prezidents izsludina šādu likumu:
Par Latvijas Republikas un Slovākijas Republikas līgumu par izmaiņām Latvijas Republikas un Slovākijas Republikas brīvās tirdzniecības līguma 3.protokolā
1.pants.  1999.gada 2.decembrī Bratislavā parakstītais Latvijas Republikas un Slovākijas Republikas līgums par izmaiņām Latvijas Republikas un Slovākijas Republikas brīvās tirdzniecības līguma 3.protokolā (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.
2.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Līgums angļu valodā un tā tulkojums latviešu valodā.
3.pants. Līgums stājas spēkā tā 2.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".
Likums Saeimā pieņemts 2000.gada 21.septembrī.

Agreement
between the Republic of Latvia and the Slovak Republic on Amendments to the Protocol 3 on Rules of Origin to the Free Trade Agreement between the Republic of Latvia and the Slovak Republic

Having regard to the Free Trade Agreement between the Republic of Latvia (hereinafter called Latvia), of one part, and the Slovak Republic (hereinafter called Slovakia), of the other part, signed in Riga on July 1, l996 and Protocol 3 to this agreement concerning the definition of the concept of "originating products" and methods of administrative cooperation,

Having in mind provisions of Articles 38 of the Free Trade Agreement between the Republic of Latvia and the Slovak Republic,

Whereas within this Protocol 3 the definition of the term "originating products" needs to be amended to ensure the proper operation of the extended system of cumulation which permits the use of materials originating in the European Community, Poland, Hungary, the Czech Republic, Slovakia, Bulgaria, Romania, Latvia, Lithuania, Estonia, Slovenia, European Economic Area (hereinafter referred to as " the EEA"), Iceland, Norway and Switzerland;

Whereas it would seem advisable to maintain in operation by 31 December 2000, the system of flat rate charges provided for in Article 15 of this Protocol 3 in connection with the prohibition of drawback and exemption from customs duty;

Whereas it would also be appropriate to extend the cumulation system to such products originating in Turkey;

Whereas to facilitate and simplify administrative tasks it would be desirable to amend the wording of Articles 3, 4 and 12 of this Protocol 3;

Whereas taking into account of changes in processing techniques and shortages of certain raw materials, some corrections must be made to the list of working and processing requirements which non-originating materials have to fulfil to qualify for originating status,

HAVE DECIDED AS FOLLOWS:

Article 1

Protocol 3 concerning the definition of the concept of "originating products" and related methods of administrative cooperation is hereby amended as follows:

1. Article 1(i) shall be replaced by:

"(i) "added value" shall be taken to be the ex-works price minus the customs value of each of the materials incorporated which originate in the other countries referred to in Article 4 or, where the customs value is not known or cannot be ascertained, the first price verifiably paid for the products in the Party."

2. Article 3 shall be deleted.

3. Article 4 shall be replaced by the following:

"Article 4

Cumulation of Origin

l. Without prejudice to the provisions of Article 2 paragraph l, products shall be considered as originating in a Party if such products are obtained there, incorporating materials originating in the European Community, Bulgaria, Poland, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein)* or Turkey in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between this Party and each of these countries, provided that the working or processing carried out in the Party goes beyond that referred to in Article 7 of this Protocol. It shall not be necessary that such materials have undergone sufficient working or processing.

2. Where the working or processing carried out in the Party does not go beyond the operations referred to in Article 7, the product obtained shall be considered as originating in the Party only where the value added there is greater than the value of the materials used originating in any one of the other countries referred to in paragraph 1. If this is not so, the product obtained shall be considered as originating in the country which accounts for the highest value of originating materials used in the manufacture in this Party.

3. Products, originating in one of the countries referred to in paragraph 1, which do not undergo any working or processing in the Party, retain their origin if exported into one of these countries.

4. The cumulation provided for in this Article may only be applied to materials and products which have acquired originating status by an application of rules of origin identical to those given in this Protocol."

4. Article 12 shall be replaced by the following:

"Article 12

Principle of territoriality

l. Except as provided for in Article 4 and paragraph 3 of this Article, the conditions for acquiring originating status set out in Title II must continue to be fulfilled at all times in the Parties.

2. Except as provided for in Article 4, where originating goods exported from one of the Parties to another country return, they must be considered as non-originating, unless it can be demonstrated to the satisfaction of the customs authorities that:

(a) the returning goods are the same as those that were exported; and

(b) they have not undergone any operation beyond that necessary to preserve them in good condition while in that country or while being exported.

