaison officer and members of his family who form part of his household and do not possess Dutch nationality, shall enjoy in and vis-a-vis the Kingdom of the Netherlands the same privileges and immunities as are conferred on members of the diplomatic staff by the Vienna Convention on Diplomatic Relations of 18 April 1961.

2. The immunity granted to persons mentioned in paragraph 1 of this Article shall not extend to either:

i) civil action by a third party for damages, including personal injury or death, arising from a traffic accident caused by any such person, and is without prejudice to Article 32 of the Europol Convention; or

ii) criminal and civil jurisdiction over acts performed outside the course of their official duties.

3. The obligations of Sending States and their personnel that apply under the Vienna Convention to members of the diplomatic staff, shall apply to the persons referred to in paragraph 1 of this Article.

3. Entry, stay and departure

1. The Government shall facilitate, if necessary, the entry, stay and departure of the liaison officer and members of his family forming part of the household.

2. This Article shall not prevent the requirement of reasonable evidence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Article.

3. Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible.

4. Employment

Members of the family forming part of the household of the liaison officer not having the nationality of an EU State shall be exempted from the obligation to obtain working permits for the duration of the secondment of the liaison officer.

5. Inviolability of archives

The archives of the liaison officer wherever located and by whomsoever held shall be inviolable.

6. Personal Protection

The Host State authorities shall, if so requested by the Member State, take all reasonable steps in accordance with their national laws to ensure the necessary safety and protection of the liaison officer, as well as members of his family who form part of his household, whose security is endangered due to the performance of the tasks of the liaison officer at Europol.

7. Facilities and immunities in respect of communication

1. The Government shall permit the liaison officer to communicate freely and without a need for special permission, for all official purposes, and shall protect the right of the liaison officer to do so. The liaison officer shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags which shall be subject to the same privileges and immunities as diplomatic couriers and bags.

2. The liaison officer shall, as far as may be compatible with the International Telecommunications Convention of 6 November 1982, for his official communications enjoy treatment not less favourable than that accorded by the Kingdom of the Netherlands to any international organisation or government, in the matter of priorities for communication by mail, cable, telegraph, telex, radio, television, telephone, fax, satellite or other means.

8. Notification

1. The Member State shall promptly notify the Government of the name of the liaison officer, his arrival and his final departure or the termination of his secondment, as well as the arrival and final departure of the members of the family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the household.

2. The Government shall issue to the liaison officer and members of his family forming part of his household, an identification card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all Host State authorities.

9. Settlement of Disputes

1. Any dispute between the Member State and the Government concerning the interpretation or application of this Agreement, or any question affecting the liaison officer or the relationship between the Member State and the Government which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of the Member State or the Government. Each party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators.

2. If one of the parties fails to appoint an arbitrator within two months following a request from the other party to make such an appointment, the other party may request the President of the Court of Justice of the European Communities or in his absence the Vice-President, to make such an appointment.

3. Should the first two arbitrators fail to agree upon the third within two months following their appointment, either party may request the President of the Court of Justice of the European Communities, or in his absence the Vice-President, to make such an appointment.

4. Unless the parties agree otherwise, the tribunal shall determine its own procedure.

5. The tribunal shall reach its decision by a majority of votes. The Chairman shall have a casting vote. The decision shall be final and binding on the parties to the dispute.

10. Territorial scope

With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

The Ministry has the honour to inform the Embassy that the Government of the Republic of Latvia agrees to the contents of the above-mentioned Note, and that the Embassy's Note and this Note expressing the agreement of the Government of the Republic of Latvia shall constitute an Agreement between the Republic of Latvia and the Kingdom of the Netherlands, which shall enter into force on the first day of the second month following the date on which the Republic of Latvia and the Kingdom of Netherlands have informed each other that the formalities required for the entry into force have been complied with.

The Ministry of Foreign Affairs of the Republic of Latvia avails itself of this opportunity to renew to the Embassy of the Kingdom of the Netherlands the assurances of its highest consideration.

Nīderlandes Karalistes vēstniecība izsaka savus komplimentus Latvijas Republikas Ārlietu ministrijai un tai ir tas gods saskaņā ar Konvencijas par Eiropas Policijas biroja izveidi, kura pamatā ir Līguma par Eiropas Savienību K3.pants (1995.gada 26.jūlija Eiropola konvencija) 41.panta 2.punktu piedāvāt vienoties, kā noteikts Pielikumā, par privilēģijām un imunitāti, kas nepieciešamas Eiropola sakaru virsniekiem to uzdevumu veikšanai.