3. The acquisition of originating status in accordance with the conditions set out in Title II shall not be affected by working or processing done outside the Parties on materials exported from one of the Parties and subsequently reimported there, provided:

(a) the said materials are wholly obtained in one of the Parties or have undergone working or processing beyond the insufficient operations listed in Article 7 prior to being exported; and

(b) it can be demonstrated to the satisfaction of the customs authorities that:

i) the reimported goods have been obtained by working or processing the exported materials; and

ii) the total added value acquired outside the Parties by applying the provisions of this Article does not exceed 10% of the ex-works price of the end product for which originating status is claimed.

4. For the purposes of paragraph 3, the conditions for acquiring originating status set out in Title II shall not apply to working or processing done outside the Parties. But where, in the list in Annex II, a rule setting a maximum value for all the non-originating materials incorporated is applied in determining the originating status of the end product, the total value of the non-originating materials incorporated in the territory of the Party concerned, taken together with the total added value acquired outside the Party by applying the provisions of this Article, shall not exceed the stated percentage.

5. For the purposes of applying the provisions of paragraphs 3 and 4, "total added value" shall be taken to mean all costs arising outside the Parties, including the value of the materials incorporated there.

6. The provisions of paragraphs 3 and 4 shall not apply to products which do not fulfil the conditions set out in the list in Annex II or which can be considered sufficiently worked or processed only if the general values fixed in Article 6(2) are applied.

7. The provisions of paragraphs 3 and 4 shall not apply to products coming under Chapters 50 to 63 of the Harmonised System.

8. Any working or processing of the kind covered by the provisions of this Article and done outside the Parties shall be done under the outward processing arrangements, or similar arrangements."

5. In Paragraph 6 of Articles 15 the date "31 December 1998" shall be replaced by "31 December 2000".

6. In Article 26 the reference "C2/CP3" shall be replaced by "CN22/CN23".

7. In Annex I, Note 5.2, the following new text "current conducting filaments" shall be added between the texts "artificial man-made filaments" and "synthetic man-made staple fibres of polypropylene".

8. In Annex I. Note 5.2 the text of the fifth example ("A carpet with tufts... are met.") shall be deleted.

9. In Annex II, between the rules for HS heading Nos 2202 and 2208 the following rule shall be inserted:

"HS heading No

Undenatured ethyl alcohol of an alcoholic strength by volume of 80% vol. or higher; ethyl alcohol and other spirits, denatured, of any strength. Manufacture:

- using materials not classified in headings 2207 or 2208"

10. In Annex II, the rule for Chapter 57 shall be replaced by:

"Chapter 57 Carpets and other textile floor coverings:

- Of needleloom felt

Manufacture from:1

- natural fibres
or

- chemical materials or textile pulp

However:

- polypropylene filament of heading 5402,

- polypropylene fibres of heading 5503 or 5506,

- polypropylene filament tow of heading 5501, of which the denomination in all cases of a single filament or fibre is less than 9 decitex, may be used provided their value does not exceed 40% of the ex-works price of the product

-jute fabric may be used as backing

- Of other felt Manufacture from:1

- natural fibres not carded or combed

or otherwise processed for spinning,

or
- chemical materials or textile pulp

- Other Manufacture from:1

- coir or jute yarn 2,

- synthetic or artificial filament yarn,

- natural fibres, or

- man-made staple fibres not carded or combed or otherwise processed for spinning

- jute fabric may be used as backing"

11. In Annex II, the rule for HS heading No 7006 shall be replaced by:

"7006 Glass of heading Nos 7003, 7004 or 7005, bent, edgeworked, engraved, drilled, enamelledor otherwise worked, but not framed or fitted with other materials:

- Glass plate substrate coated with dielectric thin film, semiconductor grade, in accordance with SEMII standards 1

- Other
Manufacture from non-coated glass plate substrate of heading 7006 Manufacture from materials of heading 7001

1 SEMII - Semiconductor Equipment and Materials Institute Incorporated."

12. In Annex II, the rule for HS heading No 7601 shall be replaced by:

"7601 Unwrought aluminium Manufacture in which:

- all the materials used are classified within a heading other than that of the product; and

- the value of all the materials used does not exceed 50% of the ex-works price of the product

or

Manufacture by thermal or electrolytic treatment from unalloyed aluminium or waste and scrap of aluminium"

Article 2

This Agreement shall be approved in accordance with the internal legal requirements of both Parties and it shall enter into force on the date of exchange of diplomatic notes.