Ja šis piedāvājums ir pieņemams Latvijas Republikas Ārlietu ministrijai, Vēstniecība ierosina, ka šī nota un Ārlietu ministrijas atbildes nota satur Nīderlandes Karalistes un Latvijas Republikas vienošanos, kas stājas spēkā otrā mēneša pirmajā dienā pēc tam, kad Latvijas Republika un Nīderlandes Karaliste ir informējušas viena otru, ka ir izpildītas visas formalitātes, kas nepieciešamas, lai līgums stātos spēkā.

Nīderlandes Karalistes vēstniecība izmanto iespēju vēlreiz apliecināt savu cieņu Ministrijai.

Pielikums

1. Definīcijas

Šajā Līgumā:

a. "Sakaru virsnieks" nozīmē jebkuru amatpersonu, kas nosūtīta uz Eiropolu saskaņā ar Eiropola konvencijas 5.pantu;

b. "Valdība" nozīmē Nīderlandes Karalistes valdību;

c. "Uzņēmējas valsts institūcijas" nozīmē Nīderlandes Karalistes valsts, municipālās vai citas institūcijas Nīderlandes Karalistē piemērojamo likumu un paražu kontekstā un saskaņā ar tām;

d. "Dalībvalsts" nozīmē Latvijas Republiku;

e. "Sakaru virsnieka arhīvi" nozīmē jebkurus ierakstus, korespondenci, dokumentus, manuskriptus, datoru un mediju datus, fotogrāfijas, filmas, video un skaņas ierakstus, kas pieder vai atrodas sakaru virsnieka rīcībā, un jebkurus citus līdzīgus materiālus, kas pēc Dalībvalsts un Valdības vienprātīga uzskata veido daļu no sakaru virsnieka arhīviem.

2. Privilēģijas un imunitāte

1. Saskaņā ar šī Līguma nosacījumiem sakaru virsnieks un tā ģimenes locekļi, kas dzīvo kopā ar viņu un kuriem nav Nīderlandes pilsonība, Nīderlandes Karalistē un attiecībās ar to bauda tādas pašas privilēģijas un imunitāti, kas piešķirtas diplomātiem saskaņā ar 1961.gada 18.aprīļa Vīnes konvenciju par diplomātiskajiem sakariem.

2. Šī panta 1.punktā minētajām personām piešķirtā imunitāte neattiecas ne uz:

i) trešo personu civilprasību par zaudējumu atlīdzību, tajā skaitā par personas ievainojumu vai nāvi sakarā ar satiksmes negadījumu, ko izraisījusi minētā persona un kas nekaitē Eiropola konvencijas 32.pantam, ne uz

ii) kriminālo un civilo tiesvedību par darbībām, kas izdarītas ārpus savu oficiālo pienākumu veikšanas.

3. Nosūtošo valstu un to personāla pienākumi, kas saskaņā ar Vīnes konvenciju attiecas uz diplomātiskā dienesta locekļiem, attiecas arī uz šī panta 1.punktā minētajām personām.

3. Ieceļošana, uzturēšanās un izceļošana

1. Valdība nepieciešamības gadījumā atvieglo sakaru virsnieka un tā ģimenes locekļu, kas dzīvo kopā ar viņu, ieceļošanu, uzturēšanos un izceļošanu.

2. Šis pants neattur no prasības pēc pietiekamiem pierādījumiem, ka personas, kas lūdz šajā pantā paredzēto apiešanos, pieder pie šī panta 1.punktā minētās kategorijas.

3. Vīzas, kas nepieciešamas šajā pantā minētajām personām, tiek izsniegtas bez maksas un cik ātri vien iespējams.

4. Nodarbinātība

Sakaru virsnieka ģimenes locekļi, kas dzīvo kopā ar viņu un kuriem nav ES valsts pilsonības, tiek atbrīvoti no prasības iegūt darba atļauju uz sakaru virsnieka nodarbinātības laiku.

5. Arhīvu neaizskaramība

Sakaru virsnieka arhīvi neatkarīgi no tā, kur tie atrodas un kā rīcībā tie atrodas, ir neaizskarami.

6. Personas aizsardzība

Uzņemošās valsts institūcijas, ja to prasa Dalībvalsts, veic visus nepieciešamos pasākumus saskaņā ar saviem nacionālajiem normatīvajiem aktiem, lai nodrošinātu nepieciešamo sakaru virsnieku un tā ģimenes locekļu, kas dzīvo kopā ar viņu, drošību un aizsardzību, ja to drošība ir apdraudēta saistībā ar sakaru virsnieka pienākumiem Eiropolā.

7. Aprīkojums un imunitāte saistībā ar komunikāciju

1. Valdība atļauj sakaru virsniekam oficiālos nolūkos sazināties brīvi un bez īpašas atļaujas un aizsargā šādas sakaru virsnieka tiesības. Sakaru virsniekam ir tiesības izmantot kodus un nosūtīt un saņemt oficiālu korespondenci un citus paziņojumus ar kurjeru vai slēgtos sūtījumos, kas tiek pakļauti tādām pašām privilēģijām un imunitātei kā diplomātiskie kurjeri un sūtījumi.

2. Ciktāl tas ir savienojams ar 1982.gada 6.novembra Starptautisko Telekomunikāciju konvenciju, sakaru virsnieks saistībā ar savu oficiālo korespondenci bauda tādu pašu attieksmi kā to, ko Nīderlandes Karaliste piešķir jebkurai starptautiskai organizācijai vai valdībai prioritāšu kārtībā komunikācijai pa pastu, ar kablogrammu, telegrāfu, teleksu, radio, televīziju, telefonu, faksu, satelītu vai citiem līdzekļiem.

8. Paziņošana

1. Dalībvalsts nekavējoties paziņo Valdībai sakaru virsnieka vārdu, tā ieceļošanas un pēdējās izceļošanas dienu vai tā nodarbinātības izbeigšanas dienu, kā arī sakaru virsnieka ģimenes locekļu, kas dzīvo kopā ar viņu, ieceļošanas un pēdējās izceļošanas dienu un, ja nepieciešams, arī faktu, ka persona vairs nav uzskatāma par ģimenes locekli.

2. Valdība sakaru virsniekam un tā ģimenes locekļiem, kas dzīvo kopā ar viņu, izsniedz identifikācijas apliecību ar fotogrāfiju. Šī apliecība paredzēta, lai identificētu tā īpašnieku attiecībās ar Uzņemošās valsts institūcijām.

9. Strīdu risināšana

1. Jebkurš strīds starp Dalībvalsti un Valdību par šī Līguma interpretāciju vai piemērošanu vai jebkurš jautājums, kas skar sakaru virsnieku vai attiecības starp Dalībvalsti un Valdību un kas nav atrisināts sarunu ceļā, pēc Dalībvalsts vai Valdības pieprasījuma tiek iesniegts izlemšanai šķīrējtiesai ar trīs tiesnešiem. Katra puse nosaka vienu tiesnesi. Trešo, kas ir šķīrējtiesas priekšsēdētājs, nosaka abi pārējie tiesneši.

2. Ja viena no pusēm nenosaka tiesnesi divu mēnešu laikā pēc otras puses pieprasījuma izdarīt šādu noteikšanu, otra puse var lūgt Eiropas Kopienu Tiesas priekšsēdētāju vai tā prombūtnes laikā viceprezidentu izdarīt šādu noteikšanu.

3. Ja pirmie divi tiesneši nenosaka trešo tiesnesi divu mēnešu laikā pēc to noteikšanas, jebkura no pusēm var lūgt Eiropas Kopienu Tiesas priekšsēdētāju vai tā prombūtnes laikā viceprezidentu izdarīt šādu noteikšanu.

4. Ja vien puses nav vienojušās citādi, šķīrējtiesa pati pieņem noteikumus par savu darbību.

5. Šķīrējtiesa lēmumus pieņem ar balsu vairākumu. Priekšsēdētājam ir noteicošā balss. Lēmumi ir galīgi un saistoši strīdus pusēm.

10. Teritoriālā piemērojamība

Attiecībā uz Nīderlandes Karalisti šis Līgums tiek piemērots tikai uz Nīderlandes Karalistes Eiropas daļu

Ja šis piedāvājums ir pieņemams Latvijas Republikas Ārlietu ministrijai, Vēstniecība ierosina, ka šī nota un Ārlietu ministrijas atbildes nota satur Nīderlandes Karalistes un Latvijas Republikas vienošanos, kas stājas spēkā otrā mēneša pirmajā dienā pēc tam, kad Latvijas Republika un Nīderlandes Karaliste ir informējušas viena otru, ka ir izpildītas visas formalitātes, kas nepieciešamas, lai līgums stātos spēkā.