IN WITNESS WHEREOF the undersigned plenipotentiaries, being duly authorised thereto, have signed this Agreement.

Done at Bratislava this second day of December, 1999 in two authentic copies in the English language.

Latvijas Republikas un Slovākijas Republikas līgums par izmaiņām Latvijas Republikas un Slovākijas Republikas Brīvās tirdzniecības līguma 3.protokolā

Atsaucoties uz 1996. gada 1. jūlijā parakstīto Brīvās tirdzniecības līgumu starp Slovākijas Republiku (turpmāk tekstā Slovākija), no vienas puses, un Latvijas Republiku (turpmāk tekstā Latvija), no otras puses, un tā 3. Protokolu par "izcelsmes produktu" jēdziena definīciju un administratīvās sadarbības metodēm,

Ņemot vērā Brīvās tirdzniecības līguma starp Slovākijas Republiku un Latvijas Republiku 38. panta nosacījumus,

Ievērojot to, ka 3. Protokola termina "izcelsmes produkti" definīcija ir jāmaina, lai nodrošinātu paplašinātās kumulācijas sistēmas, kas pieļauj Eiropas Kopienas, Polijas, Ungārijas, Čehijas, Slovākijas, Bulgārijas, Rumānijas, Latvijas, Lietuvas, Igaunijas, Slovēnijas, Eiropas Ekonomiskās Telpas (šeit un turpmāk "EET"), Islandes, Norvēģijas un Šveices izcelsmes materiālu lietošanu, atbilstošu darbību;

Ievērojot to, ka būtu jārekomendē turpināt piemērot līdz 2000. gada 31. decembrim 3. Protokola 15. pantā minēto noteiktas likmes maksājumu sistēmu saistībā ar aizliegumu atmaksāt muitas nodokli vai atbrīvot no tā;

Ievērojot to, ka būtu nepieciešams paplašināt kumulācijas sistēmu arī uz noteiktām Turcijas izcelsmes precēm;

Ievērojot to, ka būtu vēlams mainīt 3. Protokola 3., 4. un 12. pantu formulējumus, lai veicinātu tirdzniecību un vienkāršotu administratīvos uzdevumus;

Ievērojot to, ka jāprecizē apstrādes un pārstrādes noteikumu saraksts, kas jāizpilda neizcelsmes materiāliem, lai tie iegūtu izcelsmes statusu, ņemot vērā izmaiņas pārstrādes metodēs un atsevišķu izejmateriālu trūkumu,

IR NOLĒMUŠAS SEKOJOŠO:

1. pants

3. Protokols par "izcelsmes produktu" jēdziena definējumu un administratīvās sadarbības metodēm tiek mainīts sekojoši:

1. 1. (i) pants tiek aizvietots ar:

"(i) par "pievienoto vērtību" tiek uzskatīta ex-works cena mīnus katra iekļautā materiāla, kuru izcelsme ir kāda no 4. pantā minētajām valstīm, muitas vērtība vai, ja muitas vērtība nav zināma vai to nevar noteikt, pirmā cena, ko apstiprināmi maksā par šīm precēm Puses teritorijā."

2. 3. pants tiek svītrots.

3. 4. pants tiek aizvietots ar sekojošo:

"4. pants

Izcelsmes kumulācija

1. Nekādi neietekmējot 2. panta 1. paragrāfa nosacījumus, produkti tiks uzskatīti par kādas no Puses izcelsmes produktiem, ja tie ir iegūti tur, iekļaujot Eiropas Kopienas, Bulgārijas, Polijas, Ungārijas, Čehijas, Slovākijas, Rumānijas, Lietuvas, Latvijas, Igaunijas, Slovēnijas, Islandes, Norvēģijas, Šveices (ieskaitot Lihtenšteinu)* vai Turcijas izcelsmes materiālus, saskaņā ar līgumu starp šo Pusi un katru no šīm valstīm Protokolu par preču izcelsmes noteikumiem nosacījumiem, nodrošinot, ka kādā no Pusēm veiktā apstrāde vai pārstrāde pārsniedz šī Protokola 7. pantā minēto. Šādiem materiāliem nav jābūt izgājušiem pietiekamu apstrādi vai pārstrādi.

2. Ja apstrāde vai pārstāde, kas veikta šajā Pusē nepārsniedz 7. pantā minētās darbības, iegūtais produkts tiks uzskatīts par šīs Puses izcelsmes produktu tikai tad, ja vērtībā, kas tur pievienota, ir lielāka par izmantoto jebkuras no 1. paragrāfā minētās valsts izcelsmes materiālu vērtību. Ja tā nav, iegūtais produkts tiek uzskatīts par tās valsts izcelsmes produktu, kuras izmantoto materiālu ražošanai šajā Pusē vērtība ir vislielākā.