Vēstniecība izmanto iespēju vēlreiz apliecināt savu cieņu Ministrijai.

Pielikums

1. Definīcijas

Šajā Līgumā:

a. "Sakaru virsnieks" nozīmē jebkuru amatpersonu, kas nosūtīta uz Eiropolu saskaņā ar Eiropola konvencijas 5.pantu;

b. "Valdība" nozīmē Nīderlandes Karalistes valdību;

c. "Uzņēmējas valsts institūcijas" nozīmē Nīderlandes Karalistes valsts, municipālās vai citas institūcijas Nīderlandes Karalistē piemērojamo likumu un paražu kontekstā un saskaņā ar tām;

d. "Dalībvalsts" nozīmē Latvijas Republiku;

e. "Sakaru virsnieka arhīvi" nozīmē jebkurus ierakstus, korespondenci, dokumentus, manuskriptus, datoru un mediju datus, fotogrāfijas, filmas, video un skaņas ierakstus, kas pieder vai atrodas sakaru virsnieka rīcībā, un jebkurus citus līdzīgus materiālus, kas pēc Dalībvalsts un Valdības vienprātīga uzskata veido daļu no sakaru virsnieka arhīviem.

2. Privilēģijas un imunitāte

1. Saskaņā ar šī Līguma nosacījumiem sakaru virsnieks un tā ģimenes locekļi, kas dzīvo kopā ar viņu un kuriem nav Nīderlandes pilsonība, Nīderlandes Karalistē un attiecībās ar to bauda tādas pašas privilēģijas un imunitāti, kas piešķirtas diplomātiem saskaņā ar 1961.gada 18.aprīļa Vīnes konvenciju par diplomātiskajiem sakariem.

2. Šī panta 1.punktā minētajām personām piešķirtā imunitāte neattiecas ne uz:

i) trešo personu civilprasību par zaudējumu atlīdzību, tajā skaitā par personas ievainojumu vai nāvi sakarā ar satiksmes negadījumu, ko izraisījusi minētā persona un kas nekaitē Eiropola konvencijas 32.pantam, ne uz

ii) kriminālo un civilo tiesvedību par darbībām, kas izdarītas ārpus savu oficiālo pienākumu veikšanas.

3. Nosūtošo valstu un to personāla pienākumi, kas saskaņā ar Vīnes konvenciju attiecas uz diplomātiskā dienesta locekļiem, attiecas arī uz šī panta 1.punktā minētajām personām.

3. Ieceļošana, uzturēšanās un izceļošana

1. Valdība nepieciešamības gadījumā atvieglo sakaru virsnieka un tā ģimenes locekļu, kas dzīvo kopā ar viņu, ieceļošanu, uzturēšanos un izceļošanu.

2. Šis pants neattur no prasības pēc pietiekamiem pierādījumiem, ka personas, kas lūdz šajā pantā paredzēto apiešanos, pieder pie šī panta 1.punktā minētās kategorijas.

3. Vīzas, kas nepieciešamas šajā pantā minētajām personām, tiek izsniegtas bez maksas un cik ātri vien iespējams.

4. Nodarbinātība

Sakaru virsnieka ģimenes locekļi, kas dzīvo kopā ar viņu un kuriem nav ES valsts pilsonības, tiek atbrīvoti no prasības iegūt darba atļauju uz sakaru virsnieka nodarbinātības laiku.

5. Arhīvu neaizskaramība

Sakaru virsnieka arhīvi neatkarīgi no tā, kur tie atrodas un kā rīcībā tie atrodas, ir neaizskarami.

6. Personas aizsardzība

Uzņemošās valsts institūcijas, ja to prasa Dalībvalsts, veic visus nepieciešamos pasākumus saskaņā ar saviem nacionālajiem normatīvajiem aktiem, lai nodrošinātu nepieciešamo sakaru virsnieku un tā ģimenes locekļu, kas dzīvo kopā ar viņu, drošību un aizsardzību, ja to drošība ir apdraudēta saistībā ar sakaru virsnieka pienākumiem Eiropolā.