3. Produkti, kuru izcelsme ir kāda no 1. paragrāfā minētajām valstīm un kuri netiek pakļauti jebkādai apstrādei vai pārstrādei šajā Pusē, saglabā to izcelsmi, ja tiek eksportēti uz kādu no šīm valstīm.

4. Kumulācija, kas nodrošināta ar šo pantu, var tikt pielietota tikai attiecībā uz materiāliem un produktiem, kas ieguvuši savu izcelsmi piemērojot identiskus izcelsmes noteikumus šajā Protokolā minētajiem."

4. 12. pants tiek aizvietots ar sekojošo:

"12. pants

Teritoriālais princips

1. Izņemot kā noteikts 4. pantā un šī panta 3. paragrāfā, nosacījumi par izcelsmes statusa iegūšanu, kas noteikti II Nodaļā, turpmāk Pusēm jāievēro visos gadījumos

2. Izņemot kā dots 4. pantā, ja izcelsmes preces, kas eksportētas no vienas no Pusēm uz citu valsti, tiek atsūtītas atpakaļ, tās jāuzskata par neizcelsmes, ja vien muitas iestādēm var pierādīt, ka:

(a) atpakaļ atsūtītās preces ir tās pašas preces, kuras tika eksportētas; un

(b) tās nav tikušas pakļautas nekādām darbībām vairāk kā tām, kas nepieciešamas, lai saglabātu tās labā stāvoklī kamēr tās atradās šajā valstī vai kamēr tikušas eksportētas.

3. Izcelsmes statusa iegūšanu saskaņā ar II Nodaļā aprakstītajiem noteikumiem neietekmēs ārpus kādas no Pusēm veiktā apstrāde vai pārstrāde materiāliem, kuri eksportēti no vienas no Pusēm un pēc tam reimportēti tur, nodrošinot, ka:

(a) minētie materiāli ir pilnībā iegūti vienā no Pusēm vai tiem pirms eksportēšanas ir veikta apstrāde vai pārstrāde vairāk kā 7. pantā aprakstītās nepietiekamās operācijas; un

(b) muitas iestādēm var uzrādīt, ka:

(i) reimportētās preces ir iegūtas, apstrādājot vai pārstrādājot eksportētos materiālus; un

(ii) kopējā pievienotā vērtība, kas iegūta ārpus kādas no Pusēm, piemērojot šī panta nosacījumus, nepārsniedz 10% no gala produkta, kam tiek pieprasīts izcelsmes statuss, ex-works cenas.

4. 3. paragrāfa nolūkiem II Nodaļā aprakstītie izcelsmes statusa iegūšanas noteikumi neattieksies uz apstrādi vai pārstrādi, kas veikta ārpus Pusēm. Ja II Pielikuma sarakstā, nosakot gala produkta izcelsmes statusu, tiek piemērots noteikums, kas nosaka maksimālo vērtību visiem izmantojamiem neizcelsmes materiāliem, visu neizcelsmes materiālu, kas izmantoti ieinteresētās Puses teritorijā, kopējā vērtība, saskaitot kopā ar pievienoto vērtību, kas iegūta ārpus vienas no Pusēm, piemērojot šī panta noteikumus, nepārsniegs minēto daudzumu procentuāli.

5. 3. un 4. paragrāfu noteikumu piemērošanas nolūkā "kopējā pievienotā vērtība" nozīmē visas izmaksas, kas rodas ārpus Pusēm, ieskaitot tur izmantotos materiālus.

6. 3. un 4. paragrāfu noteikumi neattiecas uz produktiem, kuri neatbilst II Pielikuma sarakstā dotajiem nosacījumiem vai kuri var tikt uzskatīti kā pietiekami apstrādāti vai pārstrādāti tikai ja tiek pielietoti 6(2). pantā aprakstītie vispārīgie noteikumi.

7. 3. un 4. paragrāfu noteikumi neattiecas uz produktiem, kuri tiek aprakstīti Harmonizētās Sistēmas 50. līdz 63. grupās.

8. Jebkura veida apstrāde vai pārstrāde, kas ietverta šī panta noteikumos un kas veikta ārpus Pusēm, tiks veikta saskaņā ar līgumiem par ievešanu uz pārstrādi vai līdzīgiem līgumiem."

5. 15.panta 6.paragrāfā datums "1998.gada 31.decembrim" tiks aizvietots ar "2000.gada 31.decembrim";

6. 26.pantā termini "C2/CP3" tiks aizvietoti ar "CN22/CN23";

7. I Pielikuma 5.2. Piezīmē starp uzskaitījumu

"- mākslīgie pavedieni" un

"- sintētiskās štāpeļšķiedras no polipropilēna"

tiek ievietots sekojošais:

"- strāvu vadoši pavedieni".

8. I Pielikuma 5.2. Piezīmē piektais piemērs ("Tepiķis ar pušķiem ... svara nosacījumi.") tiks svītrots;

9. II Pielikumā starp HS pozīcijām 2202 un 2208 tiks ielikts sekojošais:

"HS pozīcija

Preces apraksts

Ar neizcelsmes materiāliem veiktā apstrāde vai pārstrāde, lai tie iegūtu izcelsmes statusu

2207 Nedenaturēts etilspirts ar spirta 80% vai vairāk no tilpuma; Etilspirts un citi spirti, denaturēti, ar jebkuru spirta saturu Ražošana:

- visus izmantotos materiālus klasificē pozīcijā citā, kā 2207 vai 2208"

10. II Pielikumā 57.grupas ieraksts tiks aizvietots ar:

"57. grupa Paklāji un citas tekstila grīdsegas:

- No adatu cauršūtā filca

Ražošana no:1

- dabīgajām šķiedrām, vai

- ķīmiskiem materiāliem vai tekstila pulpas

Taču var izmantot:

- 5402 pozīcijā klasificēto polipropilēna pavedienu,

- 5503 vai 5506 pozīcijā klasificētos polipropilēna pavedienus,

- 5501 pozīcijas polipropilēna pavedienu grīstes, kuru lineārais blīvums visos monopavediena vai šķiedras gadījumos ir mazāks par 9 decitekiem, nodrošinot, ka to vērtība nepārsniedz 40% no produkcijas ex works cenas

- džutas audumi var tikt izmantoti oderējumam

- No pārējā filca Ražošana no:1

- nekārstām vai neķemmētām vai citādi neapstrādātām dabīgām šķiedrām,

- ķīmiskiem materiāliem vai tekstila pulpas
- Pārējie Ražošana no:1

- kokosšķiedras vai džutas dzijas2,

- sintētiskās vai mākslīgās pavedienu dzijas,

- dabīgām šķiedrām, vai

- nekārstām vai neķemmētām vai citādi vērpšanai neapstrādātām sintētiskām štāpeļšķiedrām

- džutas audumi var tikt lietoti oderējumam

2 Džutas dzijas pielietošana tiek atļauta no 2000. gada 1. jūlija." ot;

11. II Pielikuma HS pozīcijas 7006 ieraksts tiks aizvietots ar:

"7006 Preču pozīcijās 7003, 7004 vai 7005 klasificētais stikls, izliekts, slīpēts, gravēts, urbts, emaljēts vai citādā veidā apstrādāts, bez rāmja, un nav kombinēts ar citiem materiāliem:

- stikla plāksne, kas pārklāta ar dielektrisku pārklājumu, pusvadītāju kategorija saskaņā ar SEMII1 standartiem

- pārējie
Ražošana no nepārklāta stikla plāksnes, kas klasificēta 7006 pozīcijā.

Ražošana no 7001 pozīcijā klasificētajiem materiāliem

1 SEMII - Semiconductor Equipment and Materials Institute Incorporated."

12. II Pielikuma HS pozīcijas 7601 noteikumi tiks aizvietoti ar:

"7601 Neapstrādāts alumīnijs Ražošana, kurā:

- visi izmantotie materiāli tiek klasificēti citā pozīcijā kā produkts; un

- visu izmantoto materiālu vērtība ex-works cenas vai

Ražošana no termiski vai elektrolītiski apstrādāta nekausēta alumīnija vai alumīnija atgriezumiem un lūžņiem"

nepārsniedz 50 % produkta

2. pants

Šis Līgums ir jāapstiprina saskaņā ar abu Pušu iekšējām likumdošanas prasībām un tas stājas spēkā diplomātisko notu apmaiņas datumā.

APLIECINOT IEPRIEKŠ MINĒTO, attiecīgas pilnvarotās personas ir parakstījušas šo Līgumu.

Parakstīts Bratislavā 1999. gada 2. decembrī divos autentiskos eksemplāros angļu valodā.