7. Aprīkojums un imunitāte saistībā ar komunikāciju

1. Valdība atļauj sakaru virsniekam oficiālos nolūkos sazināties brīvi un bez īpašas atļaujas un aizsargā šādas sakaru virsnieka tiesības. Sakaru virsniekam ir tiesības izmantot kodus un nosūtīt un saņemt oficiālu korespondenci un citus paziņojumus ar kurjeru vai slēgtos sūtījumos, kas tiek pakļauti tādām pašām privilēģijām un imunitātei kā diplomātiskie kurjeri un sūtījumi.

2. Ciktāl tas ir savienojams ar 1982.gada 6.novembra Starptautisko Telekomunikāciju konvenciju, sakaru virsnieks saistībā ar savu oficiālo korespondenci bauda tādu pašu attieksmi kā to, ko Nīderlandes Karaliste piešķir jebkurai starptautiskai organizācijai vai valdībai prioritāšu kārtībā komunikācijai pa pastu, ar kablogrammu, telegrāfu, teleksu, radio, televīziju, telefonu, faksu, satelītu vai citiem līdzekļiem.

8. Paziņošana

1. Dalībvalsts nekavējoties paziņo Valdībai sakaru virsnieka vārdu, tā ieceļošanas un pēdējās izceļošanas dienu vai tā nodarbinātības izbeigšanas dienu, kā arī sakaru virsnieka ģimenes locekļu, kas dzīvo kopā ar viņu, ieceļošanas un pēdējās izceļošanas dienu un, ja nepieciešams, arī faktu, ka persona vairs nav uzskatāma par ģimenes locekli.

2. Valdība sakaru virsniekam un tā ģimenes locekļiem, kas dzīvo kopā ar viņu, izsniedz identifikācijas apliecību ar fotogrāfiju. Šī apliecība paredzēta, lai identificētu tā īpašnieku attiecībās ar Uzņemošās valsts institūcijām.

9. Strīdu risināšana

1. Jebkurš strīds starp Dalībvalsti un Valdību par šī Līguma interpretāciju vai piemērošanu vai jebkurš jautājums, kas skar sakaru virsnieku vai attiecības starp Dalībvalsti un Valdību un kas nav atrisināts sarunu ceļā, pēc Dalībvalsts vai Valdības pieprasījuma tiek iesniegts izlemšanai šķīrējtiesai ar trīs tiesnešiem. Katra puse nosaka vienu tiesnesi. Trešo, kas ir šķīrējtiesas priekšsēdētājs, nosaka abi pārējie tiesneši.

2. Ja viena no pusēm nenosaka tiesnesi divu mēnešu laikā pēc otras puses pieprasījuma izdarīt šādu noteikšanu, otra puse var lūgt Eiropas Kopienu Tiesas priekšsēdētāju vai tā prombūtnes laikā viceprezidentu izdarīt šādu noteikšanu.

3. Ja pirmie divi tiesneši nenosaka trešo tiesnesi divu mēnešu laikā pēc to noteikšanas, jebkura no pusēm var lūgt Eiropas Kopienu Tiesas priekšsēdētāju vai tā prombūtnes laikā viceprezidentu izdarīt šādu noteikšanu.

4. Ja vien puses nav vienojušās citādi, šķīrējtiesa pati pieņem noteikumus par savu darbību.

5. Šķīrējtiesa lēmumus pieņem ar balsu vairākumu. Priekšsēdētājam ir noteicošā balss. Lēmumi ir galīgi un saistoši strīdus pusēm.

10. Teritoriālā piemērojamība

Attiecībā uz Nīderlandes Karalisti šis Līgums tiek piemērots tikai uz Nīderlandes Karalistes Eiropas daļu.".

Ministrijai ir tas gods informēt Vēstniecību, ka Latvijas Republikas valdība piekrīt augstāk minētās notas saturam un ka Vēstniecības nota un šī nota, kas satur Latvijas Republikas valdības piekrišanu, veido vienošanos starp Latvijas Republiku un Nīderlandes Karalisti, kas stājas spēkā otrā mēneša pirmajā dienā pēc tam, kad Latvijas Republika un Nīderlandes Karaliste ir informējušas viena otru, ka ir izpildītas visas formalitātes, kas nepieciešamas, lai līgums stātos spēkā.

Latvijas Republikas Ārlietu ministrija izmanto iespēju vēlreiz apliecināt Nīderlandes Karalistes vēstniecībai savu cieņu.
